Villa Hills Mayor Heather Jansen started a discussion  at the monthly Kenton County Mayors’ meeting about cell phone coverage in her city
“and so it’s on the top of the hill in Villa Hills over towards the west
next to the three towers that are mounted over by IHeart radio
I’ve got a couple residents over closer to there who are saying that they are getting a lot of interference.”
She was wondering if anyone had the experience or had discovered solutions to the problem
She said she knew that a building around Target in Florence was complaining of some interference being next to Turfway Park
“Unfortunately we have the issue where we have River Ridge which is next to it
“Then someone told me that River Ridge has some type of shield that keeps the interference down from radio towers.”

“Yes we did a walk through about three or four weeks ago with your police chief and fire chief,” he said
“And I think what he is referencing is they put a film on the windows to reduce that radio signal from coming in
And that’s impacted for years that entire area
Some people would pick their phones up and you could hear the radio playing over their phones
In one case the signal was so strong I think someone’s downspouts were actually picking it up and you could actually hear the radio.”
Hensley said he thinks the solution is to put boosters in that building
They talked to some of the cell phone providers
but the problem is that they would have to have boosters for each cell phone company
Hensley said they had someone with them at the time evaluating the phone signal
“Outside the building radio signal is fantastic,” he explained
You go a little bit further into the building
certainly one level down and the signal is virtually nonexistent
Hensley said the new building codes through PDS require any new construction to be evaluated for multi-directional reception amplifiers
and boosters are put in as part of the construction
and Hensley said it seemed like the  signal from the outside was penetrating through the walls at first
It seems like something has changed in that area,” said Hensley
we’re dealing with something similar in our justice center as well
We are actually looking at bringing in a consultant to evaluate that because we are having similar problems
Unfortunately there may be a cost component for the school at some point to put in the equipment necessary to amplify the radio signal for first responders
we drive down Amsterdam road  and hit just absolutely dead areas.”
He said it is a different matter when it is a school area
Jansen noted that there is an old tower in the area
and she wondered if that tower could be regenerated
Hensley said that there are nondescript towers in her area already and they are not helping
 He said it is a small enough area that they can’t generate enough interest to be able to fix the problem
“With the trend of moving away from land lines
we have got a number of people who are sitting at the point where it could get very problematic,” said Jansen
Hensley said they are aware of the problem
and they are going to do everything they can to help with the problem
“It’s not going unnoticed,” he assured her
The subject of the new water tower that will be installed in Taylor Mill on Pride Parkway by the Allison-Rose Funeral Home came up
the Northern Kentucky Water District petitioned the state to put a 500,000 gallon elevated storage tank in Taylor Mill
The tank that is there is inadequate for the area
talked about the fact that the water tower is nearing reality
She said the water district has been very slightly increasing the water pressure
and said the tower will definitely benefit the community with better water pressure
Some jokes went on about if they were going to name the tower the Dan Bell tower
and Mayor Bell said he did ask if they could put Taylored with Pride on the tower
or at least Taylor Mill so that people would know where the tower was located
but it will be officially  labeled the Northern Kentucky Water District
“We plan to have the groundbreaking within the next week or so,” said Rechtin
The new tank is scheduled for completion in about 17 months
and that time starts as soon as the ground is broken

Another mailbox is out of commission and another homeowner has to buy a replacement after yet another car veered off Buttermilk Pike Tuesday morning
which shows a car driving east up the inclined stretch of road between Mary Street and Meadow Drive when it appears to hit the curb and then plow through a mailbox
leaving the knocked-over mailbox — and the car's front bumper — behind
"I think that's our first bumper that we've had," neighbor Leslie Scott said
