EVESHAM TOWNSHIP, N.J. — Fire crews from the New Jersey Forest Fire Service and Evesham Fire-Rescue responded Sunday to a brush fire behind Woodlake Drive in the Kings Grant community
The fire affected approximately one acre of land, bordered on three sides by water
Crews worked to contain the fire and limit its spread
with smoke visible in the surrounding area
Authorities noted that smoke would remain present as operations continued
No injuries or damage to nearby properties were reported
Firefighters remained on scene to ensure the fire was fully extinguished and posed no further threat to the area

A 63-year-old man has been sentenced in New Hanover County in connection with the death of his father
Marshall Todd Anderson was sentenced to 18 to 23 years in prison for the killing of his 83-year-old father last February
according to a news release from the New Hanover County District Attorney's Office
The sentencing follows a homicide investigation at 905 Marlowe Drive in Kings Grant
The New Hanover County Sheriff's Office arrived at the residence shortly after 8 p.m
to conduct a welfare check on William Thomas Anderson -- the defendant's father
Prior coverage: Wilmington man charged with murder in connection with father's death
William's adult grandson reported him missing in the early evening of Feb
after stopping by to check on his grandfather
who had begun to display signs of dementia
The grandson found his father Marshall -- who had a history of drug abuse and altercations with William -- at the residence and claiming to have seen William just a minute prior
When the grandson began to search the house and yard for William
Marshall told him not to disturb the blue tarp in the backyard under which he claimed there was trash
The grandson began searching the surrounding neighborhood and placed a call to 911
Deputies thought Marshall may have been looking for William
but it was later determined that he had asked a neighbor to drive him to Walmart as patrol vehicles approached the property on Marlowe Drive
law enforcement located William's body under a tarp in the backyard
Medical Examiner determined he had been dead for at least a half day
with the cause of death ruled as blunt-force trauma
Marshall was later located by deputies walking down S
according to a prior news release from the New Hanover County Sheriff's Office
He was initially held in the New Hanover County jail under no bond
Judge Frank Jones presided over the sentencing and several of William's family members from the Tarboro area attended the hearing
"The grandson spoke at the sentencing and gave voice to the hardship that the defendant has inflicted on their family and loved ones
and the heartbreak when someone chooses drugs over their own family," the release reads

She was active in her community and church
serving as choir director of First Christian Church in Macclesfield for 50 years
She moved to Martinsville in 2018 to be near family
She enjoyed annual “girls’ trips” to Emerald Isle
Fla and John traveled extensively in the US and also visited Canada and England
They were especially fond of Sanibel Island in Florida and the Grapevine Canyon Ranch in Arizona
Fla developed many new friendships and enjoyed visits from family and friends from North Carolina
She looked forward to visits from her grandchildren and her great granddaughter
affectionately known to Granny as “the little princess.”
The family wishes to thank the staff of King’s Grant for their loving care of Fla
Memorial services will be held at King’s Grant Victory Chapel on Thursday
at 3pm and at Macclesfield Christian Church on Saturday
Family visitation will be held one hour before each service – in the King’s Grant Chapel and Macclesfield Christian Church Fellowship Hall

which is there with the New Jersey Forest Fire Service
But residents in the Kings Grant neighborhood will smell smoke
and the fire will smolder until there's soaking rain
Evesham Fire-Rescue shared the approximate area of the fire:
Evesham had two major wildfires in recent weeks — both around Sycamore Avenue in the southern portion of the township. A 14-year-old boy was charged with arson after one of the fires
and authorities are investigating whether the incidents are linked

This isn’t a KAT situation where he’s just bad at defending the rim but can play up next to a high-level rim protector
What they actually need is a high-level defender at the 4
allowing Sabonis to run the high post and smash the rim while hiding him on defense
Murray is a 3 as long as Sabonis is his teammate
but his fit with the team was always a problem
Playing Heurter over Keon Ellis doesn’t help
but that won’t solve all their problems
Trading Murray and a first for Walker Kessler might be the dumbest trade idea they could do
“He played the 4 in Indiana!” Yeah
Their defense with him at the 4 was irrevocably compromised
regardless of how well he played offensively or how hard Turner tried to back him up
and 29th in opponent’s PPG with Sabonis at the 4 in his 2.5 seasons as a full starter in Indy

the Blazers have two key players who are on the injury report
Both Deandre Ayton and Jerami Grant are on the injury report
Unfortunately for Trail Blazers fans, it doesn't look good for them. Grant is listed as doubtful due to right knee tendinitis
Ayton is listed out due to his left calf strain
It's going to be very difficult for the Blazers to make up that amount of ground with so few games left unless they get some of their guys back
They especially need Grant to help with the offensive load
Portland has been able to manage without Ayton
they might be playing better basketball now that he is out of the lineup because of how little he seems to care when he's on the court
The Trail Blazers need guys who are going to try their hardest on every single play in order to catch the Suns

