Coots has subsequently pulled his request to rezone the property from single family residential to highway commercial development from the board's May 8 meeting agenda
"The applicant has tabled his request until next month," said County Planning and Zoning Director Shawn Ward
Ward said the 4.9 acre easement in question had been identified as a road on county zoning maps and
a former owner had wanted the land vacated
at that time the District 5 county commissioner representing the Gulf Breeze area
called upon fellow board members to support a resolution to establish a permanent conservation easement on the property
He received unanimous support to do so with one commissioner absent from the meeting
The resolution codifying the easement states that the county "shall prohibit the construction of any structure intended for residential or commercial use."
"Any use of the subject property shall be limited to those that protect the environmental integrity of the subject property," it said
Ward said paperwork generated through the creation of the easement seemed to indicate Lynchard had determined the vacated parcel to be a wetlands area that the county would be unable to do anything with and had therefore decided to create the easement

purchased the conservation easement property in April of 2024 for $100 despite it being clearly labeled on the agency's website as such
He also bought two other parcels the same month
all in the 6100 block of Gulf Breeze Parkway

who was to represent Coots at the Zoning Board meeting
said May 2 the existence of the perpetual conservation easement "had just come to light in the last week."
"That's the reason for the delay," she said
"The county attorney contacted us and we agreed it would be better if we wait for a month."
Cato declined to provide contact information for Coots
Coots purchased the land protected by the conservation easement from David May
In correspondence between Ward and Pavelick
Ward responded to a question about whether a seller would be required to inform a buyer of the perpetual conservation easement
"But a title search would identify the conservation easement (and) the Property Appraiser’s Office identifies it as a conservation easement as well
A potential buyer would hopefully do their due diligence to identify any wetlands or potential stormwater issues."
Last year the Zoning Board approved without objection a request from Coots to rezone land on the 6200 block of Gulf Breeze Parkway for highway commercial development
His application for the pending rezoning notes that a previous rezoning "straightened out the southern boundary of an area now zoned for highway commercial development."
The developer later decided that extending the area zoned commercial down to an existing wetland barrier would be "more amenable for cohesive development" and remove a small area of land zoned residential
it would impact the northern 653 feet of three individual parcels and add approximately 3 acres to the existing highway commercial development zoning
A wetlands assessment report conducted by Wetland Sciences Incorporated on behalf of the developer states that more than half of the parcel reviewed is comprised of wetlands but makes no mention of the existence of the perpetual conservation easement
"the actual area proposed for rezoning to highway commercial development is predominantly upland."
"The adjacent wetlands will be protected as required by the county
Florida Department of Environmental Protection and U.S
Army Corps of Engineers," the application states
the senior scientist who signed off on the wetlands report
did not return a phone call seeking comment
just because it says perpetuity doesn't mean it's permanent," he said
Pavelik said she wants to see the entire 4.9 acres protected under the easement remain free from development
"I'm not sure how much they wanted to rezone
but once you start cutting into it who knows what will happen?" she said
"If it's a conservation easement that means there's wildlife on it
The Lundin farm includes about 120 acres near Wasatch Mountain State Park
and open space supporters have been working for five years to place it under a conservation easement
Utah Open Lands says progress has been slow due to interfamily lawsuits and complicated negotiations with local governments
the end of the Lundin family’s legal battles and a finalized conservation agreement could be in sight
Robert Fuller sued the Lundin Land Company for breach of contract in July 2024
alleging the Lundin siblings didn’t honor the right of first refusal agreement they made with him and Randy Lundin
A right of first refusal means Fuller and Randy Lundin are entitled to match whatever sale price the other siblings put on the land
Fourth District Court Judge Jennifer Mabey dismissed the lawsuit February 3
she wrote that a conservation easement includes the right to use the land – it’s not land ownership
Mabey said the right of first refusal doesn’t apply
Utah Open Lands Executive Director Wendy Fisher explained the ruling
“There are several moments where it talks about the fact that the conservation easement would not trigger the right of first refusal because the property remains in the hands of the family,” she said
She said the context of the lawsuit being dismissed meant that Utah Open Lands would need to work with everyone involved to revise the conservation agreement
some members of the Lundin family sued their relatives because they wanted to sell the land to a developer
while others wanted to keep it as farmland
Fisher asked the Midway City Council to keep money set aside for the easement until the end of June
she had hoped to have the agreement finalized by April 30
“So that is why Utah Open Lands is here on behalf of this project: to request an extension from the April deadline to the end of June
and hopefully bring back to the council a fully ready to go purchase and sale agreement
and we can move forward and hopefully get this deal closed.”
There was also some question about whether federal dollars for the project are in jeopardy under the Trump administration’s funding cuts across a broad range of government programs
Utah Open Lands learned a lot of grant funding had been frozen
The Midway City Council approved extending the deadline to July 1. It’s pledged $1 million for the easement
Wasatch County also promised to support preserving the farm. It approved $2 million in open space funds back in August 2022
Fisher said those funds remain committed to the land

