WAUKESHA — A New Berlin police officer charged after being accused of removing drugs from storage lockers at the police station in late 2023 to early 2024 was ordered to proceed toward trial after waiving a preliminary hearing in the case on Monday
Steven Dodson
was charged April 2 in Waukesha County Circuit Court with a count of misconduct in office in one case
a felony punishable by up to 3.5 years in prison
and also was charged with possessing a firearm while intoxicated
Dodson also was cited for operating while intoxicated and operating with a restricted controlled substance
following an incident of alleged OWI on April 1 that involved a hit-and- run to a traffic sign in West Allis
Dodson waived his preliminary hearing and saw a plea of not guilty entered on his behalf
that drugs supplied by the Drug Enforcement Administration for training were missing from storage lockers; specifically
and 14 grams of methamphetamine and were last seen Nov
An officer hoping to take the drugs to Fond du Lac for training discovered the drugs were missing May 7
as well as notes indicating the amounts of each
leading him to believe the items were stolen
A captain reviewing video of the property room was able to link 12 instances the locker in question was accessed to Dodson
incident in Mukwonago where he was found passed out unresponsive behind the wheel of a running vehicle at the Walmart store there
and when he was brought to after being given Narcan
A urine screen found both fentanyl and cocaine in his system
Dodson later said he was prescribed Vicodin for a herniated disc in his back
and the Walmart incident was a result of his mixing prescriptions
Dodson is free on $2,000 cash bail between the two cases
The 20-year veteran of the force has been on paid administrative leave with the New Berlin Police Department since December
WAUKESHA — A New Berlin police officer has been charged after being accused of stealing cocaine

He also was ordered to wear a bracelet monitoring him for alcohol use and to comply with pretrial drug testing
A call to his attorney Michael Steinle late Wednesday afternoon was not returned
nor was a message left with a New Berlin police spokeswoman
According to the complaint in the misconduct case: New Berlin police noticed May 7
and 14 grams of methamphetamine were missing and were last seen Nov
A captain reviewing video of the property room was able to link Dodson to 12 instances the locker in question was accessed
SIGN UP
He admitted he’d been taking more Vicodin than prescribed
police found Dodson wouldn’t explain how he got more medication when he ran out
and doctors documented his requests for early refills because he had a hard time getting off hydrocodone
The complaint added the first documented entry to the drug storage locker at the police department came Dec
only three days after Dodson’s November prescription would have run out
Dodson would have had no need to access the drug locker as part of his job duties
The complaint said officers were able to document on video when Dodson was in or near the property room at the times of the entries to the drug locker between Nov
and he was the only police employee on duty and inside the department during the entries
Dodson was arrested for first-offense operating while intoxicated at about 2:20 a.m
Tuesday after he lost control of his vehicle as he headed to his Mukwonago home
and ended up in the median of Interstate 43 south of Racine Avenue
According to the complaint in the firearm matter
Dodson indicated he was in West Allis watching the Brewers game and headed home to Mukwonago
He was observed by a deputy to be having "a very hard time standing," and failed field sobriety exercises before giving a breath test that showed a blood alcohol level of 0.17
he had a loaded .40-caliber pistol in the console of his car
Dodson’s car was linked to a hit-and-run accident in West Allis where he took out a traffic standard at 70th Street and Greenfield Avenue at about 12:34 a.m
Tuesday; parts matching his vehicle were found at the scene
He told police there he’d been at a bar prior to driving home
Dodson was the police officer who crashed his car into one driven by Jaylen Frier near the New Berlin police station on Aug
Dodson was reading a text message while driving
Frier sued the city in circuit court and won a judgement of $159,246
Frier also filed a federal lawsuit against the city which was dismissed later that year

