The University of South Carolina Upstate recently hosted its annual First-Year Reading Program event
where students were introduced to the program’s powerful
transformative theme through “The Home Place: Memoirs of a Colored Man’s Love Affair with Nature” by renowned ornithologist and author J
which fosters a love for reading and encourages critical thinking
selected this memoir to help students explore complex issues that weave through personal identity
and the shared history of communities across South Carolina
The memoir captures Lanham’s journey growing up in rural Edgefield County
he reflected on his life’s work as a naturalist
presenting his story as one that challenges conventional narratives about Black identity and environmentalism
His words were both a celebration and a call to action for students and faculty alike
urging them to connect deeply with nature and understand how identity shapes our perceptions of the world around us
Lanham stated “We have the responsibility to speak out as loudly as we can to work towards undermining the crises where we might.”
thanking him for bringing his insights to the university’s new students
expressed his gratitude for the opportunity to share his story
emphasizing that his writing reflects a personal “love affair with nature.” He offered students the chance to ask any questions
welcoming dialogue and assuring them that curiosity was at the heart of understanding
Lanham recounted his connection with nature as both scientist and storyteller
capturing the students’ attention with his vivid recollections of Southern landscapes and his reflections on the joy and solace he finds in the wild
He spoke candidly of being a “wild boy of forests and fields,” feeling at home on backroads and woodland paths
his identity shaped as much by his ancestry as by his love for the outdoors
His words emphasized that the world of nature embraces diversity effortlessly
never questioning his right to belong—a stark contrast to the societal prejudices he has encountered
Senior Instructor in the Department of Languages
thanked Lanham for his ability to reach her students
stating “Your writing has inspired some of the best personal narratives that I have received in 25 years of teaching
so it is magic and the students have talked so much about the quality of your prose
And they’ve been able to sort of dive deep and I see the influence of your work in their writing.”
Lanham challenged students to consider how language
He underscored the power of words to challenge complacency and to address societal crises
urging students to use their voices for good
no matter their medium—whether through poetry
By grounding his reflections in the context of environmental conservation and racial identity
he shared his belief that art and science together can guide people toward a more just and inclusive world
USC Upstate’s First-Year Reading Program once again affirmed its commitment to fostering dialogue and broadening perspectives
get out of your heads” resonated with all in attendance
it was clear that Lanham’s message had left a profound impression
setting the stage for a year of critical thinking
and transformative learning for the students at USC Upstate
The Preface Author’s Night is an engaging way to introduce students to different genres and spark their curiosity for reading
Senior Instructor Tasha Thomas explained the selection process
“The composition department typically chooses one book
we teach nonfiction or creative nonfiction; this year
we’ve explored collections of essays and novels.” Thomas emphasized that the goal is to select books with contemporary relevance and high interest
so students will genuinely want to read them
“To enhance and enrich the topics brought up in the text
we organize various activities beyond the classroom
but we’ve also had campus strolls for bird watching
and we’ve hosted talks related to themes in the book—such as discussions on ecology and human interaction with the environment
These activities aim not only to deepen the understanding of the reading but also to encourage students to connect in new ways,” Thomas shared
“Our true motivation is to bring students together outside the classroom
offering them opportunities they wouldn’t normally have to interact and learn.”