Sacramento enters Thursday’s contest amid a rough patch as they have lost four consecutive games and they have also dropped eight of their last 10 matchups
They will now look to turn things around on Thursday against a Trail Blazers team that is also struggling as they have dropped six of their last 10 games including two straight
they may once again be without their starting point guard Malik Monk in Thursday’s contest as he is listed as questionable with an illness
Monk has missed Sacramento’s last three games due to an illness and if he is out once again against the Trail Blazers
expect Keon Ellis to continue to fill in for him in the starting lineup

Firefighters in a Putnam County town were kept busy with blazes at a condominium complex and residence on the same night
Carmel firefighters responded to a chimney fire on Kelly Ridge Road
The fires happened in Carmel on Saturday night
the town's fire department said on Tuesday
The first occurred at the Kings Grant Condominiums
where a cooking fire began in an appliance
crews were able to contain the flames to the appliance and prevent further damage
The second incident happened at a home on Kelly Ridge Road
Crews battled it for an hour before returning to service
Her fascination with the motor lodges and small mom-and-pop hotels that once dotted roadside America took hold during bucolic childhood summers spent in New England
Hussa can still tick off the names of the motels where she stayed as a girl
Her family visited OId Sturbridge Village and stayed at the 55-room inn on Route 20 (touted as just 1,000 yards from the Massachusetts Turnpike!)
They swam in the indoor heated pool and enjoyed meals in the restaurant
the American Motor Lodge is abandoned.’ This place that was the source of so many great memories was gone
I realized this is something that I could actually research and document in some way.”
She started documenting the phenomenon through her website, Dead Motels USA, which launched in 2018. She also introduced a Dead Motels Instagram account
which nearly 200,000 motel enthusiasts follow
Hussa’s website and Instagram account show Kodachrome-preserved photos and postcards of these motor lodges in their midcentury glory
There are still travelers with a taste for unique or retro accommodations
but the success stories are few and far between
the mom-and-pop motor courts have been slipping into ruin and fading from memory
She’ll only reveal the initial of her first name; she vaguely describes her profession as “the medical field” and her location as “somewhere in Virginia.” She wants the focus to be on the motels
She’s not looking to make a profit from her work
preferring that her website and Instagram account tell the sad stories of the rise and decline of the roadside inn
“It’s just more fun for me to separate my real life from this almost fantasy hobby,” she said
We got her on the phone from her home in Virginia to discuss the end of the family-owned classic motor lodge and how she’s cataloging these vintage gems
Are these motels fading from the map because they don’t fit current lodging tastes
have started to view these roadside motels as too trashy or sketchy for your typical American family vacation
I don’t believe they are seeking out small
quirky motels to stay in on their family vacation anymore
After seeing the abandoned American Motor Lodge in Sturbridge
But I imagine your family probably spent many summers in interesting mom-and-pop motels
I started with Sturbridge and then began researching places around where I grew up
or just closed buildings in every part of the country
and I never ran out of anything to research because it seemed like a never-ending topic
I don’t know if anyone else is researching to the extent that I am
At what point did you start hearing from people about their motel experiences
I’m guessing you get suggestions of places to research all the time
I think after I hit around 50,000 followers on Instagram
I really noticed a lot of people reaching out with suggestions
I can’t just go and drive to a place and explore
So it’s nice when people send me the recommendations and I can do that research from my couch
So it’s opened up many different areas of the country for me that I wouldn’t otherwise know about in terms of abandoned places
it now revolves around finding or staying in old motels
I visited the part of New Hampshire where I once lived
I drove around Lake Winnipesaukee and noted all the weird rundown and maybe even abandoned places
I sometimes stopped to take pictures and creep around
But I also got to stay in some of the cute motels I’ve admired for years
Not all hotels there were closed or rundown
Are there regions of the country where these classic motels have fared better than others
They’ve definitely fared better in some areas of New England
There are very specific areas of New England that really attract tourists
so a lot of the smaller places there have survived simply based on crowds and demand
Sometimes a motor lodge is your only option if you want to stay on the lake or near a beach
The before-and-after photos of the motels are captivating
but I think creating a coffee-table book should be your next project
A couple of people have reached out about coffee table book projects
but I just haven’t felt moved or compelled to do it