MCLENNAN COUNTY, Texas (KXXV) — Midway ISD has appointed David Denham as the new head tennis coach for the Panthers, bringing more than three decades of coaching experience and a legacy of competitive success to the district.
Denham, a USPTA Elite Professional since 1994, is widely respected for developing championship-level teams and mentoring student-athletes to achieve on and off the court.
Most recently, he led Lovejoy High School to a standout 17-1 season, with both the boys and girls teams winning district titles and advancing through the Bi-District and Area rounds. Prior to that, Denham spent 18 years at Lubbock Coronado High School, where his teams claimed eight consecutive district championships and produced multiple UIL state champions in singles and doubles.
A graduate of Texas Tech University, Denham has also served in leadership roles, including on the Texas High School Coaches Association Advisory Tennis Board for Region 1.
District officials say they are excited to welcome Denham to the Panther family and look forward to the continued growth of the tennis program under his guidance.

Some of the veterans who attended Sunday served on the Midway during the rescue effort known as Operation Frequent Wind
“It's a very emotional experience for me to see all of the wonderful people that are here that have become American citizens — hard working
loyal American citizens,” said retired Rear Adm
The 95-year-old commanded the Midway during the fall of Sàigòn in 1975 and risked his career to save South Vietnamese refugees
“When we were in the middle of chaos there were 24 ships out there rescuing
there were a lot of boats that made it to the Philippines on their own,” Chambers said
who escaped with his family in a small plane
And I did it,” he said during a speech at the weekend ceremony
To make way for Buang-Ly's plane and other aircraft loaded with evacuees, Chambers ordered his crew to push military helicopters overboard. The Smithsonian says $10 million dollars worth of aircraft went into the ocean

who knew his decision could result in court martial
When he took off with his family beside him
There were no radio communications on the plane
which he had spotted on an airfield on Con Son Island
Navy vessels were landing crafts carrying folks fleeing from South Vietnam
"I spotted a large number of helicopters,'' he said
he saw the Midway and the many helicopters cramming the flight deck
He scribbled a note detailing his situation
It went off the flight deck into the water
shoved into a holster that dropped on the flight deck
Both the holster and a replica of the letter were on display at the ceremony

McFarlane was still a bit emotional as he watched the crowd greet Buang-Ly and his family

This is the latest installment in our Main Street NC series from the WUNC Politics Podcast
We're visiting communities across the state to hear from local leaders about the positives going on in their towns
wasn’t even a town for most of its history
The Davidson County community became a municipality in 2006 in an effort to avoid getting annexed into the nearby city
Local leaders didn't want to pay higher city property taxes
and they wanted to prevent high-density development
Forming a town with its own planning and zoning rules was an effort to keep its rural character despite the Triad region’s growth
You won’t see many new subdivisions under construction right now in Midway
but town leaders like Mayor John Byrum are planning to build a big expansion of the town's centerpiece
a 16-acre park along rolling hills that opened a few years ago
With multiple playgrounds and a large pavilion for picnics and events
it’s the sort of park you’d expect to see in a larger city
"We have about 20 acres that the town still owns that's undeveloped
that's right next to our current park," Byrum said
"We want to continue to build out an additional 20 acres of recreation
We've had vision sessions where ideas have been thrown out
We like the idea of having non-traditional recreation."
The town has prioritized the park even with its limited revenue from having one of the lowest property tax rates in the state
low-density towns in North Carolina where homes have to be built on larger lots and commercial development faces some limitations
Many of these towns were formed several decades ago before the state legislature limited towns and cities from expanding their boundaries without the consent of property owners
The slow-growth approach hasn’t been controversial in Midway
North of Greensboro, the town of Summerfield recently tried to block a mixed-use development with apartments. Town leaders weren’t able to reach a compromise with the developer, and that led to legislation from Senate leader Phil Berger to remove the entire property from town limits
The legislative intervention prompted outcry from local leaders
"This is the largest deannexation in North Carolina history," Harrison said
I can't imagine why any of us think this is a good idea to do this to the town of Summerfield."
said at the time that the legislature had to step in because the two sides couldn't work out an agreement
there have been no big battles between developers and the town council
and there’s been no push for denser development
That means new businesses here tend to locate in the town’s existing small retail centers
Jamie Hoke and her husband Alex own the coffee shop
a place that hosts church groups and chess clubs
They write a Bible verse on each cup they serve
Jamie said residents of Midway prefer the smaller businesses
they are very big on supporting local," she said
They don't want big-name things around here
There is a Starbucks under construction about three miles south
but that’s outside the town of Midway in the area known as Welcome
That part of Davidson County is unincorporated and has looser zoning rules
Other Midway businesses predate its establishment as a town
Midway General Store has stood on the main road since 1936
it's now the sort of small-town hardware store where you can pick up anything from a can of Cheerwine to plumbing supplies and fertilizer
Owner Hal McAlpine said he's seen tobacco fields replaced by houses
and he expects the store will close when he eventually retires
or the ship will go down with me," McAlpine said
"Most people don’t want to put in that many hours."
WUNC spoke with Mayor John Byrum at the town hall to find out more about how Midway formed and what’s happened in the 18 years since

