The New Hanover County Board of Education is preparing for an expected vote later this week to censure Dr Tim Merrick and “express its strong disapproval of his actions,” according to a new resolution The board will have a special meeting on April 11 at 2 p.m with the vote tied to allegations that Merrick violated privacy policies -- and potentially state statute While censuring is considered a formal reprimand it wouldn’t remove Merrick from the school board He said he’s not expecting formal charges to be pursued Board Chair Melissa Mason emailed board members about the meeting saying the time frame “ensures we are abiding by policy.” Mason said the vote was tied to Merrick’s violation of Policy 2125/7315 and possibly Article 21A of Chapter 115C of NC General Statutes which is related to personnel files and confidentiality She didn’t return WECT’s request for comment on Tuesday saying Mason is out of line and in violation of board procedures He said the meeting is a result of the board He called the push a “waste of taxpayer money.” “It’s just really sad the board feels they would have to go through his partisan attack,” Merrick said The allegations stem from a conversation Merrick says he had with a New Hanover County Schools teacher months ago was concerned about violating district policy by having a pride flag on a bookshelf in their classroom but the board believes he should have remained neutral throughout the discussion Once other board members learned about the conversation Merrick said he lost his committee assignments on the board for two months The resolution said after investigating the allegations Mason concluded they were “credible” and showed Merrick had violated board policies by “intervening in an employment matter that involved an employee disciplinary action Merrick’s actions directly undermined his ability to impartially and fairly carry out certain of his judicial function.” It’s unclear if the teacher Merrick had a conversation with has been tied to any discipline action Merrick expressed concern that the censure vote will make teachers unwilling to speak out against policies that they believe hurt their ability to teach My biggest concern is it will also have a chilling effect on teachers,” he said While Mason’s email provided Merrick with less than a week to mount a defense he said he’s pushing for the board to follow policy and give him 30 days While he’s already discussions with the board’s attorney and his own attorney he said he expects the vote to go through and censor him “They’re going to do what they’re going to do – whether they’re following the law or not.” Resolution Document by WECT Staff on Scribd Resolution Document by WECT Staff on Scribd Your Ads Privacy ChoicesIMDb Broadway Off-Broadway Off-Off Broadway Cabaret Dance Opera Classical Music Nashville Minneapolis / St. Paul Connecticut Atlanta Chicago Los Angeles WEST END UK Regional Canada Australia / New Zealand Europe Asia Latin America Africa / Middle East TV/Movies Music son of original playwright Bernard Pomerance Based on the life of Joseph Merrick The Elephant Man centers on a young man who lived in London during the latter part of the nineteenth century Merrick became the star attraction in traveling sideshows Pearson's casting in the new film makes him the first disabled character to play Merrick on screen The play follows Merrick's story as he is admitted to London’s prestigious Whitechapel Hospital Under the care of celebrated young physician Frederick Treves Merrick is introduced to London society and slowly evolves from an object of pity to an urbane and witty favorite of the aristocracy and literati only to be denied his ultimate dream – to be a man like any other The two projects are unrelated takes on the same true story As an actor, Pearson has appeared in such films as Under the Skin, Chained for Life, and, most recently, 2024's A Different Man opposite Sebastian Stan.  With two Broadway musicals under his belt, Josh Groban isn't done yet. Merrick.    and the staffs of both the Retirement Ranch and Roosevelt General Hospital who provided such good care for Marcel on many occasions.  in Portales to Amon Duke “Bud” Garner and Ella (Gumm) Garner Her name was spelled Marcelle at birth but she always went by Marcel.  she and her brothers helped with all the chores … even if they had other plans Marcel said her first official job off the farm was at the age of five when she was given a feather duster to help clean the shelves and merchandise at the Causey Grocery Store which was owned and operated by her aunt then worked her way up to stocking the shelves and eventually running the store by herself.  Jennie Dee was also the postmaster so Marcel’s sweet smile was regularly seen behind the counter filling in at the Causey Post Office.  In 1957 Marcel graduated from Causey High School They had been married for more than 46 years when Hank died in 2004.  