A few notable awards for “The Home Place” include Winner of the Southern Book Prize
Winner of the Reed Award from the Southern Environmental Law Center
and Finalist for the John Burroughs Medal

Lanham started the indoor campaign as a major athlete to watch for the Roos and made his name known on the national level quickly

and has now agreed to join the band full time
Wayne has a strong sense for harmony lines and arrangements and
although he has touched on all the vocal parts at one time or another
He looks forward to the opportunity to sing many of the Country Gentlemen songs that have inspired him over the years
Eric and I are very pleased to add Wayne to the Country Gentlemen Show
Wayne’s first official gig with us will be Friday
May 9 for the James River Bluegrass Association at the Madison Heights Community Center in Madison Heights
The Country Gentlemen Show was started back in 2005 by longtime Gents bass player Bill Yates
in response to the passing of Country Gentlemen founding guitarist Charlie Waller
The entire purpose was to keep the music of the Country Gentlemen alive
hence the “Tribute Band” in their name
Now that they are also recording new music in the style of the original Gents as well
a must see for any dedicated fan of the Gentlemen
and an excellent introduction to their sound for the uninitiated

many businesses have come to rely on online marketing campaigns
whether they do their marketing in-house or hire an outside service
should be aware of the potential for liability under the Lanham Act
This article will examine some of the ways an unsuspecting client could be liable for false advertising on the internet without even knowing it. Courts are just beginning to grapple with some of these emerging trends. But as Judge Learned Hand wrote, “there is no part of the law which is more plastic than unfair competition, and what was not reckoned an actionable wrong 25 years ago may have become such today.”[1]
What constitutes a “literally or impliedly false” message is by far the most litigated issue in this area. While a literally false message is “false on its face,” an impliedly false message is “not literally false, [but] is nevertheless likely to mislead or confuse consumers.”[4] Where the challenged message is literally false
Where the challenged message is impliedly false
consumer deception must be proved typically through expensive consumer surveys and studies
As for damages, the courts have “some degree of discretion in shaping th[e] relief.”[7] Thus
a business accused of false advertising could face significant monetary damages
corrective advertising costs and attorney’s fees
Upheld jury awards regularly reach tens of millions of dollars
Google search is the number one driver of traffic to businesses
But how are these search results prioritized
advertisers bid on keywords so that their website links and ads appear higher than their competitors in the search results
This is a great way to be seen and drive traffic
but there are a few ways that an unmonitored Google Ads campaign could subject a business to significant liability
liability may attach if the search result or the website landing page includes the competitor’s name or causes consumer deception
Of particular concern in Google Ads is a tool called dynamic keyword insertion
which allows advertisers to dynamically update displayed ads to include the user’s search query
if you search for “toddler shirts,” you might see a sponsored link that says
“Buy Toddler Shirts on Sale.” When used properly
this tool creates targeted ads that will increase consumer engagement
the dynamically inserted keyword could misrepresent the product or service or suggest an association with a competitor’s brand when there is none
if you search for “cotton toddler shirts” but the advertiser now manufactures polyester shirts only
liability may attach for a sponsored link that says
if a competitor’s name or a phrase resembling it is included on the advertiser’s dynamic keywords list
this could mislead consumers to incorrectly believe that they are visiting a website associated with the competitor
Google Ads is one of the most powerful tools for both brick-and-mortar and online businesses alike
business owners should disengage the cruise control and pay close attention to their Google Ad campaigns before a lawsuit threatens their livelihood
While researching a product or service on the internet
you have likely come across blogs and videos by influencers concerning said product or service
Compensating third parties for these reviews and endorsements is not inherently unlawful and is a common practice known as affiliate marketing
Businesses freely enroll third parties into their affiliate marketing programs without reviewing or monitoring their content
a wildly popular influencer could conceivably ruin a business with a single disparaging remark about a competitor
While affiliate marketing is a great way for businesses to reach new customers
these programs must be monitored closely for Lanham Act compliance
Hiring a local digital marketing firm to implement and administer the Google Ads and affiliate marketing programs should insulate a business from liability, right? Wrong. Under the Lanham Act, intent and bad faith are not elements in what is a “regime of strict liability.”[13] Thus
although the marketing company may be a co-defendant in the lawsuit
the business is ultimately responsible for the harm inflicted on competitors