Tell me about the history of Midway and why the community decided to incorporate as a town in 2006
“It was all about a desire to retain our rural identity
there were various cities being annexed by larger municipalities or cities
and there was a fear that Winston-Salem proper would one day come a little south into Davidson County and take what is now known as the town of Midway
The incorporation of the town really happened as a result of trying to preserve the identity of Midway.”
how did you decide early on what services were going to be offered
“The state actually gives a lot of guidance when it comes to that
you have to provide a basic number of essential services
The essential services we provide here in Midway is garbage pickup
We get to have a planning and zoning board
and they get to hear requests from citizens if they want to rezone their property.”
How would you describe the differences between how Midway has developed over the past two decades as compared to unincorporated neighboring communities around here that are also dealing with some of the same suburban growth pressures
“If you wanted to develop a business or put up a neighborhood
residential and commercial developers would probably find Midway to be a little bit more restrictive
But that's not to keep development from happening
the architectural feel of what an area is.”
Did the development controversy in Summerfield create any concerns here that this could become a trend affecting some other low-density
sometimes those things don't get worked out without there being collateral damage for the municipality and for developers and for different individuals who are involved in the process
and deal with it and just try to be level-headed
We really do try to make decisions solely based off what's best for the town.”

Owensboro Catholic’s Aubrey Randolph has signed with Midway University to continue her basketball and academic career. A standout on the court, Randolph spent five seasons with the Lady Aces, helping them win the 3rd Region Championship in 2022 and advancing to the second round of the State Tournament.
“I liked everyone that has been there, the culture around it, and they were super welcoming whenever I went to visit,” Randolph said. “They are all super close, and they are girls I have known for a while. I have played against them and know how they play.”
It also helps that longtime teammate Karmin Riley will also be attending Midway, even though it wasn’t planned that way.
“It means a lot to continue playing with her. I have known Karmin since fourth grade, so that means a lot to me. I think it’s going to be really fun.”
During the recruitment process, Randolph heard from a few schools in Missouri and Illinois, but the opportunity to stay in her hometown won out. It was after attending an in-depth workout at the end of her sophomore year that Randolph realized she could play collegiately.
“It was a 21-week program that I went through,” Randolph said. “I went to the gym five times a day and did workouts for about an hour and a half.”
Viewing herself as a defensive player, Randolph spent the last few years honing her offensive game. While at Midway, she plans to pursue an academic career in physical therapy.

“We had a chance to chip away," Warwick head coach Ryan Brown said
"We’ve done it before where we had chances to chip away at the lead and it doesn’t have to be a big lump sum
But when you get down that far you know you have to play perfect
Our boys never gave up and that has been the identity of our group this year.”
Joramo finished with a share of the game-high score with 16
He shared that mark with Gudajtes after he was able to solve Midway’s layup woes in the third and fourth quarter
Gudajtes found those open spaces to get Midway back on track
all while the team was able to get hands on rebounds and keep second chance opportunities on the table
The Mustangs kept pouring it on in the fourth quarter as their lead grew back up to 20 and beyond
Their third-place finish in Region 2B puts the Mustangs in the state-qualifier round in Fargo on Saturday
“We got into some foul trouble which affected our press a little bit," Robinson said
"We weren’t able to do some of the things we are able to do
But in the second half we were able to come back with that press and it got things back to the tone we want."