Hank and Marcel ranched in the Causey area Marcel worked side by side with Hank on everything They were active and involved with all of their children’s activities first at the Causey School and later at Dora School following the consolidation there wasn’t much that happened at Causey that Marcel wasn’t involved in whether it was working with the volunteer fire department to overseeing commodities distributions where Marcel dispensed her unfailing good cheer along with the food for her friends and neighbors they bought Merrick Hardware in Causey and ran it for 20 years never letting the weather stop her from pumping gas and helping customers with anything they needed They closed the store in 2004 after Hank’s death Marcel’s faith was an integral part of who she was She was a member of Third and Kilgore Church of Christ at the time of her death she truly lived her faith leaning on her favorite verse: Philippians 4:13 “I can do all things through Christ who strengthens me.” She touched countless lives with her love and her prayers and was always one of the first to send a card to anyone who was ill or who just needed a word of encouragement.  Marcel’s own life had its share of tragedy losing their daughter Ramona who was only 18 Hank’s sudden and unexpected passing and facing an illness herself in 2007 that doctors did not expect her to survive One of them later remarked that Marcel was what all who loved her already knew: “a tough High Plains woman.”  Marcel moved from Causey to an apartment at Golden Acres in Portales where she lived for the next 12 years until declining health prompted the move to Retirement Ranch in November.  Marcel was preceded in death by her parents Mary Beth (Heath) Williams and 12 great-grandchildren to whom she was “Grandma Cel.”  The family is especially grateful to the staff of Retirement Ranch for the friendship and wonderful care they gave Marcel for the last four months as well as Marcel’s nephew and niece Randy and Edie Merrick of Shallowater for their devoted love and help in being with the family.  Those wishing to honor Marcel with a memorial donation are encouraged to consider two options dear to her heart: The Causey Cemetery Fund NM 88130 and Causey Emergency Medical Services The exact nature of his condition is not known, with suggestions he may have had neurofibromatosis or Proteus syndrome Pomerance’s play was first performed in the UK in 1977 with David Schofield in the lead role; subsequent productions featured actors including Philip Anglim starring John Hurt and directed by David Lynch The America of 2025 will be unlike any other in American history It will be marked by further economic growth for the billionaire class unprecedented public and political corruption within Trump’s White House and further deterioration of the middle class and a continued push rightward Amidst the search for a rational answer why this happened there are numerous culprits; Democrats searching for a moderate road the American populace’s misogynist and racist thinking and the billionaire class supporting Donald Trump there is another culprit; Merrick Garland and his failure to lead the U.S Department of Justice (DOJ) through one of the most important and tense times in the nation’s history Garland’s failures as America’s top cop cannot be more profound and arguably have helped usher in the second Trump administration that is upon the American people “more than a year [passed] before prosecutors and FBI agents jointly embarked on a formal probe of actions directed from the White House to try to steal the election … [with DOJ leadership directed by Garland] charted a cautious course aimed at restoring public trust in the department while some prosecutors below them chafed feeling top officials were shying away from looking at evidence of potential crimes by Trump and those close to him” Dean Obeidallah, a former trial attorney and journalist, assessed in late 2024 that due to Garland’s inattention “it took [Special Counsel Jack] Smith until August 2023 to gather evidence and build the case against Trump for seeking to overturn the 2020 election” with the first charges only coming after “the first GOP primary debate” baseless claims of corruption or malfeasance by Republicans In towing the middle line so strongly and often being incredibly sensitive about upsetting any Conservative voice regardless of the situation it is no wonder that many individuals question if Garland was himself a conservative in disguise the sooner we can hope to begin counteracting those attractions” Brushing aside that Wittes is an admitted longtime friend of Garland’s Wittes’ argument using a hypothetical timetable brushes aside the fact that Garland was effectively avoiding the Trump issue for a substantial portion of his time in office While Garland is not the cause of the second Trump administration his actions and stances indicate he did next to nothing in countering the crimes of a former president yet the level of inactivity and a lack of competent forceful response to the most prescient dangers in American society displayed under his tenure will remain some of the most serious missteps in American jurisprudence One can easily imagine how different the United States would be had Biden selected a more politically aware and astute attorney to lead the department understanding firsthand the Trump administration’s corruptness and lack of desire to follow the rule of law Not only were they quite likely to be confirmed by the Senate but any similar moderate or timid action with them at the helm is near unthinkable he effectively helped to legitimize Trump’s actions as commonplace seemed intent on appearing as apolitical as possible (which only served to help the extreme tendencies of the GOP and his own personal reputation) and was so focused on not making the DOJ not appear supportive of Biden that he abandoned the pursuit of justice