Manteca Police Department officers shot and killed a man who rammed into three police cars in the parking lot of an In-N-Out Burger on Wednesday officers responded to the In-N-Out Burger at 1490 E after dispatchers received reports of a disturbance that involved a man driving a white van in the restaurant's drive-thru line identified as 69-year-old Charles McGonegal After about 20 minutes of trying to de-escalate the situation police said McGonegal rammed into at least two more police cars Police said officers shot McGonegal in response It's unclear how many officers were involved in the shooting and whether officers gave McGonegal commands before discharging their firearms No officers were injured during the incident Authorities said he died from his injuries on Thursday Police said McGonegal was the only person in the van during the incident and he had a history of criminal activity in multiple states dating back to 1972 but his living situation was not fully known a spokesperson for the Manteca Police Department was asked to respond to concerns from eyewitnesses at the scene who watched officers shoot the man at least two dozen times "I think that's the easiest thing to answer. If somebody was attacking you, how many bullets would you fire?" Beerman told KCRA-TV Sacramento. "Right or would you fire until they stopped doing what they're doing?" Beerman also noted that there were lines of people around the scene watching and recording video when the van was seen ramming the police cars Had they not done that and he was able to get through all those people that are asking that question that were lined up over here and ran a couple of them over they would have been asking why didn't they use deadly force to stop him," Beerman told KCRA police said the San Joaquin County Officer Involved Critical Incident Protocol was enacted The protocol requires the San Joaquin County District Attorney's Office to conduct a thorough impartial investigation when a law enforcement officer is involved in an incident such as a shooting that results in serious injury or death of a civilian Sherwood Mall shooting: Macy's employee shot while trying to stop shoplifter in Stockton The California Department of Justice Crime Lab and the Manteca Police Department are also investigating the officer-involved shooting Five officers were placed on paid administrative leave in accordance with the police department's policy (This story has been updated to include additional information.) may have been suicidal Feliciano was treated at the scene and transported to an area hospital the District Attorney’s Office determined the use of force was justified and no criminal charges were warranted A Manteca police officer accused of sexual acts against an intoxicated woman was granted bail Friday afternoon which was reduced from the $400,000 amount his attorney Mary Ann Bird had requested during a hearing at San Joaquin County Superior Court in downtown Stockton Castro is charged with oral copulation of an intoxicated person penetration by a foreign object on a victim who was drugged Bail for Castro in his arrest warrant was previously set at $2 million Some of the requirements of Castro’s bail release include having GPS and alcohol screening device placed on him not contacting the victim and obeying laws Castro is also barred from leaving the state and he must have an unlimited search waiver A motion was filed by Bird Friday to request the court to release Castro on his own recognizance or have his bail reduced but Deputy District Attorney Victor Bachand didn’t agree Bachand said he didn’t believe the defendant should have a bail reduction because he didn’t think he would follow court orders the victim in the case has known Castro for approximately 13 years Before Judge John Soldati could make a decision regarding bail the prosecution and defense stated what occurred the night of the alleged rape Bachand said the victim had gone over to Castro’s house on April 20 2024 for a night of drinking in which she had consumed “massive amounts of alcohol.”  The victim told the officer who took the report that she had been out drinking with her cousin her cousin’s husband who was identified as Castro and several others at the Main Street Inn in Ripon Surveillance video showed that the victim was “clearly intoxicated (and) inebriated,” and that she passed out at the bar Bachand said Castro carried the woman out of the bar and that she was puking and unable to care for herself Castro’s attorney explained that the victim had consumed alcohol on her own and wasn’t fed alcohol by the defendant “That doesn’t make a rape of an unconscious person OK.”  the victim told the officer that her cousin had gone to sleep The victim said she eventually fell asleep She woke up to Castro’s penis in her mouth Bachand said that when Castro gave his statement to law enforcement he told investigators that he did not touch the victim in a sexual manner He also said there should be no DNA evidence linking him to the victim testing by the Department of Justice showed Castro’s seminal fluid inside the victim’s underpants referred to as Detective Nutt in court documents said when he