Kamran Hashmi is the owner and principal attorney of Hashmi Law Firm in Rochester
He devotes a large portion of his practice to advising and representing clients in business-to-business disputes
including false advertising under the Lanham Act

Lanham Leads the Charge: Roos Sprinters Shine in 2025 Indoor Season3/17/2025 12:50:00 PM | Track and Field
Kansas City broke school records in the 60m
400m races and saw Tory Lanham take home Summit League Indoor Championships Men’s Track MVP honors
Kansas City finished seventh of the men's side at the end-of-year conference meet
Heading into this year's indoor track and field season
the Roos were pegged to come in sixth place on the men's side
The Roos took a key step forward in 2025 by closing out the season with a fifth place finish at the Summit League Indoor Championships and exceeding their preseason expectations
The Roos year-by-year progression has been spotlighted by their talented group of men's sprinters, who earned a grand total of eight medals at the big conference meet. Leading the pack for the Roos was Tory Lanham
who grabbed himself three medals including a gold in the 200-meter dash and won Summit League Indoor Championship Men's Track MVP
"I came into this past indoor season with the mindset that I was going to do well because of how I performed in the outdoor season last year
I wanted to compete for that MVP spot and put my all on the track and that's exactly what I did," Lanham said in an interview with Kansas City Athletics
Lanham came into the indoor season as a Summit League 'Athlete to Watch' in the preseason and lived up to the billing early into the indoor season
running a 21.01 at the Alexis Jarrett Invitational back in January
The time instantly became the Roos new 200-meter men's indoor program record and put Lanham in prime position for more success
That gave me the motivation to keep going and lower that time to under 21 seconds," Lanham stated
Lanham bested his previous program record with an even better time of 20.93
becoming the only Summit League 200m runner to break the 21-second barrier and the first to do so in Kansas City school history
Lanham's consistency was a testament to his training and preparation off the track
All of that goes into how you perform on the track
I would say those improvements contributed the most to my success this season," Lanham said
"I was training a lot of short-sprints but coach also threw in 400m workouts which helped me build more endurance and stay fast for the 200m and 4x400m
The training really helped me become more well-rounded for everything I had to do at conference," Lanham said
At the 2025 Summit League Indoor Championships
Lanham took gold in the 200m with a time of 21.07 seconds
the MVP won the silver medal in the 60-meter dash due to a time of 6.82 seconds and ran the second leg of KC's silver medal 4x400-meter relay squad
The sophomore sprinter is a KCMO native who graduated from Oak Park High School in 2023 before becoming a Roo
Lanham dealt with a series of setbacks that challenged him in several ways
"I had a pretty untypical high school career
My sophomore year there wasn't a season due to the pandemic and my junior year I ended up fracturing my hip," Lanham said
"My senior year I got my 100m time down to 10.4 and so I started looking at schools to run at the collegiate level
UMKC was very close and they offered me a scholarship which I took."
The Roos' gifted group of short-distance runners have an 'iron sharpens iron' mindset that has led to tremendous amounts of success for the men's sprinters. Additionally, the steady guidance of Head Coach Beanud Shirley and Assistant Coach Clif Mitchell has had a profound impact on Lanham and the entire team
We work and move as a team and we keep our team morale high at all times
They do a lot for me and I wouldn't be able to have my success without them," Lanham stated
"The coaches have put me in a great position to succeed here
They know what they're talking about because they've been doing this for so long
They know how to train their athletes and get them better
which you can see through how our team developed this season," Lanham said
Lanham is hungry for more as the defending 200-meter Summit League outdoor champion will look to retain his crown and earn a time good enough to qualify for the regional and potentially national meets in May and June
I want to get my 200m time down and make the regional meet
I want to win the 200m at conference again and have a spot on our 4x100m and 4x400m teams," Lanham said
On February 26, the U.S. Supreme Court in Dewberry Group, Inc. v. Dewberry Engineers Inc. unanimously held that an award of “defendant’s profits” under the Lanham Act in a trademark infringement suit is only ascribable to the “defendant” itself—not its affiliates
sued Dewberry Group for trademark infringement and unfair competition for its unauthorized use of the term “Dewberry” for related real estate services
The District Court ruled in favor of Dewberry Engineers and awarded the plaintiff nearly $43 million based on the total profits of the defendant
“as a single corporate entity.” The Court of Appeals for the Fourth Circuit affirmed the award
the Court reversed the Fourth Circuit’s decision and determined that the district court erred in granting Dewberry Engineers the $43 million award
The Lanham Act provides that a plaintiff is entitled to recover the defendant’s profits in a trademark infringement lawsuit
the Court clarified that the term “defendant,” as referenced in the statutory text