Collins and Grant could provide similar boosts to the team's bench scoring
although any deal for Grant would be complicated by his $32 million AAV contract
He is signed for at least two more seasons with a 2027-28 player option
The Kings are ranked 11th overall in net rating by the NBA
a sign that this team has room for improvement
McNair could hope some roster adjustments this winter will help the team achieve that potential while keeping Fox happy in Sacramento
Earlier reporting from Adrian Wojnarowski named the Kings as a legitimate suitor for DeRozan
who would need to be acquired via sign-and-trade
with a third team likely taking on salary from Sacramento in the deal
Sean Cunningham of FOX 40 Sacramento (Twitter link) confirms there’s “mutual interest” between DeRozan and the Kings, while James Ham of The Kings Beat (Twitter link) confirms Sacramento has talked to the Bulls about a sign-and-trade and suggests that a third team has been “lined up.”
However, there continues to be competition from rival suitors for the 34-year-old’s services, Ham adds. As John Hollinger of The Athletic writes
it also won’t be easy to construct a three-team trade that gets DeRozan the type of salary he wants
ensures the Bulls don’t take back much money
and has the Kings sending out enough assets to Chicago and a third team to incentivize them to make the deal
Although there are other teams who could open up a little cap room, Detroit and Utah are the only two teams with significant space still available, and the Pistons are rumored to be keeping their room open for trade opportunities
so it wouldn’t surprise me if Chicago and Sacramento have been talking to Detroit in relation to a possible DeRozan deal

Demar is basically a salary dump for the Bulls since they will refuse to take any money back
if the Bulls end up with a second rounder it’s about as good as they could do because of their utter failure at the deadline to act like they know how to run a team

Red Deer Polytechnic Athletics announced on Tuesday that Kings and Queens soccer players McKenna Leslie and Grant Johnson were named RDP Athletes of the Week
a first-year bachelor of education student from Red Deer
helped the Queens earn their third straight victory with back-to-back wins over the weekend in Medicine Hat and Lethbridge

according to the Columbia-Richland Fire Department
Firefighters responded to Tombee Lane and found heavy smoke coming from the property
Officials say fire was breaking through parts of the roof
Due to the humid conditions and large fire load coming from the house

Officials say the home suffered about $300,000 in damages
There were no injuries during the incident

A key player in a fight against a major development on State Road 206 near Interstate 95 could be removed from the case
The South Anastasia Communities Association no longer has standing to be part of the lawsuit over Kings Grant
according to an order by Circuit Court Judge Lee Smith this month
Johns County Commission voted in 2015 not to allow the 999-home
The 3-2 denial was based mainly on the belief the development was urban sprawl
the developers filed a lawsuit in circuit court challenging the decision
SACA petitioned to be co-defendant in the case with the county
SACA members focus on preserving "the rural Florida beach environment of South Anastasia Island and its associated communities," but the group gets involved in other parts of the county

