previous city council members during a special hearing following several complaints made against him Eva Cervantes says she had no idea who Martinez was when she had an encounter with him at the San Antonio area church they both attend and volunteer for while she was volunteering as a camera operator Martinez was sent to check a problem with her camera It was during that interaction that Cervantes says Martinez stood behind her in a small space and rubbed his crotch on her backside but I cannot move because there’s a wall here and it’s a small square,” she explained Cervantes says she was frozen in panic and shock not wanting to draw attention to her because the pastor was speaking And I was just there feeling him behind me,” she explained Cervantes and her husband took her complaint to church leaders She says she was told to stay quiet about the incident until they completed an internal investigation She provided KSAT with an August 2023 email she received from church leaders explaining steps that would be taken to keep Martinez and her in separate volunteer schedules as well as requiring him to “give all people appropriate personal space,” while at church KSAT has decided not to name the church at this time since no legal action has been taken against the church in connection with Cervantes’ claim “We immediately took prudent steps to establish physical boundaries surrounding our cameras.” “The circumstances of the alleged incident took place in a highly public setting with hundreds of people present and none of those to whom we spoke and who were specifically watching the interaction saw anything inappropriate other than an encroachment upon personal space,” the statement said In February 2024 Cervantes filed a police report with San Antonio Police Her incident report sounds similar to what Catherine Rodriguez described during an interview with KSAT in 2018 Rodriguez was a councilwoman at the time and was one of several people who filed complaints against the city for allegations of sexual and workplace harassment Rodriguez lost her seat and said she was subject to a lot of public shaming because she spoke up “Sometimes I think maybe I should have kept my mouth shut But I couldn’t stay quiet because it was going to happen It was going to happen to somebody else,” she explained In 2018 Martinez was the subject of a special city council hearing after half a dozen City of Leon Valley workers filed complaints against him alleging Rodriguez accused him of sexual harassment the city council voted 2-1 to remove Martinez from office in connection with charter violations but that hearing did not address any of the sexual misconduct made by Rodriguez so her claims were never proven or disproven The council said the then-councilwoman waited too long to file her complaint Cervantes says it wasn’t until after she heard someone at church mention Martinez’s connection to Leon Valley that she did an online search and found Rodriguez’s account of what happened to her That’s when she was encouraged to speak up about her claims publicly Cervantes says she was removed from the volunteer position she’s held without prior complaints for seven years led her to believe it was retaliation for her speaking up against Martinez The church confirmed Martinez was no longer a volunteer but does continue to attend the church “It would not be appropriate for us to make further comments about our church members.” KSAT reached out to Martinez by email and left a message with city staff requesting a call back We reached him by phone and he denied any wrongdoing “You know for a fact that the stuff Catherine accused me of was all lies,” he said “This Eva stuff is all lies it happened a year ago and nothing happened,” he said over the phone But he declined to sit down with KSAT for a formal interview Both women say they felt horrible and alone when they opened up to those around them but wanted to be on the public record Regarding the July 2023 complaint by Cervantes at the church “This case is still open and under investigation The case is currently being investigated as an Assault-Contact as that is the most appropriate offense based on the description given by the victim.” The church’s statement indicates they have not been contacted by local authorities but will cooperate openly if they are with emotions of (whether) my children are safe,” said a parent whose child attends the School of Science and Technology who asked to remain anonymous The mom we spoke to has kids who attend the School of Science and Technology she realized the staff didn’t know about the police presence in the area it wasn’t until I let them know,” said the parent I just wanted to be an advocate for the other parents because of what I had witnessed,” The mom says she was working out at the LA Fitness next to the HEB during the altercation and saw the suspect walk towards her children’s school before being arrested “We were not made aware of the incident that was happening behind our campus,” said Anna Ruiz the communications coordinator for the School of Science and Technology Anna Ruiz says the Leon Valley Police Department never called them to notify them of the situation “We could have issued either a hard lockdown procedure or a soft depending on the circumstances,” Ruiz said Leon Valley Police Chief David Gonzalez declined an interview he said that part of the issue is that Pat M Neff Middle School has a police department through NISD where students can listen to what is happening on police radios The School of Science and Technology does not have the same equipment to prioritize the safety of children and the community safety and I feel like that was not a priority for them.” He added that he is in communication with the charter school representatives but when asked about the plan moving forward he said he didn’t want to disclose that publicly “Our central office team is going to be meeting with the Leon Valley Police Department to review their communication protocols to make sure we are included there and that they have the proper contact information,” Ruiz said An Sign up for it here a 36 year-old street artist who was arrested by Leon Valley police in June has received