WEST PALM BEACH — Five Tenet hospitals in Palm Beach County have accused a national hospital-rating organization of orchestrating a “pay-to-play” scheme
favoring hospitals that participate in its surveys and failing those that don't
attorneys for Tenet said Leapfrog Group's grading system relies largely on self-reported and unaudited data and ranks hospitals according to their participation
The hospitals' attorneys said these ratings aren't just wrong
but dangerous — driving patients away from safe facilities and into the waiting rooms of worse ones
"The Leapfrog Group's business model is as simple as it is sinister: prey on public fear
distort the truth and profit from deception," the attorneys wrote in a federal lawsuit filed April 30
a nonprofit which claims to promote health-care transparency and safety
the group's attorneys rejected Tenet's "pay-to-play" characterization and said its patient safety data is credible
"Tenet is attempting to shoot the messenger instead of addressing the serious patient safety problems," wrote attorney Kimberly Blair in January
Blair said Leapfrog "encourages Tenet to make patient safety a priority and improve."
Seven attorneys from across the nation represent Good Samaritan Medical Center
Mary’s Medical Center and West Boca Medical Center
They said the facilities stopped responding to Leapfrog’s 100-page surveys during the COVID-19 pandemic
choosing instead to focus on meeting federal and specialty-specific health standards
The hospitals — which together treated about 470,000 patients last year — said that until 2024
Leapfrog graded them based on available data and never gave them lower than a "C."
when Leapfrog tweaked its methodology to fail nonparticipating hospitals automatically
Leapfrog gave the hospitals “D” and “F” ratings
Photos: Palms West Hospital nurse Leelamma Lal recovering after February patient attack
“The integrity of information guiding patients' health care decisions must be beyond reproach," the attorneys said
has corrupted that trust — weaponizing fear
and misleading the public to serve its own craven financial interests."
Leapfrog's supposed mission of protecting patients is a "sham," the attorneys continued
The lawsuit points to examples where hospitals that earned top Leapfrog grades were simultaneously cited by federal regulators for life-threatening patient care deficiencies
received consecutive "A" grades from Leapfrog while government inspectors documented dangerous lapses in care
including delays blamed for patient deaths
It also cites multiple academic studies and statements from the American Hospital Association warning that Leapfrog’s methodology is unreliable and should not be used to guide patient decisions
the hospitals' attorneys said they asked Leapfrog to stop issuing misleading grades
"Hospital ratings and hospital safety grades are Leapfrog's opinion," Blair wrote in an email to Tenet's attorneys
"Courts nationwide have consistently held that such opinions are protected speech under the First Amendment."
Tenet's attorneys said “there is no First Amendment protection for deceptive practices."

(CBS12) — The Palm Beach Gardens tax cheat who was sentenced to 18 months in prison for his decade-long fraud scheme that funded a lavish lifestyle will not have to serve any more time for his crime
Less than two weeks after a federal judge handed down his sentence
the man who failed to pay more than $10 million in taxes – Paul Walczak – learned he would be a free man
President Donald Trump wiped Walczak’s slate clean with the stroke of a pen last Wednesday by granting him a full and unconditional pardon
Department of Justice explained how he ran multiple health care companies
had a workforce of 600 people and an annual payroll of over $24 million
Walczak was required to withhold Social Security and Medicare taxes
An employer is supposed to turn those funds as well as his companies’ portion of Social Security and Medicare taxes to the federal government
he kept some of that money and used it to enrich himself
The crimes began in 2011 when Walczak did not pay taxes for two quarters of that year
the IRS began reaching out to try to get his payments back into compliance
Walczak kept pocketing a portion of the owed payroll taxes
which he was still collecting from employees
he withheld nearly $7.5 million from them between the years of 2016 and 2019
his company was supposed to pay $3.4 million as part of its share of Social Security and Medicare taxes at that time
he used money from the business to buy a yacht and transfer hundreds of thousands of dollars to his personal accounts
They also determined that his business accounts were also used to buy personal items at Goodman
the judge had ordered Walczak to pay more than $4 million in restitution