(WOWT) - A Southwest flight departing from Omaha on Tuesday morning had a close call with a private jet when attempting to land in Chicago
A similiar incident happened two hours earlier at Ronald Reagan Washington National Airport
when an American Airlines plane arriving from Boston was forced to climb back into the sky to avoid a private jet crossing the runway
and 115 Category D incidents occurred there during the same time period
According to U.S. Department of Transportation statistics
there were about 79,594 departures at Midway airport in the 12 months ending in November 2024; that’s down from about 101,000 in 2006
the earliest data available; and 88,000 in 2017
First Alert 6 talked to passengers on the Southwest flight who said they were surprised when they saw what happened after their landing
“We had no idea what happened,” said Emily Novak of Omaha
There was no panic on the plane at all that I noticed
just made it seem very routine and then we saw the video we were like
Honest to God had no idea that even happened.”
who said she was already stressed about flying
“I was already kind of anxious going on the plane
just because of what’s been happening this year so far with all the flights crashing and things happening,” Maszk said

The service district fired its first salvo Wednesday
in response to a lawsuit filed by a small group of Midway residents in February
Four homeowners allege the odor of the HVSSD’s wastewater treatment ponds harms both their health and their property values
Taking their grievances to 4th District Court marked an escalation for the residents
who have complained for years they’ve suffered because of the smell of the lagoons
nasal congestion and sleep problems because of the odor
which can be strong when the seasons change
The residents’ attorney told KPCW his clients decided to sue because they didn’t believe the district would address their concerns with any urgency
HVSSD denies it intentionally caused any harm to residents and says it does not owe the residents any damages
The district says the court should consider the residents’ choices to purchase property near the treatment ponds
Since they didn’t object to the lagoons at the time
the residents have lost the right to do so now
HVSSD also claims it is protected by Utah’s Governmental Immunity Act
It says the wastewater treatment plant complies with all environmental and legal requirements
Residents say the ponds have prevented them from enjoying their property
but the service district argues that since they chose to live in an area “where such operations are customary and expected,” they can’t claim the lagoons unreasonably interfere with their property rights
The district also says there could be multiple culprits behind the smells
The residents now have two weeks to respond and share relevant documents and other information with the court
The court estimates evidence will be gathered for the case through next summer
scientists are still working to understand what causes the smell during changing seasons and what health effects
Researchers from Utah’s Environmental Epidemiology Program are conducting a risk assessment for a toxin called hydrogen sulfide
which has a rotten egg smell and can cause symptoms like headaches
Scientists started collecting data in late March
the Boeing passed approximately 200 feet behind the tail of the Challenger after it had crossed the runway and was directed to hold its position by ground control
in which the Flexjet pilots described confusion as to their taxi clearance
which included clearance to turn left and taxi on Runway 04L
cross Runway 31L and hold short of Runway 31C
they were onto Runway 31L before they could “center the nosewheel” from the turn
They also noted that Runway 31L is comparatively very narrow (60 feet wide)
matching the width of most taxiways on the airport
which led them to believe that it was a taxiway and that Runway 31C (150 feet wide) in front of them was actually Runway 31L
what used to be Runway 31R is now Taxiway H
The crew further testified that their vision was impaired by the low sun
which at 8:48 CST was just 22.4 degrees above the horizon and on an azimuth of 126 degrees from the runway intersection—closely aligned with Runway 13/31C
which was the Southwest flight’s landing direction
In the seconds the Challenger approached the edge of Runway 13/31C
controllers tried to issue a call to hold short
but the transmission was blocked by another aircraft
The Flexjet pilots said they did not see a hold short line indicating they were approaching Runway 13/31C
but the NTSB report includes airport-supplied images showing the yellow and black lined markings on the surface of Runway 04L and marker signs on the edge of Runway 04L clearly indicating “Runway 13C Runway 31C.” SWA2504 circled back to land safely
and after a telephone conversation with the tower
the Flexjet flight was cleared for takeoff and continued its flight schedule for the day

A roadblock is standing in the way of the Tuloso-Midway school district's plans for a new junior high school — finding the land to build it on
Tuloso-Midway Independent School District voters approved a $165 million slate of bond projects
Part of this bond package was a new junior high school
the school board authorized legal counsel to begin condemnation proceedings to acquire 40 acres on McKinzie Road if the district can't negotiate a sale with landowners
School officials didn't realize in 2023 that location would become a sticking point
The district could not consider buying land before voters approved a bond
The district has its eye on a 40-acre piece of land that's part of a larger tract stretching over nearly 870 acres
The junior high school would serve seventh and eighth grade students and allow for a broader grade realignment
Tuloso-Midway Middle School would serve fifth and sixth grades; Tuloso-Midway Intermediate School would serve second
third and fourth grades; and Tuloso-Midway Primary School would increase the pre-K program
Braman Ranches representative Bland Proctor said that Braman Ranches "has hired eminent domain counsel to defend its property rights" over land that has been owned by the Braman family for more than 30 years
According to a deed without warranty document included in TMISD school board meeting documents
several Nueces County tracts of land were granted to Braman Ranches LLC in 2008
having previously been owned by members of the Braman family
and property records indicate the land is used for dry crops