King’s Grant Golf Club has gone through some rough times in recent years
Changes in ownership led to a decline in the condition of the golf course and the amount of play fell off
the course closed in September while a deal was worked out for another sale
But 2017 promises a brighter future for the course
thanks to three members who have pooled their resources to buy the course from Methodist University
Kevin Rodriguez and Chris Blanton are accomplished golfers who live at King’s Grant and have a vested interest in seeing it succeed
while some members own the other 49 percent under a business model set up by Methodist
The trio were part of the 49 percent before they took over the controlling interest
The course has re-opened with temporary greens but the permanent greens have been re-seeded and should be ready for play by the end of December
They are looking for a course superintendent
Rodriguez and Blanton are successful businessmen who are now taking on their biggest challenge
They sat down for an interview about their purchase and their plans for the future
Q: Why did you want to buy the golf course and keep it open
Rodriguez: It’s kind of a dream come true to own a golf course
The three of us are very passionate golfers
It’s our home course and we have an emotional attachment to it but it’s an opportunity for us to do something in the community
We’ve been working on this thing for basically a year
There were a lot of moving parts and that is why nothing has ever been done at King’s Grant before
So many different entities owned three or four different things
We thought with the three of us that we could do it
We knew everybody in the game and we brought it together
Blanton: I live out there so the home value is very important to me
I miss the course being in great condition
I haven’t played much out there in the last couple of years because it’s not been in good shape
I want to get back to the days of being able to hop into the golf cart and go out and play a great golf course
Q: What has been the reaction of the King’s Grant community to your purchase
Rodriguez: We’ve had more volunteers come out than we’ve had jobs for — from cleaning bathrooms
That’s what inspires us to know it’s going to work
we give them something they can be proud of
We need the golfing community to get behind us as well
We need them to tough it out with us just a little bit longer
Q: What makes you feel like you can make a success of King’s Grant since others have failed
Rodriguez: We feel very confident we can make it work with the neighborhood support and the plan we have in place
We’ve had several meetings in the neighborhood to tell them our plan and let them ask questions in an effort to rally support and be just up front with everybody
We gained a lot of support from it and as things change
Robinson: Chris has been in charge of membership and we’ve gotten well over 100 social memberships in this interim period
We have support from the neighborhood that hasn’t been there before and most of it is because we are asking for it
no one’s ever asked me to join to club or no one’s ever talked to me
Q: What sort of work do you plan to get the golf course in shape
Robinson: We will re-do the greens again next May and June
There will be some new bunkering and we have plans to remove some trees
do some cart path repairs and other things
it was by far the best conditioned course around here
they’re shading the greens and they are not getting enough sunlight and air flow
living organism and there are things you have to do to take care of it
It just hasn’t been taken care of like it needs to be
There are lots of irrigation and drainage issues that we have to take care of
Blanton: We’re fixing it up and getting it back to a basic standard of play
The members thought it was in great shape in June
Kevin and I have played at Kiawah Island so when we think great
We feel we can have this golf course in the best shape of any
Q: Methodist changed the order of play for the holes
Why did you change it back to the original design
Robinson: They did it so they could monitor the first hole from the clubhouse
People started teeing off on the back nine without checking in so it didn’t accomplish what they thought it would
The last five holes are supposed to be your toughest five holes
Blanton: It was such a hard start for the average golfer
You had to hit over water twice on the first hole
then you get the toughest par-5 on the course followed by the longest par-3
Q: Why are you three people the right ones to buy this course
Rodriguez: One of the advantages we have is the golf course is not how we make our living
We can’t afford to lose money but we don’t have to pull money out of it
put it back into the course and get it to where it needs to be
Blanton: Anybody else that would have bought this place would need to instantly make money on it
If you’re trying to make money on it and fix it up at the same time
Robinson: There have been people in there who just didn’t listen to what was needed and
East Coast Management kind of did their own thing and wanted things to go a certain way
They had no participation from anybody around there and people didn’t support it
Q: What are your plans for the future of King’s Grant
Robinson: We have a swimming pool and it will be up and running next season
We have a clubhouse committee and we have started looking at what’s needed
We don’t know how long that process will take but that’s our goal to do that
Rodriguez: We have to have another attraction for the community to rally behind besides golf
The social aspect of membership is very important
We have to bring people there who don’t play golf and have something to offer
We want you to be able to come there as a family and everybody has something to do
Robinson: There has to be a diversity in where to play golf
more established country clubs in Fayetteville
The other ones are more daily fee type places and we want to be somewhere in between
We want members and we want to have a country club atmosphere feel to it