Ed Modla: Defined Outcome ETFs can provide a path for investors to gain indirect exposure to the derivatives markets
A key feature of these products is the calculated risk-reward profile which is largely accomplished using options contracts
OIC will highlight this topic in the morning of day 2 in “The Rise of Defined Outcome ETFs” when a panel of industry experts will weigh the benefits of simplicity against the extent to which investors should understand the construction of these products to help determine their comfort level
and automation transforming trading strategies and risk management in the options industry
Ed Modla: Sophisticated trading systems have incorporated the element of AI for quite some time
the speed and capability of this technology is expanding at a rapid pace today
Traders and investors are always looking for ways to gain an edge

this will surely be another night to remember
there will be several formal and casual networking opportunities
including the “Surf’s Up” Networking Event on Wednesday
and the golf outing and a pickleball mixer on the final day
The race for an open seat on the Palm Beach Gardens City Council is ablaze over firefighting
A second contest pits a veteran incumbent against a newcomer suspicious of city government after the decision to convert a city park into an ice-rink complex
Group 2 incumbent Marcie Tinsley and Group 4 challenger Chuck Millar
intimately familiar with site plans and zoning disputes after spending most of their professional careers navigating the intricacies of local government
is a fourth generation Floridian who grew up attending Hialeah Gardens city meetings with his father
And he learned perseverance and patience as he and his wife
navigated the nation’s health system to diagnose and cure their critically ill son
whose interests as both an ice-skater growing up in Green Bay
and a bike rider who co-owns an Abacoa bike shop
converged into opposition to the city’s decision to close a skateboard park and convert Plant Drive Park into an ice-skating complex
Stet has looked into the court records of all four candidates
publishing findings about Millar here and Gilow here
with no candidate forums scheduled before the March 11 election
Stet held wide-ranging discussions with all four candidates to offer a sense of their positions
a vice president in property and construction management for Herb Kahlert’s Karl Corp.
She served from 2010 to 2017 before term limits forced her out of office
But the voter-approved term limits allow a council member to return after sitting out and she won an election to a partial term in 2021 before winning a full three-year term unopposed in 2022
She seeks a second three-year term in this cycle
One reason Gilow cited for opposing her is to make sure she didn’t win the seat again without opposition
loaning his campaign its entire $1,939 war chest
While she said she views campaigning as a gift because “you learn so much about your city,” she compared running for office to giving birth
“You really have to put yourself out there
You forget the pain you endured giving birth to children.”
Despite the city’s history of lawsuits and disputes with Palm Beach County
she praised the city for working with the county on traffic issues
she cited the 2016 agreement that allowed construction of Avenir and involved county signoff on Northlake Boulevard widening and the extension of Coconut Boulevard to Beeline Highway through the 4,000-home project
She downplayed the county’s 2021 decision to sue the city over the city’s decision to pocket county road impact fee payments from developers
After a judge ruled in favor of the county
city officials went to Tallahassee to push a bill that would force counties to negotiate with cities over how those dollars are spent
“We have to collaborate with the county to work together to solve some of these traffic-related issues,” she said
Tinsley praised County Engineer David Ricks for making a presentation recently to the City Council on experimental smart traffic signals installed on Hood Road
she also criticized the length of time it took the county to add a right-turn lane at Military Trail and PGA Boulevard
a project she said she championed for 10 years
Construction alone took from September 2021 to October 2023
On the potential for the county to seek an extension of the 1-cent sales tax surcharge to pay for transportation projects
a source of money to extend Tri-Rail on the easternmost tracks
she said she could not offer support without knowing the details
said he would support the sales tax increase
Among achievements she is most proud of over this term
she cited the three-year reduction in the property tax rate
renovation of the Burns Road Community Center and plans for a fieldhouse to complete the Gardens North County District Park
a community southeast of Donald Ross Road and Military Trail
They both advocate finding a new site for the Plant Drive Park skateboard park in the wake of the city’s decision to lease the park for 40 years to the Palm Beach North Athletic Foundation to build a $40 million
says the ice rink is the right idea in the wrong place
Tinsley did not vote on the project because her husband