The company's managers are all members of the Braman family
according to the Texas franchise tax public information report
Tuloso-Midway ISD stretches from the Nueces River and the mouth of Nueces Bay down past Texas State Highway 44
surrounded by the Calallen and Robstown school districts to the west
West Oso Independent School District to the south and Corpus Christi Independent School District to the east
But most residents live in the northern portion of the district
All of the district's current schools are located north of State Highway 44
Despite the wide stretches of land in the southern part of the school district
very little of it is suitable for a new school
The U.S. Environmental Protection Agency has guidelines recommending that schools identify all hazardous waste facilities within a mile of potential school sites and all large industrial facilities within a half mile
The screening perimeter is 2 miles for airport runways
1,500 feet for oil and other hazardous material pipelines
a quarter mile for flood zones and about a mile for rail lines
If the school district wants to ensure the new school is a comfortable distance from the industrial and transportation entities
then large swaths of the district are off the table
A 2-mile stretch surrounding Corpus Christi International Airport covers most of the southwest portion of the school district
Industrial sites impact much of the undeveloped areas in the central north of the school district and the areas near State Highway 44
Other areas to the south of the district are located within flood zones or far from any current sewer and water access
Some areas are "riddled with pipelines," said Patrick Hernandez
assistant superintendent for district operations
The closest options are between McKinzie and Rand Morgan roads
though there's also land outside the hazard perimeters east of North Clarkwood Road
According to Nueces County Appraisal District records
Braman Ranches owns nearly all of the land west of the neighborhoods surrounding Tuloso-Midway Intermediate School and Rand Morgan Road
Tuloso-Midway ISD was eyeing three potential properties
A third 61-acre parcel was located east of North Clarkwood Road with different owners
The Braman Ranches properties included 60 acres out of a 304-acre parcel located directly south of Tuloso-Midway High School and the 40-acre piece a tad farther south on the east side of McKinzie Road
But the 40-acre piece is the district's preferred location
This is the piece of land at the center of a brewing eminent domain case
the Tuloso-Midway ISD board of trustees issued a resolution declaring a "public use and necessity to acquire" the surface of the portion
The resolution authorizes district administration to negotiate with the landowners for the acquisition of the parcel
It also goes a step further and authorizes legal counsel to initiate condemnation proceedings if the owners refuse to sell
"This is clearly in the public's best interest for our new junior high school," VanMatre said
adding that the attempted land acquisition has been a long process and eminent domain is not the district's preferred method for finding a location for the school
the district presented Braman Ranches with a letter of intent
The district also attempted to buy the other Braman Ranches parcel south of the high school in the fall but was initially refused
the district has decided that that Braman Ranches parcel is less suitable
primarily because a pipeline runs beneath it
the district would have to pay to remove or relocate the pipeline
which could cost $1.3 million and delay the project up to a year
according to information provided by VanMatre
As for the third potential site on North Clarkwood Drive
VanMatre said that the roads near this area "are not good" for school buses and parents bringing children to school
The 40-acre parcel that TMISD wants to acquire is part of a larger tract of Braman Ranches land
VanMatre said that the reason the district wants this specific parcel is that it is aligned with where Oregon Trail would run if the roadway is extended
The city of Corpus Christi's 2023 Roadway Master Plan, Land Use Assumption and Capital Improvements Plan includes several potential new road projects that would connect McKinzie Road and Rand Morgan Road
both of which are also included for potential road widening
The study examines how areas of town might develop in 10 years in the entire city to inform impact fees that fund roadway improvements
The district will "do everything possible" to avoid exercising eminent domain
But the district is focused on the 40-acre property and is not considering other properties and would not "under current conditions."
and Texas constitutions allow private property to be taken for public use with "just" or "adequate" compensation
Tuloso-Midway ISD has had eminent domain authority since 1947
The district did not file any condemnation petitions between 2016 and 2024
according to the comptroller's eminent domain database
If Tuloso-Midway ISD files a condemnation case, it will take place in Nueces County. In that event, the judge will appoint three local landowners to serve as special commissioners to decide the amount of money adequate to compensate the landowner. A condemnation can be challenged by the landowner, with the right to a trial by judge or jury, according to the Texas Landowner's Bill of Rights
