Several psychologists testified that Brandon no longer meets the criteria for commitment at Florida State Hospital His treatment team at the hospital recommended his release to a secure treatment facility that will be more secure than where he is currently at Florida State Hospital in Chattahootchee Brandon Aydelott, who was found not guilty by reason of insanity for brutally killing his mother, 48-year-old Sharon Aydelott, in the doorway of her home on Christmas Eve of 2013, is being released from Florida State Hospital to the Apalachee Center “Based on all the testimony that's been presented as well as the evidence in the form of reports I do find that Mister Aydelott no longer meets the criteria for involuntary commitment,” Drake ruled I find that it is appropriate to grant conditional release to the Apalachee Center the testimony was very clear from all of the doctors that he should be released to a locked facility and therefore I agree with the state attorney's office that the conditional release plan needs to be tightened.” Aydelott’s treatment plan called for him to be placed in a part of the facility that was unlocked up to 14 hours a day Drake changed the plan to say Brandon must stay in a secure facility that is on lockdown 24/7 and he will not be permitted to move from the secure building without a court order Why Brandon Aydelott's last hearing: Doctors say mentally ill Gulf Breeze man who killed mom at 17 is better. What happens now. Brandon Aydelott was 17 years old when he attacked his mother, popular Holley-Navarre Middle School teacher Sharon Aydelott He confessed to the Christmas Eve 2013 slaying telling investigators that there had been no argument with his mother prior to the attack but that he killed her without warning because he heard voices that told him to do it Aydelott was later diagnosed with schizophrenia. When he was found competent to stand trial in 2016, Brandon Aydelott was found not guilty by reason of insanity for her murder He was remanded into the custody of the Department of Children and Families and sent to Florida State Hospital in Chattahoochee for treatment Drake began by acknowledging Sharon Aydelott’s horrific death at the hands of her own son and the toll that has taken on her family “The fear and suffering that she must have experienced is unimaginable as well as recognizing that her death would be at the hands of her own son,” said Drake “Her death has profoundly affected her friends and family the three psychologists who testified about Aydelott’s sanity said he no longer shows active symptoms of psychosis has been cooperative with his treatment team and understands that he will need to take anti-psychotic medications among other medicines for the rest of his life all agreed if he were to stop taking his medications he could potentially become violent and without the availability of the secure treatment facility and program offered at Apalachee Center they might reconsider their opinion to release him from Florida State Hospital “I'd like to reiterate that my opinion about his not meeting criteria is within the context of the next step being a structured residential program,” said Dr a psychologist at Florida State Hospital who treated Brandon “If that were not in place or on the table My opinion doesn't mean he's ready for stepping out to any other kind of setting It's contingent on being in the context of a structured seven-day-a-week monitored residential setting.” While doctors agree Brandon has not shown signs of active psychosis since around 2018 they did say he was caught with a boxcutter in 2021 The item is considered “contraband,” and Brandon told staff he took it and hid it so he could use it to “defend himself” from other residents at Florida State Hospital Staff acknowledged fights do sometimes occur between residents testified during the hearing that she loved her nephew but did not want him to ever be released from Florida State Hospital She recounted “concerning” statements he made to her when she visited him at the facility for several years before the visits stopped around 2019 Early on in his treatment at Florida State Hospital Brandon requested that Hill be his “personal representative” and help him with his care team It took three years before he was found competent to stand trial “And he has told me he's not through killing my family He's told me that people with brown eyes are dangerous Only blue-eyed people are the ones on his side He killed my sister when his life was charmed.” Elizabeth Aydelott was only 10 years old when her brother killed her mother She blames his mental illness for what happened and asked the court to release him into the step down program because he “deserves to enjoy things he once used to.” He has a life that he wants to live,” Elizabeth Aydelott read from a prepared statement to the judge Sharon Aydelott’s sisters were disappointed The court will continue to receive reports about his progress every six months but at least the judge did acknowledge