But the free skatepark and the basketball courts that will be displaced were open to all
roller bladers and others use their own motion to propel themselves over berms and rollers
He pointed to cities like Ocoee and Okeechobee that have done so
Gilow builds custom bikes as a co-owner of Draco Bikes in Abacoa
The dispute over the ice rink helped Gilow form his opinions of the City Council
“I don’t believe the people of our city are represented by our council,” he said
They should be doing a job for the people that live in the city.”
Millar and Kemp are running for the seat of Carl Woods
first for the city of Greenacres in 1985 and then for a local law firm
He also served six years on the city’s Art in Public Places Board and four on the Planning
“My value added is understanding the dynamics of growth management,” he said
You can manage it in a way that has the quality of life of residents in mind.”
He has opinions on the Gardens Mall — one of three county malls that will survive; the FPL office building at PGA and Interstate 95 — “a truly eye catching entry to the city;” and the next development at the Loehmann’s Plaza site — don’t let it turn an unsightly backside to I-95
Fixing the PGA flyover traffic tie-ups will not be simple or cheap but can’t be ignored
He supports eight lanes on western Northlake Boulevard
He saw merits to both sides of the ice rink debate
but voted in December as a planning board member in favor of the site plan because it met all the city codes
After Stet’s publication of stories about court complaints over his relations with women
he posted an open letter about his struggles with alcoholism
saying his opponent “wants to use my disease against me.”
“I will not be bullied into silence,” he wrote
“I stand here today as someone who understands hardship
who has faced darkness and refused to let the negatives win.”
would oppose annexation of neighboring areas because Kemp lives in Rustic Lakes on west Northlake Boulevard
which became part of the city in a controversial 2018 annexation that most of Rustic Lakes opposed
“I love living in Palm Beach Gardens,” he said
He listed four points annexations must meet to gain his support
including the backing of those being annexed
in Portofino between PGA Boulevard and Hood Road
Even though he is running against a firefighter
Millar secured the endorsement of the city’s firefighter’s union
which recently broke off from the county union
suggested the county might try to take over the city’s fire department
it does!” favorably contrasted the city’s green fire trucks to the county’s red
Palm Beach County Fire Rescue expressed an interest in taking over multiple municipal fire departments
Sometimes the city relies on county fire-rescue to respond to calls
adding “we believe our City deserves to keep our own first responders,” and urging voters to “vote to protect Palm Beach Gardens Fire Rescue.”
he said he has no intention of working to shut down the Gardens department
“I want Palm Beach Gardens Fire Rescue to stay as the home town fire department and make it a destination fire department that firefighters want to work for,” Kemp said
A merger could only happen at the request of the city department
“Anyone suggesting otherwise is either misinformed or deliberately spreading falsehoods.”
He called the city union’s decision to back his opponent political
said he would fight to replace the skateboard park
He suggested the city should have invited more public comment before agreeing to lease Plant Drive Park for the ice rink
moved from The Acreage into the city in 2021
his priority has been the health of his son
The child’s symptoms started in 2009 when he came home from preschool having trouble breathing and in pain
according to an account on the Johns Hopkins Children’s Center website
Despite treatment and seemingly endless doctor consultations
his condition worsened until by 2013 he was reliant on a wheelchair
That’s when a doctor at the center in Baltimore identified a vascular malformation and performed surgery
he has been diagnosed with Graves’ disease
Hashimoto’s disease and atypical dysautonomia
his photo on a poster helped Johns Hopkins raise $7 million
Palm Beach County declared June 7 to be John D
living in a dorm and attending Palm Beach Atlantic University
He still spends months getting treatment in Philadelphia and Baltimore
His award-winning newspaper career spanned more than 40 years

He volunteers on the board of NAMI Palm Beach County and the Palm Beach Gardens Historical Society

has filed a lawsuit against The Leapfrog Group
accusing the organization of publishing misleading and harmful hospital safety ratings
The hospitals involved are Delray Medical Center
According to the news release sent to CBS 12 by Tenet
the lawsuit claims Leapfrog's ratings are inaccurate and corrupt
The hospitals argue that these deceptive rankings damage their reputations and mislead the public about the quality of care they provide
CBS 12 reported in December that these hospitals received "D" and "F" grades in Leapfrog's Fall 2024 survey
The Palm Beach Health Network contends that these scores do not accurately reflect their safety standards
they did not submit data to Leapfrog’s voluntary survey
which is not a regulatory or credentialing requirement
the hospitals have repeatedly tried to engage with Leapfrog to address their concerns about the rating methodology
They claim Leapfrog changed its criteria last year to fail hospitals that did not participate in the survey deliberately
Leapfrog unfairly evaluates non-participating hospitals by assigning them scores equivalent to the 'Worst Hospital’s Score' on several measures
They argue this does not accurately reflect hospital performance or patient outcomes
Florida residents should be very concerned when local hospitals..
waste money and court time to try to suppress publication of critical information their patients deserve to know," Leapfrog wrote in its response to CBS12 News
The company expressed confidence that it would win
emphasized the hospital's commitment to patient safety and clinical excellence
“Our hospitals are continuously working to improve the patient experience and have been recognized repeatedly for our leadership in quality
We will not allow that record to be smeared by The Leapfrog Group’s reckless
and fundamentally dishonest ratings system,” she said
See Also: Teen dies after being found unresponsive inside Stuart behavioral facility
The hospitals accuse Leapfrog of using a flawed methodology
and publishing false and inaccurate rankings
They allege Leapfrog pressures hospitals to pay for consulting services and promotional licenses in exchange for better grades
punishing those who decline with artificially low ratings
claimed the Center for Medicare and Medicaid Services' results show the hospitals have preventable suffering and death figures that are higher than the national average
"Instead of using their resources to file frivolous lawsuits
they should be improving how their patients are treated
That is the leadership communities expect from their hospitals," the Leapfrog statement added
The Palm Beach Health Network is the largest healthcare provider in Palm Beach County
offering the area’s only Level 1 Trauma Centers
The hospitals involved in the lawsuit have earned recognition from other independent organizations for their commitment to excellence in healthcare