in all corners MD does not stand behind any specific agenda, narrative, or school of thought. Another: “Judge Garland has no weaknesses.” Opinion Columnist Jackie Calmes brings a critical eye to the national political scene She has decades of experience covering the White House and Congress Therein lies the tragedy of Merrick Garland A man who could have been a truly supreme justice — but for then-Senate Majority Leader Mitch McConnell’s unprecedented Republican blockade — instead became a seemingly ineffectual attorney general at least regarding the defining challenge of his tenure: holding Donald Trump accountable for trying to steal the 2020 presidential election The traits that the bar experts saw as Garland’s strengths — deliberative caution indifference to politics — turned out to be weaknesses for the head of the Justice Department in these times Garland feared the optics of the Justice Department turning its legal powers against the man President Biden had just beaten at the polls accuse the attorney general of the very thing that Trump himself was guilty of: weaponizing the Justice Department the case against Trump needed to be pursued Garland succeeded in reviving the department’s post-Watergate norms which restrict contacts between law enforcement officials and the White House as a young Justice lawyer in the Carter administration helped develop in response to Nixon-era abuses But so much for Garland’s achievement: Trump saved by his election from having to answer for Jan 6 or for a separate federal indictment for filching classified documents more emboldened than before and backed by appointees willing to do his vengeful bidding at the Justice Department and the FBI The 72-year-old attorney general soon leaves office having angered all sides -- Republicans for going after Trump at all, Democrats for not going after him fast and hard enough. California Sen. Adam B. Schiff, formerly a member of the House Jan. 6 committee, was among the first Democrats to publicly blame the Justice Department for letting Trump avoid trial before the 2024 election complaining on CNN that the department had focused too long on “the foot soldiers” who attacked the Capitol “and refrained from looking at … the inciters.” A recent CNN retrospective on the Trump prosecution called 2021 “the lost year.” At a time when the former president was still on the defensive about Jan. 6, the Justice Department followed a bottom-up strategy targeting more than 1,500 rioters in its largest criminal investigation ever Prosecutors insisted they were chasing leads involving Trump and close allies while sorting out the legal complexities of trying a former occupant of the Oval Office essentially a daytime drama about Trump’s multipronged efforts to keep power Months of legal challenges from the Trump team followed delaying everything and putting forward what seemed like a crazy claim that Trump should have presidential immunity Even if Garland had moved aggressively, there’s a good argument that all the delays available to Trump would’ve made a trial and verdict before the election unlikely And this fact remains: The ultimate jury — voters — had more than enough incriminating facts available to decide Trump was unfit to be president again Garland’s performance makes me doubly sad that he ended up at Justice instead of becoming a justice @jackiekcalmes Jackie Calmes is an opinion columnist for the Los Angeles Times in Washington Before joining The Times in 2017 as Sometimes you can make the wrong decision and everything works out. That doesn’t mean you made the right call.2 And sometimes you’re in the Kobayashi Maru where you fail even after making the right decision Looking at the world as we understood it in 2021 Had he decided to go hard at Trump from the bell There was no one to share the burden of responsibility with him but I’m glad I wasn’t sitting in Garland’s chair Leave a comment One of my favorite TV shows from the ’00s was House. The series was a retelling of Sherlock Holmes, only with Holmes as a doctor who solved medical mysteries. Hugh Laurie played the titular Dr. House and, like Sherlock Holmes, he was a bitchy, cantankerous wadbag. In one episode, Dr. House is teaching a class of third-year medical students by presenting them with a hypothetical case about a farmer who says he’s been bitten by a snake and whose leg is going necrotic. House gives the class two treatment options and asks for a show of hands. The exchange that follows has stayed with me for twenty years: Student 1: I assume that one choice kills him and one saves him. House: That’s usually the way it works at the leg-turning-black stage. Student 2: So half of us killed him and half of us saved his life. House: I’m sure this goes against everything you’ve been taught, but right and wrong do exist. Just because you don’t know what the right answer is—maybe there’s even no way you could know what the right answer is—doesn’t make your answer right, or even okay. It’s much simpler than that. It’s just plain wrong. That has to be our final verdict on Merrick Garland. Maybe we can’t blame him. Maybe there’s no way he could have known what the right answer would be. But his answer was wrong. It resulted in no convictions, a new Supreme Court writ of presidential immunity, and Trump’s return to power. Garland was just plain wrong. And the rest of us will be paying for his mistake for a long time.