NEW BERLIN - A 20-year New Berlin police veteran allegedly took narcotic drugs stored for the department's K9 training program
resulting a felony misconduct charge Wednesday amid his ongoing suspension
who's been on administrative leave since December
was arrested for suspected drunken driving Tuesday while in possession of his gun
and will face an additional charge of having a firearm while intoxicated
The New Berlin Police Department spelled out both allegations in a news release Thursday afternoon that for the first time revealed an 11-month investigation in 2024 stemming from the drug theft
But the criminal complaint filed Wednesday in Waukesha County Circuit Court provided more details
including what drugs were taken and why Dodson was suspected during that investigation
The drugs — 28 grams each of black tar heroin
plus 14 grams of methamphetamine — were discovered missing on May 7
issued by the federal Drug Enforcement Administration in September 2022
in this case New Berlin's K9 program run by another officer and a separate dog handler
The DEA-issued drugs had last been used for training in November 2023
New Berlin authorities asked the Waukesha Police Department to conduct an impartial investigation into the theft
Surveillance tools showed Dodson as having been near the property room where the drugs were stored 12 times between December 2023 and April 2024
New Berlin police officials said it's an area which Dodson had no authorized reason to access
New Berlin police also suspected Dodson as a result of an incident in Mukwonago
Police and rescuers found Dodson unconscious inside his vehicle on East Wolf Run Road after an apparent drug overdose in August 2023
forcing them to administer Narcan to revive him
investigators said they found evidence that Dodson had been taking excess amounts of Vicodin and Gabapentin beyond what had been prescribed for back pain and may have obtained painkiller drugs that were laced with cocaine and fentanyl
The investigation also showed his inability to fill Gabapentin refills coincided with the period between November 2023 and April 2024 when the DEA-issued drugs were believed to have been taken
Dodson was placed on administrative leave in December following the 11-month investigation
It's not clear why the criminal charges were filed more than three months after the investigation concluded
and what role the drunken driving-related incident played in the timing
Dodson made his first appearance Wednesday on the misconduct in public office count
A separate criminal complaint focused on the April 1 incident
in which Dodson's pickup truck was found stuck in a ditch near Interstate 43 and Racine Avenue at 2:20 a.m
which authorities believe was tied to a hit-and-run accident earlier that evening involving a traffic pole in West Allis
Dodson was unable to stand on his own and failed sobriety tests
His gun was found loaded in the center console of his truck
If convicted on the public office misconduct count
he could face as much as a 3½-year prison term and a $10,000 fine
Because the intoxicated gun possession charge was a separate incident
he could face additional penalties if convicted
In a statement included in the news release
the New Berlin Police Department said it was "saddened" by the alleged incidents and is still processing their impact
"It is vital the public understands the NBPD takes allegations of this kind seriously and will hold officers accountable if they are found to have violated Department Rules or state law," the department said in the statement
Dodson is allowed due process both as a criminal defendant and as an employee of the City of New Berlin
We request that the public respects his rights and has patience while the process plays out
"We recognize the disappointment this case may cause our officers and community members," department officials added
"Let us be unequivocal — this is not who we are
The officers of the NBPD remain dedicated to serving this community with honor and professionalism
and we will work tirelessly to ensure that trust is restored and maintained."
was not immediately available to comment late Thursday
Dodson is currently free on a $1,500 cash bond

A group of New Berlin homeowners who are part of the West Allis-West Milwaukee School District is suing the school district in an attempt to detach from that district and join the neighboring New Berlin School District
The group filed a lawsuit March 24 in Waukesha County Circuit Court after the West Allis-West Milwaukee School District declared its detachment petition invalid, according to online court records
Homeowner John Molling signed the group's petition
even though he had already petitioned to detach his home individually
The district cited state law in ruling that action invalidated the group petition
The homeowners are asking the court to determine whether the petition is void under state statute
if a one-year limitation would apply to the petition and for the court to approve the petition
the owners of 134 homes signed a petition to remove their homes from the West Allis-West Milwaukee School District so they could join the New Berlin School District
The West Allis-West Milwaukee School District agreed to hear the petition Feb
10 approved the residents' request to attach
the West Allis-West Milwaukee School District notified petitioners it had canceled the Feb
24 hearing because Molling had already petitioned to detach his house
and his signing of the group's petition rendered it invalid
The group of petitioners was unaware that Molling had filed his own petition
Molling then contacted the West Allis-West Milwaukee School District seeking to withdraw his individual petition so the group petition could move forward
the district denied Molling's request and said that since the district declared the group petition void
Lawsuit claims district is trying to silence petitionersThe lawsuit claims the West Allis-West Milwaukee School District is trying to silence the petitioners
and said the school district failed to provide any written description of the procedures for school district reorganization
The lawsuit also said the New Berlin School Board had no procedural problem in approving the group's petition
it argued that there's precedent for homes detaching from the West Allis-West Milwaukee School District and attaching to the New Berlin School District
which is within the state Department of Public Instruction
approved a petition to move 161 homes from the West Allis-West Milwaukee School District to the New Berlin School District
The West Allis-West Milwaukee School District appealed that decision, but in February 2024, Waukesha County Circuit judge Brad Schimel upheld the decision
New Berlin School District director of communications and public relations David Cotey declined to comment
saying the district doesn't provide statements on pending litigation