At every twist and turn in the road, Dwyer softball has had an unexpected answer
Faced with the latest challenge of visiting Palm Beach Gardens to battle the region's No
the Panthers outlasted the Gators in a dramatic 5-3 in in eight innings
It's the first district championship for Dwyer in six seasons
and one of several underdog successes for a Dwyer squad that has ripped off a six-game win streak to enter regional play as one of Palm Beach County's hottest teams
"It was a really fantastic game," head coach Matt Bodenheimer said
"We have two girls that we rely on to pitch and we knew we were going to have to throw them both
After Maddy Lowdermilk and Haylee Taylor navigated a dangerous Gators (18-7) lineup to push the game into extra innings
Bodenheimer called for a play he says they've been working on for a long time
Palm Beach County softball: District preview for all local squads ahead of playoffs
Watch high school softball live on the NFHS Network
Following a successful bunt that moved runners Becca Fox and Alyssa Dover
Taylor hit a fly ball and Bodenheimer motioned for both runners to tag up
The move forced an error as the Gators hastily tried to get the runner coming into third and both runners came around to score as the ball trickled into the dugout
putting the Panthers up by two runs in extras — a lead they would hold onto in the bottom half of the eighth to clinch the victory
"That gave us breathing room in the bottom of the eight to just attack the lineup," Bodenheimer said
The pitching staff the second half of the season has been absolutely tremendous."
The statement win is the latest in a string of victories against teams like Centennial
with the Panthers' collective performance consistently improving as the season has gone on
Making the dynamic second half even more impressive is how the team has responded to losing captain Kayla Sejnoha
who broke her leg in the game against Doral Academy in March and hasn't played since
"Our defense has been incredible," Bodenheimer said
we were wondering what we were going to do at shortstop
but sophomore Riley Adams has been fantastic
We have more fielding chances than any team in the region because we don't strike a lot of kids out."
Adams made a diving catch in the hole before tagging the baserunner in the fifth inning of the game on Thursday
while Dover made an impressive catch in center field
After a rocky start to the year that saw Dwyer drop a few close games
the second half of the game proved to the girls that they could come back and play well against a quality opponent
"It all changed the first time we played Jupiter," Bodenheimer said
but something triggered where we started believing that we could win
We played really well the second half of that game
its about what we're doing as a team," Bodenheimer said

Fla (CBS12) — Swimmers visiting public parks in Palm Beach County may notice newly installed life-saving devices designed to help in water emergencies
Ring buoy stations have been appearing at various locations
including South Inlet Park in Boca Raton and Ocean Inlet Park in Boynton Beach
These devices can be used by anyone in an emergency
thanks to a South Florida mother who turned personal tragedy into a mission to protect lives
The Aden Perry Hero Life Ring initiative was inspired by the loss of 17-year-old Aden Perry
who drowned three years ago while trying to save a driver who had crashed into a Broward County lake
"He had such a bright future in front of him
it’s just hard to believe he’s not here," said Sarah Perry

These flotation devices are simple yet effective
bystanders can quickly grab and throw a life ring to a struggling swimmer
The attached rope allows the rescuer to pull the individual to shore without putting themselves at risk
the person in the water can grab a hold of it – and you can pull them to safety," Perry explained
“And if you’re not able to get to the water yourself
just having them hold onto the rope allows you to bring them closer to shore until fire rescue arrives.”
More than 400 life rings have been donated to beach parks statewide
with the latest installation taking place on Thursday at South Inlet Park in Boca Raton
including Phil Foster Park and Jupiter Beach Park
"I didn’t realize until losing my son that there was nothing available in such a water emergency," Perry shared
"It was only after losing him that I realized I had to do something about it—to live his legacy
and prevent other mothers from experiencing the grief I have."