conducted a follow-up investigation of the victim’s allegations he was informed by medical staff that she did not have injuries in her genital area The document stated that a person had informed a nurse at the medical center that the suspect was a Manteca police officer and she was worried he would find out about her report After Manteca police were informed of the allegations the Manteca Police Department said Castro has been employed as an officer for the department since June 2018 he worked for the San Joaquin County Sheriff's Office as a correctional officer and deputy Castro surrendered himself to the San Joaquin County Jail on April 7 after the charges were filed against him “What we have here is a man and a woman engaged in an illicit affair,” Bird said “He was trying to hide it from his wife and just because he wanted to hide it from his wife doesn’t mean that these events took place.” Castro is set to return to court at 8:30 a.m on May 21 at the San Joaquin County Superior Court in Stockton A Manteca police officer who is accused of sex crimes against an intoxicated person appeared in San Joaquin County Superior Court for his first arraignment hearing on Tuesday is charged with oral copulation of an intoxicated person In the criminal complaint filed against Castro by the San Joaquin County District Attorney's Office on April 3 prosecutors allege the crimes occurred on or before April 21 who remains in custody at the Stanislaus County Jail appeared in Department 8C in front of Judge John Soldati He is being represented by Stockton-based attorney Mary Ann Bird Bird told Soldati she had just received a packet of discovery and requested that the arraignment be continued The judge scheduled further arraignment for 1:30 p.m Bail for Castro in his arrest warrant was set at $2 million Soldati said he would leave bail set at that amount and review Castro's bail at the next hearing "They are recommending no release due to the nature of the charges," Soldati told the courtroom the judge issued a criminal protective order forbidding Castro from contacting the victim in the case either directly or through a third party Manteca police said the alleged offenses occurred in Ripon while Castro was off-duty Department officials said they were notified by the Ripon Police Department of an investigation into the officer on May 1 Castro was immediately placed on paid administrative leave," Manteca police officials stated Castro surrendered himself to the San Joaquin County Jail after the charges were filed against him on Monday Manteca police said the department is now proceeding with an internal states a man was hit and injured and a woman was killed by trains in Manteca a 53-year-old unhoused man’s dog had gone on the train tracks between Yosemite Avenue and Center Street when the leash got stuck on a railroad tie Manteca police said a train was approaching when the man attempted to free his dog The train ultimately struck the man and his dog but he had sustained a severe injury to his left arm The train had stopped on the tracks for a couple of hours following the collision Police said the man was taken to a hospital for immediate medical care and the dog was taken to the Manteca Animal Shelter until arrangements could be made Police said the man was a resident of Manteca Melissa Dunn was also struck by a train in Manteca The 48-year-old Manteca woman died at the scene officers responded to the 1200 block of Moffat Boulevard after receiving reports of a person lying on the tracks as a train was approaching which run north and south on the west side of Moffat Boulevard The crash happened near where the tracks go under Highway 120 Authorities are actively investigating Dunn’s death and there is little information to release there were 1,464 pedestrian rail trespass casualties according to the Federal Railroad Administration Data showed that there were 818 trespass-related fatalities and 646 trespass injuries across the U.S California held 328 of the casualties with 197 of them being fatal and 131 resulting in injuries “It is important for the public to remember that trains coming through town cannot stop in a reasonable distance to avoid hitting persons or animals on the track,” Manteca Police Department officials said in a statement this train took almost a mile to come to a complete stop it is important to stay off the tracks unless stepson during a confrontation at his home on Thursday in Councilman David Breitenbucher's home in the 1000 block of Yolo Street Breitenbucher called 911 and said that his stepson had attacked him and threatened to kill him White does not live in Breitenbucher's home The councilman also reported using his firearm in self-defense Breitenbucher suffered a head injury and White was shot in the abdomen They were both taken to a local hospital for treatment Manteca Police Chief Stephen Schluer said Breitenbucher and White have been stepfather and stepson for about six months Schluer said White "had some difficulties with different family members" in the past but the department hadn't received a call for service regarding the two until the shooting Schluer also said a search warrant was signed by