a settlement from city officials Hinson decided to draw some of his art on a sidewalk just before it was about to rain He uses the same kind of chalk to draw on the sidewalk that children would use playing hopscotch But then Leon Valley police officers arrived "Less than a minute after him saying the first word he had started putting me in cuffs." Hinson said One officer said Hinson had violated a graffiti law "and his superior told him there was no charge and even arresting me was grounds for a lawsuit Hinson received apologies from the city and a settlement of $16,500 He said he hopes the incident will help Leon Valley improve as a community “If they’re continuing to make this problem over and over again it’s a way bigger problem than just me getting arrested for chalk,” Hinson added Civil rights attorney Brandon Grable negotiated the settlement He has represented several clients who have sued the city of Leon Valley in the past for civil rights violations He told TPR that the city’s police department has a problem that needs to be fixed “I do think there is a problem with Leon Valley PD and the way they interact within the community There is a training issue specifically that needs to be addressed,” Grable told TPR Leon Valley officials declined TPR's request for comment on the settlement Kylelovesyou / Public domain via Wikimedia Commons Leon Valley, located just outside San Antonio, is set to become the last city in Texas with red-light cameras — unless state lawmakers pass bills that would void a contract with the city’s photo-enforcement company Leon Valley’s contract for the cameras with American Traffic Solutions is set to expire in 2039 and the only way to exit the agreement before then is for the city to pay millions. Timothy Fanning a digital reporter at the San Antonio Express-News said local officials have called on state lawmakers for help getting out of the contract state lawmakers made an exception for four Texas cities two of which are in Bexar County: Balcones Heights and Leon Valley decided to extend their contract way out into the future,” he said “And now they feel like their hands are tied because there’s a new city government – new elected officials police chiefs – and they don’t want it.” The other cities that were granted exceptions did not extend their contracts for nearly as long Amarillo’s red-light camera contract expired last year and Humble’s contract will expire in 2024 Balcones Heights initially extended its contract until 2034 and the program will expire next year. This leaves Leon Valley with the longest extension on the books “Leon Valley has a sympathetic ear of State Rep He’s felt like the lengthy contract extension was a violation of the spirit of the 2019 law,” Fanning said he filed a bill that would void these red-light camera contracts; that bill died in committee And he’s now refiled that again this year who’s filed an identical bill in the state Senate.” Fanning said residents in the area are also in favor of getting rid of the cameras “You’ll see people posting on social media every now and then talking about this general confusion of whether they should actually pay their bills,” he said “They’ll get a threatening letter in the mail saying that they owe $75 or something like that It won’t go on your driver record.” Fanning said local officials are hopeful that state lawmakers will get the bill ending their contract over the finish line this year “They say one of the biggest hurdles is being that one small city who still has [the cameras] And they’ve made the bed that they’re currently lying in,” he said he said that the bill died last time because of a lack of timing but he feels that lawmakers are on his side as long as they hear his pitch.” If you found the reporting above valuable, please consider making a donation to support it here. A service of the Moody College of Communication at the University of Texas at Austin | Contact us Leon Valley TX – David Gonzalez said he was surprised after pulling the amount of calls the Leon Valley Police Department received related to homelessness over the last five years we try and patrol our business areas and our home and residential areas Gonzalez said his department has seen a spike in calls related to homelessness. Between 2017 and 2023, he said there were more than 400 of these calls. He said that’s part of the reason why the city passed an ordinance essentially banning homelessness He said his department is working to enforce it but is also eager to see how new solutions help the city with an ongoing issue “We have very heartfelt emotions about this,” Gonzalez said It’s something that happens and it’s pretty typical nowadays.” The ordinance that Leon Valley City Council passed this past summer makes certain characteristics of homelessness illegal within city limits at any public park or other recreational spaces The ordinance also bans people from sleeping in a vehicle that is parked on a city street for more than 24 hours or more than two hours on a highway in the city limits Gonzalez said enforcing this ordinance has been more challenging to his department than just answering calls He said over the first six months his department was tasked with enforcing the ordinance The department only ever gave out one citation in 2023 that person will keep moving,” Gonzalez said You’ve been advised in the past you’ve been given your trespass warning But Gonzalez said the calls are still coming in He compiled the police data from 2017 through 2023 for KSAT 12 related to homeless response and calls received Gonzalez said the biggest jump came between 2021 and 2022 He said hotspots for the city and homeless response usually come at vacant lots He said one of the major concerns of the city and addressing homelessness is its limited resources surrounded by San Antonio’s 500 miles,” Gonzalez said That’s why he’s eager to see the city’s street outreach program come to fruition The City of Leon Valley is partnering with Bexar County and Haven for Hope to launch a new pilot program focused on building connections and a community for those without shelter They plan to walk the city streets and get to know people and Close to Home SA helps set