(CBS12) — Fentanyl-laced marijuana — long seen as rare — is showing up in police reports and addiction centers
a woman in Rhode Island died after smoking marijuana that had been laced with fentanyl — marijuana that wasn’t bought from a dispensary
a West Palm Beach teen was arrested after officers say they discovered an ounce of marijuana laced with fentanyl during a traffic stop
Florida Governor Ron DeSantis signed “Gage’s Law,” requiring hospitals to test for fentanyl in all suspected overdose cases
Now addiction experts say the threat is real — and growing
Officers say the car had dark tints and failed to come to a complete stop at a stop sign
officers reported that 18-year-old Brian Rosado appeared nervous — “sweating and stammering.”
Rosado told officers he’d previously been on parole for marijuana charges as a minor
That admission gave police probable cause to search the vehicle
Experts say this arrest highlights a broader and dangerous trend — fentanyl being found in nearly everything
“We see it more and more. Everything is fentanyl,” said Carrie Carlton, a licensed clinical social worker at Beachway Therapy Center
an inpatient rehab facility in West Palm Beach
“If somebody were to buy a pill off the street
If someone were to purchase marijuana — it could be laced with fentanyl.”
Carlton says their team is seeing fewer heroin users these days — because fentanyl has completely taken over the street drug supply
“We have a lot of people who have shared with us that they put fentanyl in their weed
Carlton says Beachway tests every new patient for fentanyl — even if they say they haven’t used it
360 people reported overdoses in January,” Carlton said
While it’s unclear how many of those overdoses were fatal
Carlton says even one death from an accidental exposure is too many
about 150 people die every day from fentanyl overdoses
Governor Ron DeSantis signed House Bill 1195
who died in 2022 after unknowingly ingesting a substance laced with fentanyl
His family says they were left in the dark about what killed him — until it was too late
The new law now requires hospitals to test for fentanyl in any suspected overdose or poisoning case
“It'll make a difference because the doctor or the treating provider will know what they're treating and they'll be able to treat it appropriately,” she said
“They can administer Narcan if that's what's needed.”

(CBS12) — A man is badly bruised after he got into a few scuffles with police officers following a domestic incident on Saturday
officers from the Palm Beach Gardens Police Department responded to an apartment complex about a domestic incident
officers made contact with Dylan Arnold who was displaying aggressive behavior
The arrest affidavit against Arnold says he began to ball up his fists and make threatening gestures to the responding officers
It led to officers trying to detain Arnold by forcing him to place his hands behind his back in an attempt to restrain him
but officers were able to get Arnold into the patrol vehicle
one of the officers injured their right ring finger
Arnold was then taken to the Palm Beach Gardens Medical Center where he refused to cooperate with law enforcement
Officers note as they tried to transport Arnold out of the hospital he spat at them and even tried to kick out the back window
Arnold's action led to one of the officers punching Arnold to subdue him
He was booked on battery on specified personnel

Palm Beach Gardens is getting another organic grocery store
which sells all-natural and locally sourced food and everyday products
plans to open in February 2026 at the Prosperity Centre plaza on PGA Boulevard east of Prosperity Farms Road
This will be the grocer’s second Florida location
It has more than 30 locations across the nation — some of them in airports
The first Plum Market opened in Bloomfield Township
which was formerly occupied by Bed Bath & Beyond
which is about twice the size of a traditional Trader Joe’s
North county traffic: U.S. 1 bridge in Jupiter opens with more traffic lanes, paved sidewalks, bike paths
“We are thrilled to bring the Plum Market experience to Palm Beach Gardens and welcome guests from across Palm Beach County," wrote Matt Jonna
Plum Market’s chief executive officer and co-founder
demonstrates our dedication to supporting the community and providing the freshest
Plum Market chose to open a store in Palm Beach Gardens because it has received “a lot of organic interest” from the area
Its build-out will cost about $10 million and construction will begin in a couple of weeks
The nearby area has a wealth of health-food grocers
The new Plum Market will sit about 2 miles away from a Whole Foods Market
about 3 miles away from a Fresh Market and about 6 miles away from Sprouts Farmers Market
A Trader Joe’s is also less than a one-half mile away
There also are three Publix supermarkets within 3 miles of the Plum site
Not only is northern Palm Beach County welcoming new grocers
but longtime grocers there are upgrading as well
The Publix at the Promenade Plaza in Palm Beach Gardens has been closed for more than a year while it was torn down and rebuilt with a modern look
wider aisles and a larger selection of products
What sets Plum Market apart is its focus on goods from local sources
Plum Market was founded by brothers Matt and Marc Jonna
They are third-generation grocers who grew up working in their family’s stores which sold specialty products and wine
They worked for the Whole Foods national operations team before leaving to start Plum Market in 2006
Plum Market has a focus on selling organic goods
but it does not exclusively sell organic products
"Plum Market's decision to grow in Palm Beach Gardens reinforces the strength of this market and the draw of our neighborhood centers," wrote Patrick McKinley
"Their high-quality offerings and community-first mindset are exactly what we look for in an operator and what our customers expect from a Regency property."