"Before I saw the video (my neighbor) was standing out in the driveway with this bumper
Scott said mailboxes are common casualties on her block
Her neighbor will now be replacing her second in as many months
"I posted on Facebook when this video came out: 'What is it about our little stretch of Buttermilk like this?'" Scott said
Scott first spoke with us in April after a doorbell camera recorded a <a class="Link" href="https://www.wcpo.com/news/local-news/kenton-county/villa-hills/theyve-taken-out-a-mailbox-there-there-there-speeding-cars-plague-quaint-villa-hills-neighborhood" data-cms-ai="0">car catching a curb, skipping down the street and driving through front yards before crashing into a tree.</a>
At that time Scott blamed the crash on speeding
which she stressed was her main concern along the thoroughfare
Villa Hills Police Chief Matthew Hall said while speeding was a factor in the April incident
the teen driver had fallen asleep at the wheel
likely causing him to step harder on the gas
Hall assured he would look into concerns of excessive speeding down the stretch of Buttermilk Pike by running a speed study
We checked back in with Hall on Thursday when he confirmed his department did collect data
Two days following our initial conversation
Hall said a speed radar known as Kustom Signals Stealth Stat II Covert Traffic Data Collector was deployed
It surveyed speeds between Sunglow Street and Meadowview Drive for 11 days
"It has been found that this device is the most accurate way of collecting information without alerting drivers and motorists to its presence
we want to remove any factors that could skew the results of the data and this device does this effectively," Hall said in an email
A summary of the study determined that the average speed of vehicles in along the stretch of Buttermilk Pike was 32 MPH
The 85th percentile speed for both directions of travel was determined to be 37 miles per hour
The posted speed limit on the road is 35 mph
it does not find a persistent and systemic speed issue
This is not to say that speeding does not occur on this stretch of roadway or for any roadway for that matter," Hall said
"The Villa Hills Police Department continues to monitor that stretch of roadway and extra patrols the area for violations." 
Since April 23 — the day our original story was published —  Hall said his officers issued six citations with a total of 11 charges and one arrest on Buttermilk Pike
The charges vary from equipment violations
VHPD issued four warnings during this time frame as well
Hall also weighed in on Tuesday's incident
The driver pulled off a side road and called in a report following the crash
"We will continue to monitor the complaints on the roadway and take enforcement actions where necessary with the continued hope to resolve the issues and concerns of our residents," Hall said
why do neighbors continue to keep a tally of mailbox takedowns
We posted on Facebook asking that question
It didn't take long for neighbors and other area residents to offer another possible reason
Some suggested the road itself is causing problems
"Seems to me the real issue is how narrow that eastbound lane of Buttermilk is in that area
If I'm staying centered in my lane between Mary Street and Meadow View Drive I am very close to that giant curb and those mailboxes," one person wrote
"I don’t think the “running off the road” situation started happening more frequently until they redid the road and added the high curbs
The road doesn’t seem to be as wide as it used to be prior to that
I’d be curious if they made it less wide and drivers are hitting the high curb and losing control of their cars," another person wrote
"You should also see why they didn’t address not straightening the road when they resurfaced and put in the new curbs and sidewalks
Actually made it harder to make the turns at legal speeds
It is as if they designed the road for street-legal golf carts," read another comment
We brought these concerns to City Administrator Craig Bohman
He pointed to a 2019 road construction project
"Buttermilk Pike predates the city’s founding in 1962
It was a county road surrounded by farms and did not have any curbs
Villa Hills grew up around it," Bohman said in an email
"The road was transferred to the City by the County in the early 2000s
Buttermilk was replaced using a combination of city and state/federal grant funds in 2019
Curbs and drainage were added to address flooding primarily at the Mary Street intersection
however the existing road alignment was used to keep from moving the road closer to existing homes
The Kentucky Transportation Cabinet signed off on the road design and required the box curbs."