“The King’s Grant litigation was voluntarily dismissed yesterday by the plaintiffs,” County Attorney Patrick McCormack told The Record in an email
“Throughout the four and a half years of litigation
the Board of County Commissioners stood strong in defending its decision to deny the Kings Grant PUD application for reasons stated in the 2015 public hearing
“While the County Commissioners are fully respectful of private property rights
they are protective of the County’s Comprehensive Plan
There has been a fair amount of public pushback against the large residential project
which also included hundreds of thousands of square feet of commercial space on the 772-acre parcel
An attempt at a settlement with the county was made in 2018
but the Commission voted against that plan as well
The offer included millions more in infrastructure improvements
One the main opponents of the King’s Grant project
the citizens’ group South Anastasia Communities Association
was worried that the county would accept the settlement offer
Its leadership was relieved when the Commission remained opposed to the project and is obviously happy with this week’s happenings
“We appreciate the county standing tough the whole time,” said Keto Burns
“We are on guard and cautiously optimistic.”
Burns said all SACA members understand that the new ownership of the property might have development plans of its own
He just hopes they aren’t like the previous plans
Although the county’s Comprehensive Plan does pinpoint the area for some kind of future development
opponents of King’s Grant pointed out that something so intense is not exactly what the Comp Plan suggests
SACA would like the land to be used in a way similar to what it’s now used for: silvaculture
“A lot of people look at it as land that something has to be done with
but timber and silvaculture is really important,” Burns said
If something unsavory is proposed by the new owners
it’s likely that SACA will again dig in its heels
Burns said county residents are alarmed by overdevelopment and that they don’t want everything turned into master-planned communities
It’s the county’s diversity that makes it interesting
A complaint filed in Superior Court in Burlington County accuses the Kings Grant Maintenance Association of misappropriating more than $600,000 from one of the condominium associations in the Evesham neighborhood
Medford attorney Paul Leodori filed an order to show cause on behalf of the Kings Mill at Kings Grant Condominium Association
The association represents the 82 housing units in Kings Mill
which is one of Kings Grant’s 12 neighborhoods in the southern end of the township
The complaint alleges that the Kings Grant Maintenance Association is an “anachronistic
monopolistic enterprise which has engaged in a pattern of malicious
fraudulent and deceptive activity for at least the last 14 years.”
the association had been the “management agent and administrator” for Kings Mill since 1985 until the agreement was terminated on Nov
and an attorney and auditor who represented the association are also named as defendants
Among the allegations in the lawsuit are that $417,305 for capital improvements such as new roofing and decks were supposedly put in reserves but never turned over to Kings Mill
and that more than $4,300 in payments has been made to association employees’ pension benefits without authorization
The suit also alleges that the association has overcharged for management services and that more than $200,000 has been misappropriated for other communities in addition to the $600,000 from Kings Mill
The suit asks that the maintenance association’s financial documents be turned over
and that a receiver be appointed by the court to monitor the association’s dealings and to represent the individual communities’ “interests against the abuses of KGMA (Kings Grant Maintenance Association).”
because we believe there is absolutely no reality to the claims,” Angstreich said
adding that he will ask that the complaint be dismissed
The complaint also takes issue with about $3,100 in payments made to Angstreich for his legal services
alleging that his “conduct in both billing and accepting payment from Kings Mill on behalf of KGMA violated” rules of professional conduct
“I think it shows you the malice of the KGMA and the people that operate the KGMA,” Leodori said of payments made to Angstreich allegedly using Kings Mill monies for litigation involving the neighborhood
He said the other communities are named as defendants because the maintenance association has contended that Kings Mills owes about $24,000 to them
This is not the first time Leodori has been involved in litigation involving Kings Grant
he represented a group of homeowners in the Oak Hollow section that was looking to oust members of that neighborhood’s association
Oak Hollow was one of three associations to break away from the Kings Grant Maintenance Association after a 2001 New Jersey Supreme Court decision cleared the way for individual associations in each Kings Grant community

King's Grant Golf and Country Club may close at the end of August

Monk said the course has made money since he took over the lease agreement
But Hancock's letter did not sound encouraging for King's Grant
which is surrounded by 450 homes with an average tax value of $318,000
Hancock wrote that Methodist had been negotiating with prospective buyers for 150 days
"We wanted to provide these prospective buyers with every opportunity to complete the purchase
but learned late last week that their offer had been withdrawn," Hancock wrote
Among those prospective buyers was a group that includes Chris Blanton and Gary Robinson of Fayetteville
who was critical of how Methodist has managed the course over the years
said the group couldn't reach an agreement because of a dispute over 10 acres and problems with a lake dam that the state has labeled high-risk of failure
Blanton said the dam could cost hundreds of thousands of dollars to fix
The 10 acres that had been in dispute is owned by a group that includes Chris Manning
one of the original developers who helped lead Methodist to buy King's Grant
The driving range and part of the maintenance shed and clubhouse sit on the 10 acres
Manning's group has allowed King's Grant to use the property
but someone other than Manning would not agree to sell it
Blanton said he still hopes his group "can pull a rabbit out of the hat" and buy the course from Methodist
Hancock wrote that Methodist's trustees agreed nearly two years ago that the university should no longer operate King's Grant at a loss and should either sell its interest or enter into a long-term agreement with a management company to end the shortfall
Methodist spokeswoman Sandy Ammons said Friday "the university's decision to cease operating King's Grant Golf Course was not an easy one
but represents the best interests of the university and its financial well-being."
Methodist bought the majority interest in the course in 2007
Methodist's main intent was to woo even more students into its acclaimed golf management program
largely because of a rule change limiting the number of students in the program
a decline in golf's popularity and an increase in similar programs throughout the country
as they call themselves - were excited about Methodist taking over the course
Members say the course has deteriorated since Methodist stepped in
A leasing company from South Carolina took over management of the course
but members say it didn't fare any better at keeping the course in good shape
Methodist entered into a leasing agreement with Monk
said Monk has greatly improved the course this year
"We are all just kind of in shock,'' Jensen said
Hancock said the agreement with Monk was never intended to be long-term
"We were willing to operate at a loss for these past six months because of negotiations underway for a sale and to maintain operations as long as feasibly possible for the King's Grant community," Hancock wrote
Blanton said he doesn't understand why Methodist would let the course close
The university would continue to lose money
and King's Grant would lose even more value if membership disappears and the course goes to seed
though most of it is being plowed back into improvements
"The course is vastly better off since Feb
1 than it has been in the last 10 years," Monk said