how heinous it was,” said Hill “I want people to remember because the reason for why he is here has been so sanitized and I was afraid that was going to get lost The people who are saying he’s not a threat I wonder if they’d be all right if he comes live next door to them?” Aydelott is currently being held in the Santa Rosa County Jail The court ruled he would be taken back to Florida State Hospital where he will stay and remain in the custody and care of the Department of Children and Families until a bed opens for him at the Apalachee Center It's hard to miss the Expo Center on the Wisconsin State Fair Grounds Whether you go inside to get a quick break from the heat or to shop for some of the items being sold you're likely to see artwork hanging on the walls 15-year-old Sharon Hill painted one of those portraits and won this year's "Positively Portrait" award at the State Fair She told TMJ4's Symone Woolridge she never expected to take home the prize Her work is one of 306 pieces you can see hanging around the Expo Center you can see Sharon's painting and other creative pieces Watch: Teen wins art award at Wisconsin State Fair Sharon says she just started painting a couple of years ago She says she picked up the hobby during the pandemic "This is my first time doing something like this," Sharon says "So I'm excited to connect with the community and put my work out there Her next goal is to create murals and really get her work out there Stream local news and weather 24/7 by searching for “TMJ4” on your device Available for download on Roku, Apple TV, Amazon Fire TV, and more. whether the use of deadly force is a last resort; [and] the danger to innocent bystanders,” the report said The directive goes on to prohibit Sharon Hill officers from firing weapons when an innocent person could be injured “It is not the purpose of the Investigation to render a conclusion about the liability or culpability of any party under a criminal or civil law standard of proof the purpose of the Investigation was to assess the comprehensiveness of the Department’s existing policies,” the report said Former Sharon Hill police officers Devon Smith and Sean Dolan currently face 12 criminal counts each of manslaughter and reckless endangerment Lawyers for the three former police officers made a motion Monday to have the manslaughter charges dismissed Both sides are currently submitting written arguments to the courts and the next hearing is scheduled for Sept Never miss a moment with the WHYY Listen App and dive into podcasts from both local and national sources Delaware County lawmakers sent a letter to Pennsylvania Attorney General Dave Sunday asking him to “leave no stone unturned in holding” Crozer Health’s owner accountable Michelle Zajko’s denial was part of a 20-page handwritten “Open Letter to the World” her attorney provided to The Associated Press on Tuesday Chester Township police were notified on January 14 of a suspected child abuse case at Chester Community Charter School The independent investigation into the borough’s police procedures was completed in June but the report might not be released to the public until the end of July Castor said that this is a difficult case to litigate because the prosecution can’t conclusively determine which officer fired the fatal round “The criminal law punishes people for bad conduct If you are unable to determine whose bad conduct caused Fanta Bility’s death it becomes difficult for the prosecutor to convince a court that the criminal law is the appropriate forum,” Castor said As a former Montgomery County District Attorney Castor believes that the criminal case and the civil case do not necessarily complement each other His logic is that the more “liable” the former officers are the less it is the borough’s fault for providing proper use of force training he reiterated that the Bility family is more concerned with justice than anything else “The more serious charges going forward make the civil case harder and then they will worry about civil damages,” Castor said An independent investigation conducted by the law firm Fox-Rothschild LLP into the Sharon Hill Police Department procedures following the shooting has been completed and was submitted to the borough in June While the report is supposed to be released by the end of the week, Castor questioned why the borough would sit on the report for nearly two months without immediately sharing it with the public or the family “But if the report says that the borough failed to make certain that the officers understood use-of-force protocols and failed to test that they knew that and failed to keep their skills under simulated conditions sharp, that will mean that the borough is in deep trouble civilly as long as intentional criminal conduct is not found in the criminal court,” Castor said. Pointing to the possibility of appeals in both cases he said it will likely take a long time before any improvements to the lives of the family and surviving victims will happen