Bohman said his understanding is that recent issues with vehicles leaving the roadway along the short stretch of Buttermilk Pike were due to medical issues
the road has curves and elevation changes that drivers need to be mindful of when traveling between Collins and Rogers Roads
"The speed data we have suggests the current 35 MPH speed limit is appropriate
Given that the road sees about 3,300 cars per day these incidents
are infrequent compared to the number of cars that safely traverse Buttermilk every day," Bohman said
she said she's not as concerned with cars speeding down the road
But she won't rule out another felled mailbox in the near future
"I said we really should get mailbox insurance," said Scott

— Residents of a northern Kentucky neighborhood said radio signals from nearby towers are causing all kinds of issues
causing some to worry about the safety of their living situation
“It’s hard to justify a million-dollar home when you can’t utilize everything on a day-to-day basis,” said Jordan Niernberger
resident of the Sanctuary Village in Villa Hills.&nbsp;
“It just doesn’t make it very enjoyable to live back here when you have such a nice neighborhood and such a nice city,&quot; who added cell phone service &quot;has always been really spotty here.&quot;&nbsp;
said there are pockets of no cell coverage throughout the city because of a lack of towers
But the towers' proximity to Sanctuary Village is what residents said are causing other issues.&nbsp;
“You can’t predict when it’s going to happen
and it can just affect your day-to-day life,” Niernberger said
and the radio signals are showing up in and around people’s homes in unwanted ways
“A lot of the houses through this street right here had issues
where our smoke detectors were going off constantly
washers and dryers weren’t working,&quot; Cobb said
&quot;Anything that had a small voltage wire wouldn’t work
Some of them will actually pick up the radio signal through their computer headsets.”
“If our vehicle is parked in the garage or right outside the garage
there’s some type of interference that is basically causing it to try to open the trunk or try to start the car,&quot; he said
Cobb even shared a video her husband took of radio frequency coming in through natural gas lines connected to their stove
“If a fire happens and someone can’t trust their alarms
or if an emergency happens and you need to call 911 and your internet’s not working and your cell phone reception’s not working because of these issues
but our neighbors as well,” Niernberger said
&quot;How are you supposed to get ahold of anybody or what happens in case of an emergency?” Cobb added.&nbsp;
Jansen said the city is aware of the issue
“Proximity is certainly going to be a hard thing to fight,” she said
but we’ve certainly been reaching out to everybody we possibly can to see if this can get fixed.”
Spectrum News 1 reached out to iHeart for comment to see if anything can be done and has not yet received a response

roads in Northern Kentucky have been closed due to flooding and other hazards
Here's a breakdown of what roads were closed as of 8:40 a.m.
according to the Kentucky Transportation Cabinet:
Transportation officials are urging motorists to never drive through a flooded roadway
"There have been several reports of motorists driving past barricades/barrels on to flooded roadways," KTYC said in a release
the crews will begin constructing ditches to help with drainage
"The hope is that we can reopen the road later today," Ryle said
"We want to stress that this closure is a short-term closure."
Much of Greater Cincinnati is under a flood watch until Sunday
with the heaviest rainfall expected Saturday and Saturday night
streams and other low-lying and flood-prone locations
as well as part of Clermont County in Ohio
were placed under a flood warning until noon
Areas that may experience flooding are Cincinnati
The Ohio River at Cincinnati could see minor to moderate flooding, according to a water gauge forecast. Water levels could reach as high as <a href=https://water.noaa.gov/gauges/CCNO1>56 feet by Sunday night</a>
causing some inundation of roads and structures near the river
<a href="https://forecast.weather.gov/product.php?site=ILN&issuedby=ILN&product=AFD&format=CI&version=1&glossary=1&highlight=off">National Weather Service forecasters</a> also expect showers and thunderstorms throughout the weekend

The Elsmere Police Department is being criticized by some in the community for hiring a former deputy who fatally shot a 19-year-old woman a decade ago
Former Boone County deputy and Villa Hills police officer Tyler Brockman was sworn in on Monday
the police department announced on its Facebook page
“Please join the City of Elsmere in congratulating our newest Officer
Officer Brockman was sworn in by Mayor Lenhof this morning,” the post states
“Officer Brockman started his law enforcement career at the Boone County Sheriff’s Office from 2010-2019
From 2019-2024 Tyler worked at the Villa Hills Police Department
Tyler was promoted to the rank of Sergeant at Villa Hills
We are excited to welcome Tyler into the Elsmere family!”