a buzz grows as residents express worries about more homes in the area
The giant 48-year-old private lakes development with 2,507 homes
condos and townhouses already taxes the two-lane Taunton Lake Road

And the buzz has grown recently as the owner of the Links Golf Club has requested rezoning for its clubhouse to allow the building to connect to the Township sewer network and to turn off its burdened septic-sewage disposal system
The owners say they need to be on the public sewer network to add amenities to the clubhouse
Residents worry that rezoning will open the door to converting the golf course into residential housing — something that Township officials maintain would not happen because of Pinelands and other restrictions
Evesham Township Council on Wednesday night will hold a public hearing on the zoning ordinance change for the Links clubhouse as well as a zoning change for the now-closed Barton Run Swim Club

but they also said they were insistent on making sure the golf course is never developed
"In this ordinance are there any protections that would prevent the landowner of the golf course from developing the golf course besides the clubhouse?" asked Councilwoman Ginamarie Espinoza

"Does the ordinance only allow the golf course landowner to only develop the clubhouse?" asked Espinoza
"Without those protections in this ordinance
I cannot support this ordinance," said Espinoza
She said she had met with community members and heard their concerns about development in Kings Grant
Espinoza was not the only Council member who wanted more specificity in the zoning change
"I know there have been ongoing discussions and continuing discussions as far as providing those protections that Councilwoman Espinoza is speaking of," Councilman Eddie Freeman III told fellow Council members at the March 9 meeting
I want to note that I will go ahead and vote for it tonight
if those discussions break down or if those protections are not there then I don't think we can go forward with this ordinance."
Freeman noted: "Ten years from now I don't want to see
or I don't want it to be a possibility to see
Councilwoman Patricia Hansen also said she was worried about the lack of restrictions
Hansen and Espinoza voted against the ordinance on first reading
Mayor Jaclyn Veasy and Deputy Mayor Heather Cooper voted to move the ordinance to its second reading and a public hearing
told Council at the March 9 meeting that the plan said that only the clubhouse is being rezoned so it can connect to the public sewer system
"It's not an effort to open that property to development with multiple homes and with some purpose other than the clubhouse," Drollas said
The rezoning of the clubhouse and the former swim club to Rural Growth from Rural Development was part of the "General Reexamination and Master Plan Amendment" that was presented in December and adopted by the Township Planning Board on January 20
"The Links Golf Club clubhouse requires repairs, including a failing septic system, where failing private septic systems negatively impact water quality," according to that report
"The clubhouse property but not the golf course is proposed to be included within the RG District
which will permit functional improvements to the Club
and marital suite consistent with current consumer expectations for these types of facilities."
The report also singled out the former Barton Run Swim Club
noting that it "once included a swimming pool
and other improvements and the availability of public water and sanitary sewer
it can be developed with residential dwellings
the community is requiring a set-aside to provide public open space and passive recreation improvements."