these standards the executive director for Close to Home SA said outreach helps find more long-term solutions to homelessness “Cleaning up the encampments may temporarily move people to a different area but it’s not going to move them into housing,” Wilson said “Which is ultimately how we start to solve this issue.” Wilson said after she first learned of Leon Valley’s ordinance She said the city was receptive to pushing outreach efforts too they have not been arresting people,” Wilson said “They saw the value in let’s try to get people moved off of the street instead of simply moving where they’re staying I think we can all agree we don’t want to see people on the street and we don’t want to see that continue to go up because that impacts everyone.” The program is still in its early stages. To read more about it, click here Show Breaking News BarCloseLocal NewsRJ Marquez The Leon Valley City Council on Tuesday night approved an ordinance that essentially bans homelessness or makes it illegal within city limits campers and trailer coaches are not permitted to be used for “home habitation,” according to the ordinance Leon Valley city leaders are discussing a proposed ordinance that would essentially ban homelessness or make it illegal within city limits The proposed ordinance would not allow campsites or tents in public parks during certain hours or sleeping in a parked vehicle on a public street or highway for an extended period of time Camping or sleeping along or in a drainage ditch would also be prohibited and parts of the ordinance would make it illegal for individuals to block or panhandle in public streets or areas “I think it’s happening kind of all over the country — the homeless issue where people are taking up public spaces encampments — and it’s really not safe for the public and for the homeless themselves,” said Will Bradshaw Bradshaw said taking a hands-off approach ignores the problem but he also wants to address the issue humanely “We’re offering help to the homeless shelters “I think the issue is a lot of them don’t want help The proposed ordinance has been met with some pushback by homeless agencies that want to find a solution to the problem rather than add more issues “We agree with the policies we’ve had in place over the last few years that making homelessness illegal doesn’t ultimately solve the issue It just continues to displace people and move them around,” said Katie Vela executive director for the South Alamo Regional Alliance for the Homeless (SARAH) “We understand that sometimes encampments have to be abated when there are severe issues or drugs But we want the community to work with us on what’s the longer-term solution Learn more about homelessness and the root causes behind it.” Vela added that getting more street outreach outside San Antonio is key to finding a solution “San Antonio has a street outreach team for all 10 council districts but the smaller municipalities are not part of their service area,” said Vela “And so we’re going to meet with the city and the county to talk about how can we get some street outreach capacity in these smaller municipalities.” Vela said the approach they want to take is to engage with people and connect them to different services “We’ve seen people take that next step once there’s a relationship and trust,” said Vela Tuesday’s city council meeting was scheduled for 6:30 p.m Bradshaw said the proposed ordinance would be discussed but there could be changes to the proposed law He added that potential enforcement of the proposed ordinance by Leon Valley police officers had not been determined “It’s not something that we can continue to ignore and just hope that it goes away,” said Bradshaw It’s something that we need to try and resolve humanely and try and help these people.” Find local news on KSAT.com here Copyright 2023 by KSAT - Find past answers on our traffic page Copyright 2021 by KSAT - All rights reserved Benny Martinez's seat was vacated Wednesday night around 11:20 p.m The Leon Valley City Council voted him out 2-1 LEON VALLEY - Leon Valley politics have been dominated for months by the fate of a councilman whose alleged misconduct has divided the city After more than 30 hours of special council meetings the case has taken a toll on the small Bexar County community's resources "I can't wait til this over and we can focus on what we really should be focusing on," Leon Valley chief of police Joe Salvaggio told us today after he spent over 90 minutes testifying Tuesday night in another multi-hour session about Councilman Benny Martinez Tonight is the seventh evening of meetings for the council to deal specifically with Martinez He has been accused of sexual harassment along with undermining Leon Valley's legal department Several sessions have been in excess of five hours Over 350 man hours by Leon Valley police to provide security at city hall for the meetings When the first special meeting unfolded early last month nearly two dozen law enforcement personnel were on hand to provide security and they were asking citizens by the thousands to come march on City Hall," Salvaggio said That show of manpower represents about half of what Salvaggio has available making sure everyone stays safe as the case both for and against Martinez unfolds "Total so far is 30 hours," says Saundra Passailaigue city secretary of Leon Valley who keeps track of each session "That's 30 open meeting hours." During Tuesday night's session, Salvaggio revealed a new wrinkle - an outside investigation of 13 Martinez backers, who have been dubbed "The Team." Included are Mayor Chris Riley and councilman Will Bradshaw neither of whom made themselves available to us today Group members allegedly exchanged emails about the case on personal devices and accounts who showed several examples to the Council They also failed to turn them over promptly when requested Leon Valley residents and businessmen are frustrated with the slow pace of the proceedings "Do I think it could have been resolved in a faster way manager and vice president of Henry's Puffy Tacos on Bandera Road "They do need to find out what's going on There's definitely a lot of other issues that need to be looked into."