Brockman was cleared of wrongdoing when he worked for the Boone County Sheriff’s Office in the April 2014 death of Samantha Ramsey
The sheriff's office in 2016 reached a $3.5 million settlement with Ramsey's family and passengers in the vehicle she was driving as she left a large outdoor party along the Ohio River in April 2014

The Elsmere police department’s Facebook post about his hiring has drawn more than 1,000 comments − many negative − and 554 shares so far
A “peaceful protest” is now scheduled for Sunday
according to a Facebook page about the event
Elsmere city officials and the police chief said Brockman “was fully vetted through the department’s normal hiring process
including a complete background check and a stringent review of his personnel file," in a statement
“The city is aware of Officer Brockman’s involvement in the 2014 incident involving the death of Samantha Ramsey
The incident was thoroughly investigated and a Boone County grand jury declined to issue an indictment after being presented evidence by a special prosecutor
He has continued to work in law enforcement over the past decade
“Officer Brockman is an experienced and highly-trained officer who is certified by the Kentucky Law Enforcement Council and holds bachelor’s and master’s degrees in Criminal Justice
He is dedicated to protecting the community
serving the public and will be an asset to the Elsmere Police Department and the City of Elsmere."
A Boone County grand jury declined to indict Brockman after a special prosecutor presented evidence in the April 26
shooting as the deputy tried to break up a field party
Ramsey − who was under the influence of alcohol and marijuana
according to forensic reports − was trying to flee as the deputy knocked on her window to stop her to see if she was intoxicated
Brockman said she failed to listen to his commands to stop and began to speed off
so he jumped onto the hood of the car to avoid being pinned or run over
Brockman said he felt the car speeding up and thought he would be killed
He pulled out his gun and shot several times through the windshield killing Ramsey
who was a 2013 graduate of Covington Holmes High School and also worked at the time at a local preschool
Brockman was treated for his injuries at St

Residents in one Villa Hills neighborhood said they've had to replace them more than once after they were hit by speeding cars
Frustrated neighbors say the problem seems to have gotten worse lately and now they're looking for solutions to slow down traffic
"Our mailbox has been hit three times," Leslie Scott said
Scott has lived on the stretch of Buttermilk Pike
which runs west of the Collins Road intersection
She said she avoids letting her grandson play in her front yard
"I like to keep him on the front porch or out in the backyard so that I don't have to worry about him going too fast down the driveway and being too close to the street," she said
While a portion referred to as KY-371 is maintained by the Kentucky Transportation Cabinet
the portion that runs through Scott's neighborhood is maintained by the city and has a speed limit of 35 miles per hour
"I think the speeding has become worse since the new curbs and the new road went it," Scott said
"I mean the road is great — it's smoother and it looks nice — but people tend to speed more."
She pointed out black scuff marks scattered across the curbs
indicating the spots where car tires made impact
A car drove through them last week before crashing into a tree
Video recorded on two different doorbell cameras shows the moment the car
It's briefly sent airborne before skipping down the road
Hamilton spoke with WCPO a few days after the crash
pointing out the large branch still lying under his tree
"Thankfully (the driver) didn't hit the middle of the tree
otherwise he probably would have been dead stopped," Hamilton said
"To go airborne for like three to four seconds and then land almost 30 yards away from where he took off — he had to have been going extremely fast."