NEW BERLIN — The School District of New Berlin Board of Education will consider implementing a universal four-year-old kindergarten program beginning in the 2025-2026 school year when it meets Monday
The Early Learning Program registration originally scheduled for this week was postponed pending the school board’s further discussion
New Berlin residents commented on the proposed program
Sarah Doran thinks it is awesome that New Berlin is finally making it a priority to provide a 4K program
'The kindergarten teachers and administrators that I’ve spoken to from my oldest’s New Berlin elementary school are very excited about the prospect of 4K being offered through the district
We are one of the only districts in the area that don’t have it and most families are shocked when they have kids and they get to the 4K age and realize that New Berlin doesn’t offer it
Many families scramble to find a private 4K program
and coordinate and pay for wrap-around care
Doran said she sent her oldest to a private school that offers 3K and 4K
and she is now at a New Berlin elementary school
'Our middle child is currently attending the private school for 3K
so I don’t know that we’d change to the New Berlin school district program for 4K for our youngest when she’s that age
but I love that there would be the option,' she said

NEW BERLIN - A growing chicken eatery chain has expanded into New Berlin and has eyes on possibly three other suburban Milwaukee locations
spicy additions for a taste currently shared by only a few other spots regionally and statewide

Here's what you might want to know about the relatively new chicken chain
But it isn't KFC (with battered breasts or legs) or a Chick-fil-A (with grilled chicken options or salads)
Nor is it a Buffalo Wild Wings (with beef burgers and large salad choices)

Dave’s Hot Chicken comes in seven spice-to-order levels
starting with no spice whatsoever and climbing incrementally to its trademarked Reaper — which the company says requires a signed waiver
the chain attributes its menu for its success and fast growth
Dave’s Hot Chicken’s CEO Bill Phelps said the chain emerged from an East Hollywood parking lot pop-up restaurant with only a portable fryer (a $900 investment) and picnic tables from the backyards of its four founders: Dave Kopushyan

