A 57-year-old Terrytown woman sentenced last August to a mandatory minimum prison term of three years up to five has lost an appeal of her convictions in the case
Tina Sanchez claimed the Scotts Bluff County District Court erred by rejecting a motion to suppress evidence from a 2023 traffic stop
where nearly 11 grams of suspected methamphetamine
leading to charges of possession with intent to distribute and no drug tax stamp
claimed the driver’s failure to signal a turn from a private parking lot onto a public street did not provide the probable cause needed for the stop
but the Nebraska Court of Appeals disagreed
She had also claimed the stop was a pre-text by officers wanting to arrest the occupants for drug possession
but the intermediate court cited case law that ‘as long as a traffic violation occurred
any purported ulterior motive for the stop was irrelevant.’

The Jefferson Parish Sheriff’s Office investigates the scene where two people were fatally shot during a sting in the parking lot of an IHOP in Terrytown in 2019

reversed into the vehicle while trying to flee from detectives on March 27

Family members of people killed by Jefferson Parish Sheriff's Office deputies protested against police brutality and the deaths of several men during encounters with deputies
They also demanded the Jefferson Parish Sheriff's Office begin using body-worn cameras for deputies
Five years after Chris Joseph and Daviri Robertson were shot and killed by two Jefferson Parish Sheriff's Office narcotics detectives during a drug sting in the parking lot of a Terrytown IHOP
Jefferson Parish District Attorney Paul Connick announced Monday that his office will not seek criminal charges against the deputies
"In light of the evidence reviewed in this matter, the State cannot prove beyond a reasonable doubt that the actions of the detectives rise to the level of criminal conduct," Connick said in a statement that accompanied his office's final report on the investigation.
The report concluded there was no evidence to suggest that detectives violated the law
used excessive force or acted outside of the Sheriff's Office's standard operating procedures
Joseph, 38, and Robertson, 39, were fatally shot on the night of March 27, 2019, outside the IHOP at 151 West Bank Expressway
Narcotics detectives with the sheriff's office used an informant to arrange a deal to buy heroin from Joseph at the restaurant
They were already in place and conducting surveillance when Joseph arrived and parked his silver Dodge Charger out front with Robertson in the passenger seat about 10:20 p.m
The plainclothes detectives used unmarked pickup trucks to box in Joseph
pulling up beside the driver’s side door and directly behind Joseph’s car
got out of the unmarked trucks and identified themselves as law enforcement
They ordered Joseph and Roberston out of the car
But Joseph put the vehicle in reverse and accelerated backward toward Jones
who had positioned himself behind the Charger
who were on the driver's side of Joseph's car
opened fire “to stop the vehicle from striking Detective Jones,” the report said
Joseph suffered five gunshot wounds to his chest
Robertson was shot in the neck and succumbed to his injuries at a hospital
Joseph’s car crashed into the detective’s truck behind it
clipping Jones’ leg as he jumped out of the way
Doubleday was critically injured by a single gunshot wound to his right lower abdomen
an accidental shot from one of the deputies
The report noted that Joseph’s car hit the detective’s pickup with such force that the two were “stuck together” and had to be separated
The sheriff’s office conducted its own investigation and determined the shootings were justified based on the totality of the evidence
Officials then turned the case over to the district attorney’s office for a review
which focused on the actions of Wibble and Carmouche
Connick's office consulted two use-of-force experts
a retired sheriff and police training consultant
Benny Griffin with the Jefferson Parish Sheriff's Office
Griffin served as a field training officer for the sheriff’s office and is a firearms instructor for the department as well as the commander of the SWAT team
He determined Joseph and Robertson's shootings were reasonable and justified
“Griffin concluded that Detectives Wibble and Carmouche were left with no choice but to respond with deadly force due to the driver (Joseph) ignoring the officer’s commanders and endangering all parties involved,” the report said
Louis was acquitted of manslaughter
while Hughes was found guilty of negligent homicide
Katsaris agreed with Griffin that the narcotics officers properly used tactics and procedures that were recognized and commonly employed by law enforcement agencies
Katsaris called Wibble and Carmouche’s split-second decision to use deadly force "appropriate
justified and necessary" based on the circumstances and the immediate threat to Jones
Joseph’s decision to reverse also put Robertson in harm’s way and in the line of fire
Neither Carmouche nor Wibble had any prior complaints
according to the district attorney’s office
Connick's office said the detectives "used necessary and appropriate force."
The DA's office noted that the FBI also reviewed the circumstances surrounding Joseph and Robertson's deaths but didn't find enough evidence to forward the matter to the U.S