PALM BEACH GARDENS — PGA Marina, which has for more than 50 years been a landmark along PGA Boulevard and the Intracoastal Waterway
has been demolished as part of an $80 million overhaul
modern one with more space for boat storage and 57 more dry slips for boats
It plans to reopen in December 2026 and will be the flagship location of Port 32 Marinas

when they will start building a steel structure to hold dry marina slips
“The size of boats has grown so much,” Schell said
This brand is being built for the boat of the next 30 years
What happened to PGA Marina? The marina will house boats up to 60 feet long in a building that can withstand Category 5 storm winds
It will reopen with a total of 471 boat slips
The wet slips are already open at the marina
They will remain open through construction
Crews will soon build three blue-and-white buildings at the site
37 feet taller than the building that was on the property
The two 83-foot-tall buildings will be used for boat storage
smaller 5,000-square-foot building will be a ship’s store with fueling stations for boats that can dock directly at the building
The project also changes the current path that takes customers at the River House

Mayor Marcie Tinsley said the Palm Beach Gardens area needs more boat storage
The marina will likely have the largest staff of all of Port 32’s marinas
Members will also have access to an app they can use to preorder cooler service
so their boat is ready to go before they get to it
“We really want to provide our clientele with a turnkey
friction-free way to enjoy time with their friends and family,” Schell said

“The city of Palm Beach Gardens is very stringent
It was a case of serendipity when John Jeffry and Elizabeth Louis first saw historic Villa Giardino — and just as importantly
its remarkable gardens — near Worth Avenue in Palm Beach
“We stumbled upon it,” Jeffry Louis recalls
and the couple was not looking to buy a home in Palm Beach
recalling how a longtime friend from Chicago
took her to the property at 341 Peruvian Ave.
Once Elizabeth stood before the villa’s open door and the 1920s-era residence and gardens unfolded before her
Her husband soon learned about the house from his wife
“I was in London and Elizabeth sent me a message that this place was incredible
with a picture (of the gardens from the second-floor loggia)
but that it was too big a project for us,” Jeffry says
the property’s appeal proved too potent for him: “I wrote back
They did just that — and were soon putting into place plans to restore the house and gardens
Four years later, the Louises and their landscape architect, Mario Nievera of Nievera Williams Design, accepted the Palm Beach Preservation Foundation’s annual Lesly S. Smith Landscape Award
The early-evening ceremony in late March took place in the main section of Villa Giardino’s Italianate garden
which is hidden behind a tall wall that fronts Peruvian Avenue
The wall is punctuated by a picturesque metalwork gate set into a Palladian-style brick-accented arch
“I knew the house — everyone does,” Nievera says
“It’s apparently the most photographed façade in Palm Beach
I see someone there taking a photo or a photoshoot happening.”
and when I was invited inside to meet Elizabeth
‘What would you do (to the gardens) if I hired you?’"
had a ready response even if it wouldn't prove quite accurate
“There were a lot of existing elements in the garden that I thought were worth keeping
so many that I thought we should just work around the elements and make improvements
“I thought I was talking myself out of a job
and I left — but Elizabeth thought that I gave the right answer.”
Jeffry acknowledges that Nievera had exactly the right idea from the get-go
“The most important thing we did are all the things we didn’t do,” says Jeffry
which owns the Palm Beach Daily News and The Palm Beach Post among its newspaper holdings
Elizabeth adds: “Mario has a sophisticated eye and he has a gentle touch
the town deemed the villa to be a historically significant building
a designation that signals that a house contributes to a neighborhood’s architectural character but doesn’t necessarily qualify for the more stringent “landmark” designation
The program for historically significant buildings offers qualifying homeowners who want to renovate more leeway from the town's strict zoning rules than if they were starting from scratch
The garden was originally developed in the late 1920s by Manhattan antiques dealer Ohan Berberyan
he built a showroom with a second-floor apartment
The building featured reassembled architectural elements imported from Venice
Berberyan opened the landscape to the public in the 1930s as a tourist attraction named Berberyan Gardens
the building was turned into a single-family residence
with an addition in the 1960s attributed to Belford Shoumate
The garden comprises more than half of the property
The main section of the landscape — with its formal
geometric-patterned parterre garden in the Italian style — stretches east of the house
A set of broad brick steps leads up to the pool area
which is sheltered by the two wings of the house
Throughout the landscape are antique statues and garden ornaments originally imported by Berberyan
The landscape was showing its age when Nievera first saw it
“Some little areas were ignored and (had been) left alone
But it was not in great condition,” Nievera explains
“The (domed) podocarpus hedges surrounding the parterre garden were beautiful
as well as gardenias and bougainvillea trees near the pool and the bougainvillea covering the front façade
stonework and brickwork everywhere,” he adds
Nievera immediately noticed a troubling challenge
“You couldn’t get out to the garden from the old villa,” Nievera explains
“It was an awkward situation that had to be remedied.”
Plans for the landscape project coincided with a renovation and restoration project of the house
led by Palm Beach architect Richard Sammons of Fairfax
Sammons & Partners with Chris Glapinski serving as the project architect
Nievera worked with the two men as he envisioned the hardscape elements
Sammons describes the steps taken to overcome the lack of access to the garden from the living room in the original part of the house
The building was “four feet below grade on the north side
you felt like you were in a racquetball court,” Sammons says
An excavation project “allowed the room to be opened up to (a new) sunken terrace
And we negotiated the grade against the side of the pool that allowed for a (waterfall-style) fountain to announce the pool’s presence,” Sammons says
created a more cohesive link between the home’s interior and exterior
you see the garden and you are connected to it
And you can walk out from the old villa into the gardens
which you couldn’t do before,” Nievera says
The waterfall fountain was an idea that originated with Elizabeth
who was inspired by one she had seen in Saint-Jean-Cap-Ferrat in southeastern France