Baruch Foundation’s claim to about 8,000 acres of marsh adjacent to Hobcaw Barony will resume following a ruling by the state Court of Appeals last week that allows property owners at DeBordieu a role in the legal proceedings
A three-judge panel overturned a Circuit Court judge’s 2020 ruling that the DeBordieu Colony Community Association could not intervene in the suit
The court rules “set a liberal standard for intervention
Denying intervention here was inconsistent with that standard,” Judge Blake Hewitt wrote in the opinion
Chief Judge Bruce Williams and Judge Letitia Verdin concurred
“We appreciate the court’s analysis of our arguments and their decision,” said Blanche Brown
the Baruch Foundation’s executive director
“We’re glad to have that resolved and ready to move forward,” he said
The foundation filed suit against the state in the fall of 2019 seeking a ruling that it has a king’s grant title to the marshlands within North Inlet adjacent to about 8,000 acres of uplands at Hobcaw. The property is the site of research by the University of South Carolina’s Baruch Marine Lab and the federal North Inlet-Winyah Bay National Estuarine Research Reserve
“The marine biology is core to the foundation’s mission
“Protecting the ownership is the goal that allows them to do that
The state asked the court to deny the foundation’s claim or to declare that the public had a prescriptive easement over the marsh
The DeBordieu association sought to intervene
saying that the state could not adequately represent its members
who have an economic interest in the outcome of the suit
It also claimed a prescriptive easement to the marsh
Judge Paul Burch denied the association’s motion because its claims are not “a ripe controversy” because the Baruch Foundation had not “and may never” exclude its members from the marsh
The foundation had argued that even if the court upholds its claim to ownership the right to use the navigable waters of North Inlet would not be impaired.
The Appeals Court found that the judge erred in applying the rules that allow third parties to intervene in lawsuits.
it is undisputed that DeBordieu timely filed its motion
through its counterclaim for a prescriptive easement
DeBordieu is unquestionably claiming an ‘interest’ in the disputed property
barring DeBordieu impairs or impedes DeBordieu’s ability to protect its claimed interest,” Hewitt said in the decision
A fourth factor – whether the outcome of the case might impair a party’s ability to protect its interest – “is not designed to be a difficult standard,” he said
It would be “contrary to the mandate of judicial economy” to deny DeBordieu a role “in a suit that is meant to determine the rightful property owner over a parcel over which DeBordieu claims an easement,” Hewitt said
Even though the state and the association both claim prescriptive easements
the former is for the general public and the latter is for association members
“The State’s and DeBordieu’s easement claims are independent of one another
and are different claims requiring different proof,” according to the Appeals Court decision
While the Baruch Foundation argued that DeBordieu could not intervene because it was not claiming ownership of the marsh “we do not see how any statute or precedent supports this being a meaningful distinction,” Hewitt said
He noted that there are many examples of cases where adjoining landowners were able to intervene without claiming ownership of disputed property
“DeBordieu’s participation many prolong the litigation by adding an additional party
but trying to keep them out of the case seems to have already done that,” the judge said
The judges also agreed the fact that the Baruch Foundation had not tried to exclude anyone from the marsh did not mean the DeBordieu association’s claim was not ripe
“The law does not require an easement holder to idly sit
“Not only is there a live controversy between Baruch and DeBordieu
but DeBordieu is a real party in interest by the mere fact that it claims an interest in the marshlands.”
“We were pleased with the way the decision was written,” Brown said
but everyone who recreates in the North Inlet estuary.”
Before the association filed its appeal in August 2020
the Baruch Foundation filed a motion to dismiss two of the state’s counterclaims
It argued that a prescriptive easement could not be established because access had been over navigable waters and not over a defined area.
To say it applied to all 8,000 acres “would constitute adverse possession,” which it said the state had not established
“The public has a constitutional right to use navigable waters and such right is not adverse to the title of the owner of the land under those waters,” the foundation said in its filing
That also applies to the state’s claim of “implied dedication” of the marsh to the public
The claim is based “on the public’s alleged recreational use of the navigable waters over the property in question
Implied dedication cannot arise from recreational use as a matter of law,” the foundation argues

One man was shot and killed after a verbal argument in Fayetteville on Thursday night
a news release from the Fayetteville Police Department said.
police went to the 500 block of Coronation Drive off Ramsey Street near King's Grant Golf & Country Club in response to a shooting
officers found an adult man with at least one gunshot wound; he was pronounced dead at the scene
His identification is pending next of kin notification

the preliminary investigation revealed that there was an argument outside of a residence on Coronation Drive that escalated into gunfire.
Police were not immediately available to clarify how many people were involved in the incident