NEW BERLIN - A conspicuously vacant quadrant adjacent Walmart on Moorland Road has again found a developer interested in turning it into mixed-use property
featuring hundreds of apartments and significant retail space
While nothing is certain for a plan that's now merely conceptual
Wimmer Communities has pieced together a neighborhood that would be called The Conservancy
green space and wetlands that would be preserved
The city of New Berlin's Plan Commission got its first formal look at the plan Monday
though more for discussion of certain government-oriented details tied to zoning and land use rather than what could eventually become a final site plan
consisting of three separate lots along Moorland and south of Greenfield Avenue
would be heavily residential with more than 350 apartments
but included in the concept is nearly 20,000 square feet of retail/office/commercial space
No particular commercial tenants are specified at this stage
but the commercial space would sit on the ground level of two large apartment buildings called the Conservancy Center
the focus was strictly on the residential buildings
the development would include The Conservator
a 71-unit apartment complex with an ornate facade; Meadows Residences
a series of much-smaller eight buildings with four units apiece; and Woodland Residences
four apartment buildings totaling 216 units sitting along the wooded area to the east
Hales Corners-based Wimmer noted that the development integrates all elements to create a neighborhood environment
Beyond the market-rate residences and commercial space
those elements include a clubhouse called The Conservancy Resident Club
a 5,000-square-foot building with an outdoor pool
punctuated by a trail-like conservancy walk into natural areas
The design also facilitates access to the New Berlin Recreation Trail
the former interurban rail right-of-way that stretches from Waukesha to West Allis
In its written presentation to the Plan Commission
Wimmer said "The Conservancy shall serve to establish
populate and animate the southeast quadrant to a new commercial
providing both quality of life and economic benefits to the City of New Berlin."
neighbors have ideas for the developer to consider for the commercial space — a cat café and a chicken restaurant are two of them
they are also glad about what isn't planned — a strip mall
a car wash and large destination retail space
(The plan notes an emphasis on retail places built as a convenience to neighborhood residents
especially from Brookridge on the opposite side of Moorland
also expressed concern about traffic safety
seeking assurances Wimmer would work with Waukesha County on a traffic study to make the addition of hundreds of apartments palatable
city planning staff asked commissioners to focus on several points rather than the details of Wimmer's plan
the project might require the city to amend its comprehensive plan
Though the area in question had been considered in a previous development proposal
the new plan might work better if all the land were designated for mixed-use residential
instead of two lots that are currently designated as suburban commercial and institutional
City officials will also address density — the ratio of living units to available acreage
Mandel Group, a well-known builder of homes and apartments in the Milwaukee area, originally proposed something similar on the 34.5-acre site in 2023: senior housing on 6.5 acres
a small retail shopping center on 6.6 acres
and a multifamily apartment complex on 21.4 acres
the plan was still moving through city government for approvals for possible construction sometime in 2024
"They will have many hoops to go through and it will be over several years," he said
noting that the Plan Commission's first step to offer feedback to staff on key land-use points still has to be discussed further as the plan evolves
NEW BERLIN - A reportedly intoxicated driver literally headed straight into trouble when he drove the wrong way and directly into the path of a moving New Berlin police squad car Sunday night
The result was a three-vehicle collision on Moorland Road in New Berlin at about 10:24 p.m
A police officer broke a finger in the crash
culminating in the arrest of the wrong-way driver for operating while intoxicated (third offense) and causing injury
according to a Monday news release from the New Berlin Police Department
The officer was driving south on Moorland just south of Cleveland Avenue when he saw a northbound vehicle heading toward him in the southbound lanes of the median-divided road
While attempting to evade a head-on collision
which investigated the OWI allegation at the request of New Berlin police
arrested a 57-year-old New Berlin man at the scene
He was taken to the Waukesha County Jail shortly thereafter
the department's public information officer
The Wisconsin State Patrol is also investigating the accident
Brad Polczynski acknowledged incidents such as this one — in which an alleged drunk driver collides with a squad car by chance
He recalled an accident roughly 15 years ago in which a driver collided with a New Berlin police car in an intersection in a third-shift mishap
The names of the police officer and the driver in Sunday's accident were not released
Charges were pending against the driver Monday
The officer was treated at a local hospital and released
NEW BERLIN - At the point where a decisively urban New Berlin road intersects a notably narrow rural route
a developer has plans in mind for an upscale 332-unit apartment and townhome complex within a 34-acre parcel
Menomonee Falls-based Continental Properties has submitted a conceptual plan for the northwest corner of Moorland Road and College Avenue
envisioning 11 two- and three-story multi-family buildings on 17 acres and 16 duplex townhomes on about 2½ acres
The proposal will get its first review at a Feb
Most of Moorland at that point is at least four lanes of a divided roadway
with a few small businesses until it approaches Moorland on the east side of New Berlin
undivided roadway with no defined shoulders
Continental's plan mixes rural and urban elements on 34 acresContinental's concept plan itself is divided
with most of the apartments laid out along Moorland on the east side of the property
would be preserved wetlands in a tree-filled area
visually and physically separated from the apartment buildings
The plan includes preliminary renderings of the buildings
which would be similar to other development proposals in New Berlin and elsewhere
Facades would feature architectural accents such as varied rooflines
two- and three-bedroom units — would have open-living floor plans with interiors that include white or dark wood cabinetry
wood grain flooring and large kitchen islands in all homes
Washers and dryers are also included in each unit
Like other recent development plans locally
the apartment concept has an obvious upscale element: a planned 4,000-square-foot clubhouse
Continental officials said the development represents an "affordable living" option for New Berlin residents
consuming no more than 20% of the median income for the area
"Renters are typically 20-34 years old and appreciate shared amenities and a neighborhood-oriented community design," Continental Properties development associate Katie Skelton said in a summary document accompanying the concept plan
"Residents tend to be sociable and enjoy living in a community with a friendly
The addition to these market-rate rental units play to New Berlin's advantage
"The proposed development at New Berlin will benefit the City of New Berlin and the surrounding retail community," she said
"The (development) will help meet the demand for rental housing in the city while providing a unique
quality housing opportunity for local employers and residents
The proximity to existing and future retail will increase City sales tax collection and will help draw future retailers to the area."
3 Plan Commission meeting could reveal any concerns about the concept or any of its elements
Continental itself provided few details about College Avenue
from which there would be limited secondary access to the development
It wasn't immediately clear if the city would require any financial support from the developer for road improvements
New Berlin Mayor Dave Ament did not immediately respond to an email addressing that point
Continental is not requesting tax-increment financing
a public subsidy that usually diverts new tax dollars generated by improvements to pay for certain development-related costs over two decades or more
the property would immediately bolster the city's tax base once the development is complete
That means any road costs could be offset by the taxes generated by the higher property values
That doesn't mean there will be no opposition to the plan
Proposals from the two new developments just south of Greenfield Avenue on Moorland drew concerns about density and traffic
despite a largely urban environment shared with the city of Brookfield
Information was not immediately available about that exchange
Developer hopes for approvals by summer 2025As part of the concept plan
Continental said it's hoping for city action that culminates in final approval by the end of the second quarter of 2025
Skelton listed a schedule in which the city could consider amending its comprehensive land-use plan and rezone the property by May
(The land is currently zoned for agriculture and conservation
with a projected future land use for a business park or industrial facility.)
That could depend on Continental's acquisition of the land at a later date