is “the party against whom relief or recovery is sought in an action or suit.” Therefore
since Dewberry Engineers did not add Dewberry Group’s separately incorporated affiliates as defendants in the lawsuit
the only named defendant in this case was Dewberry Group
the Court analyzed the principles of corporate law and concluded that “separately incorporated organizations are separate legal units with distinct legal rights and obligations.” Although there may be circumstances that allow a court to “pierce the corporate veil,” the plaintiff here did not demonstrate a need for such veil-piercing
Dewberry Engineers argued that the Lanham Act includes a “just-sum provision” or “second-step analysis” that enables a court to grant an award in an amount that “better reflects the ‘defendant’s true financial gain.’” In its determination of such an award
a court may consider the profits of a defendant’s related entities
Dewberry Engineers contended that the District Court and Fourth Circuit employed the just-sum provision in assessing an award based on evidence of Dewberry Group’s affiliates’ profits
The Court disagreed and found that the lower courts did not assess the $43 million award based on the just-sum provision
but calculated it based on the theory that Dewberry Group and its affiliates should be treated as one corporate entity
The Court further concluded that granting an award including non-defendants’ profits exceeded the scope of the Lanham Act
the Court vacated the judgment of the Fourth Circuit and remanded the case for further proceedings to determine a new award and consider several unanswered questions concerning the just-sum provision
a defendant’s tax records in the determination of its “true financial gain,” and the availability of corporate veil-piercing as an option on remand
Justice Sotomayor highlighted the principles of corporate separateness and emphasized that such principles do not prevent courts from considering economic realities in assessing a defendant’s profits
Justice Sotomayor also concluded that courts might consider other accounting arrangements between a defendant and its affiliates to determine the defendant’s profits
With the Court’s clarification of “defendant’s profits” under the Lanham Act
plaintiffs should consider different options to maximize awards in trademark infringement suits
Such options may include naming multiple defendants
or demonstrating a need to pierce the corporate veil
the lower courts will provide further guidance on a plaintiff’s available remedies
as well as an understanding of the statutory language regarding profits under the Lanham Act

The Lanham Brothers Jamboree is set to return for its spring show on March 8 at the Bluegrass Music Hall of Fame & Museum, promising another night of music, comedy, and audience participation.
The show, led by brothers Barry and Randy Lanham, has been a staple of Kentucky entertainment for 19 years, blending bluegrass, country, gospel, and clogging into a family-friendly variety performance. After launching a spring edition last year in response to audience demand, the Lanhams are bringing it back for a second time.
“We’re thrilled to be back at the Hall of Fame and Museum,” Barry said. “The venue is state-of-the-art, and their team is excellent to work with—from lighting and sound to ticket sales and seating assistance.”
Each show offers a unique lineup of talent, and this year’s spring performance will feature several new and returning acts. One of the highlights will be Rick Faris, an Owensboro-based luthier who crafts instruments and is an accomplished musician and singer.
“Rick is bringing something really unique to the show,” Barry said. “We’ve never had him on before, and we’re excited for what he’ll add.”
Other performers include young fiddler McKenzie Bell, crowd favorite Wayne Morris, and vocalists Lucy Jagoe Chaney and Emmy Kate Williams. The Foot Stompin’ Express Cloggers will once again showcase Kentucky’s state dance.
The Jamboree is also recorded for KET, offering audience members a chance to see themselves on television. Audience participation remains a key element of the show, often leading to spontaneous and lighthearted moments.
“You never know when you’ll be part of the show,” Barry said. “People will tell me it’s someone’s birthday or anniversary, and we have a little fun with them on stage. It’s all in good fun.”
The Lanham Brothers Jamboree is known for its relaxed, humorous atmosphere, with the brothers’ banter serving as a signature part of the experience.
“We have a great time up there,” Barry said. “It’s a very Kentucky-style show, full of music, dancing, and comedy. It’s a tradition we love to share.”
With only one spring performance, Barry expects tickets to go quickly.
The show begins at 7 p.m. Tickets are available through the Bluegrass Music Hall of Fame & Museum.

There isn’t a gun violence problem. It’s gang violence; it’s not even a city issue. The police do what they can be arresting the offenders. This is a poorly written question. All it is is anti-gun bias on its authors part.
Add and grow small businesses. Add new revenues instead of raising taxes.
Don’t turn away things like more Marijuana dispensaries like the council did in 2023.
That revenue would have eased other tax raises since then. The third largest city could probably even support 1 more either on a retail or agricultural level. It’s licensed legal and highly regulated industry. It’s free money for Joliet.