There was at least one other serendipitous moment: Elizabeth discovered a rusty pipe hidden within some hedges

WEST PALM BEACH — Two weeks after a federal judge told the son of a wealthy socialite and business tycoon that his family’s money was not a "Get Out of Jail Free" card
a move by the White House suggested otherwise
President Donald Trump pardoned Paul Walczak, a Palm Beach Gardens health care executive convicted of tax evasion for siphoning more than $10.9 million in payroll taxes from the paychecks of doctors and nurses
Prosecutors said he used the money to finance a lavish lifestyle and luxury goods
District Judge Kenneth Marra said that letting Walczak walk free "reinforces the perception that the rich get away with it and the poor go to prison."
The judge sentenced him to 18 months in prison and gave Walczak 90 days to turn himself in. Only 12 of those days elapsed before Trump signed the private pardon.
Walczak is the son of Betsy Fago, a longtime Republican donor who once hosted a fundraiser at her Jupiter mansion where attendees circulated the stolen diary of Joe Biden's daughter
Walczak controlled a network of health care companies including NuVista
FW Healthcare Investors and PHP Employment Services
PHPES employed more than 600 people and managed a payroll of more than $6 million per quarter
Walczak withheld more than $7.4 million in trust-fund taxes — Social Security
Medicare and federal income taxes — from health care employees in the network between 2016 and 2019
He also failed to pay $3.5 million in employer-side payroll taxes
bringing the total tax loss to more than $10.9 million
Attorney Brian Flanagan said that rather than directing the money to the IRS
Walczak used it to sustain a life of luxury
He bought a yacht that cost more than $2 million
transferred hundreds of thousands to himself to supplement his $360,000 salary
To sidestep the IRS's penalties assessed against him
he opened a new business in his daughter's name and continued to fund his personal expenses from those business accounts
Walczak took $10 million in taxes from the government "simply because he wasn't getting rich enough."

Officers subsequently put Avernia in the backseat while she grew more violent kicking one officer in the leg
One officer was cut deeply on the leg from the altercation
according to the criminal probable cause affidavit
A search revealed Avernia had a pair of garden shears that likely cut the shrubs

and wished to prosecute for the damage to the landscaping totaling $1,000
Officers found probable cause to book Avernia on two counts of battery on law enforcement

(CBS12) — A man's hit-and-run hoax fell flat at Palm Beach Gardens HOA meeting when witnesses started talking and his evidence betrayed him
officers with the Palm Beach Gardens Police Department (PBPD) were dispatched to a report of an assault with a car following an HOA meeting at a townhome off Miramar Lane
Officers say they made contact with the caller
PBPD also noted that he had a very small cut