NEW BERLIN - A new city will now wear the venue crown of the Miss Wisconsin pageant
which in 2025 will move to New Berlin from Oshkosh
New Berlin city and school district officials lauded the decision of the Miss Wisconsin Scholarship Organization
the 88-year-old group which announced the change Tuesday
The organization's annual competition is a precursor to the Miss America pageant
the high-profile pageant with its own long history
The state competition will take place at the New Berlin West Performing Arts Center
part of the school district's New Berlin West campus on Cleveland Avenue
"The city is always looking for partnerships and developments that focus on the economic health of our community," New Berlin Mayor Dave Ament said in a statement included in a news release by pageant officials
"This partnership will enhance our local economy by attracting visitors and promoting community engagement."
Ament noted that pageant officials approached him
while he was attending the 2024 Oshkosh event
There's a lot of their volunteers and people in their organization from our general area — in particular from New Berlin — so we struck up a short conversation and agreed to meet."
Ament and New Berlin officials discussed the available facilities
including the PAC and the city's new recreation center
which also could house certain pageant events
Ament said the PAC was a key reason that made New Berlin attractive
New Berlin School District officials said they also appreciate Miss Wisconsin Organization's recognition of the local performing arts center
a venue that they say has growing prestige in the region
"The West Performing Arts Center is a beautiful venue," Joe Garza
we have worked hard to bring more concerts and special events to it so that our community can enjoy this tremendous space."
Garza called the collaboration between district
city and pageant officials a "mutually beneficial partnership," one which "aligns perfectly with our strategic goals and will give us yet another opportunity to showcase the PAC and our incredible school district."
Miss Wisconsin Organization likewise praised the New Berlin venue and effort
but also voiced appreciation for Oshkosh and its long connection to Miss Wisconsin
"On behalf of the Miss Wisconsin Organization
I would like to thank Oshkosh for 61 wonderful years hosting our competition," Brenda Baudo
executive director of the Miss Wisconsin Scholarship Organization
"We are forever grateful for the incredible generosity and support of countless volunteers and businesses who helped shape who we are today
"As we embark on our move to a new host city
we are excited about our partnership and possibilities of future events leading up to and including our competition," Baudo added
In a story published by the Oshkosh Northwestern
Oshkosh officials admitted a combination of surprise and sadness over the pending departure of the mainstay competition locally
"Our community has been extremely supportive of this event and we are disappointed by this news," said Oshkosh Convention and Visitors Bureau executive director Amy Albright
"We are proud to have hosted this event for 61 years and wish the organization all the best."
The Miss Wisconsin Competition is open to young women ages 14 to 27 interested in competing for the title and related scholarship
The precursor Miss New Berlin and Miss West Allis Competitions will be held on Nov
Pageant officials noted that four Miss Wisconsin winners — Jayme Dawicki in 2002
Meghan Coffey in 2006 and Rosalie Smith in 2015 — have either hailed from or represented New Berlin over the past 25 years