Does the city or HAJ even have the funds? This would probably require federal grant money to actually do anything.
Fiscal responsibility means stop wasting money even things like that $85,000 trolley
Stop denying new businesses, especially the ones not politically connected
What does this even mean? What business in joliet would even harm the environment? Except maybe all these warehouses and their 100s of 1000s of trucks that some on the council support and take money from.
Does the city even do anything now? Metra and Pace aren’t run by Joliet; those are outside agencies.
Encourage and support it. Be more open to approvals.
Dont think because theyre minority owned there will be problems
Don’t worry if it will upset social justice warriors.
Part of that is disclosed in campaign financial reports (when of course it actually gets reported instead of unreported coordination).
Enforcement would rely on using Robert’s rules in council meetings, and by using public comments during agenda items. If you think a council member has a conflict of interest, demand they recuse themselves. Like those who get north point money shouldn’t be voting on north point issues.
There’s an official city email. Use that. And I would be out in the community.

The Lanham Brothers Christmas Jamboree returns for its 14th year on December 14
at the Bluegrass Music Hall of Fame & Museum
the popular event features live performances
“Our Christmas Jamboree is unique because it brings a little bit of everything — comedy
and a focus on the true meaning of the season,” Randy said
“People tell us they leave feeling like they’ve been to church
This year’s lineup includes Kaleb Lee (a finalist on The Voice in 2018)
Randy said both shows are professionally recorded for broadcast on KET
and provide a unique opportunity for audiences to be part of a televised production
show in recent years because the evening show would always sell out,” Barry Lanham said
The Christmas Jamboree is a fundraiser for Volunteer Owensboro
“All proceeds from both shows go to Volunteer Owensboro,” Barry said
It’s all about giving back to the community that has supported us for so many years.”
Randy said audiences can expect comedic skits and a celebration of the Christmas spirit
and those who want to can participate in some of the action
“Songs like Silent Night and Away in a Manger remind us of the reason for the season
while we also mix in fun tunes like Jingle Bells and I Ain’t Gettin’ Nothin’ for Christmas.”
The brothers credit the community for the show’s ongoing success and strive to make each year a fresh experience
“No two shows are ever the same,” Barry said
The event is sponsored by Commonwealth Rolled Products
Bar and concessions will be available at the venue
Tickets can be purchased online at bluegrasshall.org.
For those who can’t attend, Randy suggested keeping an eye out for the KET broadcast.
“It’s a great way to experience the magic of the Jamboree from home,” he said.
The Lanhams hope this year’s Christmas Jamboree continues to bring joy and holiday spirit to families throughout the region.
“It’s everybody’s favorite show,” Randy said. “And we’re blessed to share it with so many people.”

The Bluegrass Music Hall of Fame and Museum is using the power of music to uplift nursing home residents
thanks to an initiative led by education director Randy Lanham
Through a newly produced 40-minute instructional video
Lanham hopes to encourage musicians – regardless of skill level – to share their talents with those in long-term care facilities
funded through a grant from Owensboro Health
has already gained traction across multiple states
Lanham said he has received requests from musicians who are eager to access the resources he offers
which include song charts and backing tracks
“It’s already making an impact,” Lanham said
“I’ve had emails from three different states asking for music
The video walks through everything from song selection to using a simple sound system
it lets people know you don’t have to be a professional musician to do this.”
The video features interviews with activity directors and musicians who regularly perform in nursing homes
Lanham said the goal is to dispel any apprehension musicians might have about performing in that setting
“There are thousands of musicians out there who just need a little nudge,” he said
“Many of them stop playing because they don’t have anywhere to perform
But nursing homes are full of people who love music and would be thrilled to have someone come in and lead sing-alongs.”
He sees nursing home residents as an often-overlooked community and believes music can provide meaningful connection and joy
A lot of these residents don’t get visitors or have the chance to hear live music.”
Lanham said activity directors are eager to bring in musicians but often struggle to find volunteers
He hopes this video will change that by providing a clear guide on how to get started
“The biggest thing I want people to know is that you don’t have to be a professional,” he said
“It’s not about putting on a show – it’s about leading songs they know and inviting them to sing along
Even if you just use a Bluetooth speaker and play tracks