Feldman told police that he attended a meeting to discuss removing board members of the HOA and appointing new personnel when tensions rose
He said another board member's gray Subaru struck him with her in the passenger seat
he told officers that he was standing in the parking lot when the Subaru drove into him
He said the car accelerated causing him to fall onto the hood before stopping short and causing him to fall onto the ground before fleeing the scene
his cell phone video told a different story
The police report explained Feldman recorded the interaction on his cell phone and that the accusation was not backed by evidence from his recording
One neighbor told authorities that Feldman had been provoking the board member in the Subaru and other HOA board members
She said that when the woman in the Subaru attempted to leave
Feldman stepped in front of the vehicle and would not let the car pass
The witness said the car came up slowly to get Feldman out of the roadway when he jumped on the hood
the vehicle sped forward and stopped causing him to fall
The neighbor also mentioned that Feldman was not confined to that area and could have easily moved out of the way
One neighbor and witness said Feldman has been a continuous instigator of problems within the community
They told police that Feldman was part of an unsanctioned HOA member meeting to remove board members and was upset when people were trying to leave at its conclusion
The board member in the Subaru declined to cooperate with police
advising them that her blood was too high to provide a statement
After taking statements from all parties and witnesses
PBPD found probable cause to arrest Feldman with the false report of a crime

PALM BEACH GARDENS — A Palm Beach Gardens City Council race has become a volley of vitriol in the days ahead of Tuesday’s election
John Kemp and Chuck Millar are running to fill the seat held by Carl Woods

A mailer Millar sent to registered voters in February said Kemp was not "involved

which included a 2018 incident when a woman accused Millar of stalking her
Kemp denied having any role in the posting of the website

Howell L. Watkins Middle School in Palm Beach Gardens held its first-ever "Gentlemen's Day" on April 17
bringing in mentors from a variety of fields to give advice and encouragement to male students
The event — the brainchild of Watkins Principal Presley Charles — was planned to give young men "real talk" about the pitfalls of following the crowd
being the class clown and valuing "cool" over classwork
"Today is intentional," Charles told his students
The roughly 75 students participating in the event gathered in rows in an assembly area
They wore matching black and white T-shirts noting the day and carried backpacks inscribed with the words: "1st Annual Gentlemen's Day
Gentlemen's Day was something of a full circle moment for Charles
who noted that he grew up in Pompano Beach as the son of Haitian immigrants
"I didn't know how to read until I was 8 years old," Charles said
But being able to be self-motivated through mentors like we're (hosting) today has gotten me to the position where I was able to get a doctorate degree
and I'm a principal of one of the best middle schools in Palm Beach County."
Watkins' student body is majority-minority
and most of the roughly 75 students who participated in Gentlemen's Day were Black
a radio show host and an internet brand ambassador — stood in a line at the students' back
The mentors recalled their own middle school years as times when they wanted to fit in and didn't always listen to the adults in their lives
They urged the boys to believe in themselves even if stereotypes and popular culture often portray them in a negative light
a motivational speaker who has worked with students across the country
it is my absolute pleasure to have this opportunity to speak to you," he told the boys
"We're living in a time where people think people who look like you aren't capable
Bryant then proceeded to relay to the boys the example of a group of students he mentored in Chicago who graduated from high school with more than $1 million in college scholarships
He contrasted their example with a group of incarcerated young men he worked with in Tennessee
Bryant asked the boys for reasons that some students end up graduating from high school with college scholarships and others end up incarcerated

Jamael Stewart, director of the Community Redevelopment Agency in Riviera Beach
He reiterated Bryant's comments about surrounding yourself with the right people — and culling from your circle those who would lead you astray
"You've got to decrease your circle in order for you to increase your worth," Stewart said
"There are two buckets where people will be in: Either they'll be an asset or a liability
You've got to put people in your life in those buckets."
boys told at Palm Beach Gardens school programStewart warned the boys that it won't always be easy to move on from those who aren't going in the right direction
you're going to recognize some of those people you put in the liability bucket may be family members," he said
"I have some family that I don't go around
Stewart talked to the boys about conflict avoidance even in instances when they feel challenged or disrespected
said much of what Stewart said resonated with him
particularly the message about surrounding yourself with successful people and avoiding conflict
"He said walking away dosn't mean that you're scared," Wingate said
Some of what Timothy heard is a repeat of what he hears from his father
He talked to the students about financial literacy and having a career in finance
"I can show young Black men that they can have a career in finance," he said of his remarks
'I didn't know you could own your own accounting firm and you can employ people.' "
While some of the boys weren't certain yet what they wanted to do with their lives
that isn't the case with 11-year old Julien Roy
Air Force officer and NASA astronaut who has been on two space missions
"He went to Embry-Riddle (Aeronautical University)
and that's where I'm going to go," Julien said
"I really want to become an astronaut and explore the boundaries of space."
Julien's dreams are precisely the point of Gentlemen's Day

" And then the second thing is that if something unfortunate like this actually does happen that you’re taking the time to be open and communicative as much as you can.”
Illustrated Properties Realtor Justin Platt said although the news is scary to hear
he is also grateful for the swift action of the district
