When Robert Cavanaugh died Dec. 24 after another man hit him with a metal pipe
it set off a turn of events in the legal system that left two families devastated and frustrated
That's because authorities say the blow didn't kill him — a heart attack did
the Oakland County Prosecutor's Office said last month that the county medical examiner found his actual cause of death was a heart attack that came shortly after the injury
which carries a sentence of up to four years in prison
Prosecutors later told The Detroit News that the medical examiner's office was not clear whether the assault or the heart attack came first
but Oakland County Circuit Judge Cheryl Matthews postponed the hearing because she said she had too many unanswered questions about what actually led up to Cavanaugh's death to move forward with sentencing
"I'm struggling with this case because when I read the (presentence investigation)
it was very difficult to determine exactly what happened," Matthews said March 25
I had a really hard time determining what really happened here."
Cavanaugh was found unresponsive just after 7:30 p.m. Dec. 24 outside near the 26000 block of Dequindre Road in Madison Heights
Matthews said her belief is that Beasley had at some point beaten his own dog
approached him at his home about that and a fight broke out
It's unclear where the dog detail came from
but it lines up with what Cavanaugh's sister
wrote in a GoFundMe page set up shortly after Cavanaugh's death
even though prosecutors said they did not find any evidence of a dog being involved
"My youngest brother Bobby was murdered on Christmas Eve as he rode his bicycle through his neighborhood and tried to save a dog that was being beaten by a man
Bobby was beaten to death with a pipe ..." the GoFundMe said
said her brother would never hurt his dog and had been cooking dinner for his family when Cavanaugh approached him
My brother would give you the shirt off his back
My brother didn’t go looking for that guy; he came up on my brother’s property."
said he is frustrated that prosecutors charged Beasley with felonious assault instead of a crime like involuntary manslaughter
which would have carried a sentence of up to 15 years in prison
"How can you come up with this conclusion that he died of a heart attack?" Charlie Cavanaugh said
"Then they put salt on the wound with the way they navigated things from what I thought maybe should be a manslaughter type of offense
What happened in the moments just before Cavanaugh's death is unclear
Mona Beasley told The News that Beasley had been cooking Christmas Eve dinner for his family when Cavanaugh came onto his property
Cavanaugh was intoxicated; no one denies this
Beasley grabbed a metal pipe and struck Cavanaugh in the head outside of Beasley's home
Beasley pleaded no contest to felonious assault Feb
meaning he is not admitting any guilt for civil purposes but is no longer contesting the case
A no-contest plea is treated as a guilty plea for the purposes of sentencing
said Cavanaugh's head injury was superficial and would have only required two to three stitches had he survived
"It's really hard to determine what happened because everyone interviewed lied," said Matthews
"It's very possible that someone could be hit in the head
already be riled up and have a heart attack."
said a witness told him his brother Robert's face had been covered in blood
Hospital staff would not let him see his brother after he died because of the condition of his face
Cavanaugh was pronounced dead at the hospital
"I don't think heart attacks cause that," Charlie Cavanaugh said
"They have already made their mind up that he died of a heart attack because he had a bad liver
the spokesperson for the Oakland County Prosecutor's Office
said that because the medical examiner found Cavanaugh died of a heart attack
prosecutors would not be able to prove any charge higher than felonious assault in court
Charlie Cavanaugh admitted his brother was no angel
someone who regularly mowed the lawn for his church and neighbors
He said he is frustrated that the prosecutor seemed to be more on Beasley's side than his family's
"You had a choice at that time," Charlie Cavanaugh said of Beasley
"You could have picked up a phone and dialed three digits or picked up a pipe
Mona Beasley said her brother loves his family and God
Rodney Beasley regularly cooks for his friends and family
I understand how they feel," Mona Beasley said
"I can't wait for all of this to be done."
Charlie Cavanaugh said he ultimately doesn't care what sentence Beasley gets
He said he'll leave that up to God and Matthews
He wants people to know that his brother deserved better than what the judicial system is giving him
"Our Christmases with the Cavanaugh family and friends will never be the same again," Charlie Cavanaugh said
"What (Beasley) took from me and my family
we don't get back no matter what happens to him."