but Villa Hills Police Chief Matthew Hall said there's an unfortunate reason
The teen driver had fallen asleep at the wheel
Hamilton said in the two years since he moved into his home
he's witnessed cars hit several mailboxes and heard the sounds of cars accelerating through the curved hill
We're the first one that hasn't been taken out," he said
​"I'd say it's worse coming down the hill than up the hill
but there are still people that will still fly up the hill because
sitting in our living room we can hear people going
But according to Hall and City Administrator Craig Bohman
as far as they know speeding isn't a prominent issue along Buttermilk Pike
The city doesn't have the data to support that
there have been more than 1,000 traffic incidents down that stretch — 17 of them were crashes
That adds up to 1.6% of all recorded data in four years
officers have issued 31 traffic citations with a total of 38 charges
Bohman said if officers do pull cars over for speeding down Buttermilk Pike
There is nowhere safe to pull off on the two-lane road
so traffic stops would almost always occur at another location
City leaders said it breaks down to this: if residents are seeing cars speed down the road
"I haven't done anything to make it an issue to them
I haven't brought it to anyone's attention
"I think that if it was brought to their attention
After WCPO brought residents' concerns to the city
Bohman and Hall said the police department would run a traffic study on the road
utilizing radar technology to track speeds
If the results echo what Scott and Hamilton said
then steps will be taken to assess the area for the need for any traffic calming measures
"I think the need to put some sort of sign that says like
'slow down' like they have over by on Beechwood Road where it says if you're going over 25 it'll flash and say
"People that are going to have younger kids — younger kids don't understand
you need to not go too close to the street' and when someone comes 10 feet off the street and runs through people's yard
The family of a man fatally shot by police last year has dropped a <a href=https://www.cincinnati.com/story/news/local/northern-ky/2022/02/21/wrongful-death-suit-filed-against-nky-police-department-officers/6845882001/>wrongful death lawsuit</a> against two Villa Hills officers and their department
was shot by Villa Hills police during a February 2021 traffic stop on Interstate 75 after officers said he pulled out a gun
filed early this year in federal court in Covington
alleged Villa Hills police officers Sean Dooley and Jacob Bolton violated Lockaby's constitutional rights
overstepped their authority and used excessive force during the traffic stop
District Court for the Eastern District of Kentucky
the attorney representing the officers and Villa Hills
said there was no settlement reached between Lockaby's family and the city
He went on to describe the lawsuit as "frivolous."
"I've never seen a more justifiable use of force," Mando said
"The officers did what they were trained to do."
A month after the shooting, Kenton County Commonwealth's Attorney Rob Sanders said the <a href=https://www.cincinnati.com/story/news/local/northern-ky/2021/03/19/nky-officer-involved-shooting-justified-prosecutor-says-man-pointed-gun/4769575001/ target=_blank>two officers were justified in their use of deadly force</a>
He made his decision based on a review of a Kentucky State Police investigation
According to a letter Sanders sent to Villa Hills and KSP officials
dashboard camera video from Bolton's cruiser and body camera video from both officers captured the entire incident
in which Lockaby refused to follow Dooley's commands to step to the rear of the vehicle
Sanders said Bolton fired after he saw Lockaby point a gun at Dooley
Bolton reasonably perceived the need to use deadly force to prevent Dooley from being shot
Lockaby was not legally allowed to carry a gun due to a prior felony conviction
Court records show Lockaby pleaded guilty in 2014 in Allegheny County
Pennsylvania to a felony offense: possessing a firearm not to be carried without a license
Lockaby's family didn't dispute that he pulled a gun during the traffic stop
it wasn't needed for the officers to detain Lockaby as long as they did or demand that he exit his vehicle so they could search it
"There was no probable cause developed at any point
by either officer that Lockaby had committed any crimes prior to demanding Lockaby to exit the vehicle," the lawsuit reads
The lawsuit also alleged the city of Villa Hills and the Villa Hills Police Department failed to provide appropriate training to officers regarding traffic stops and use of force
the attorney representing Lockaby's family
has yet to respond to an email and phone call seeking comment on the suit's dismissal

VILLA HILLS – David and Darlene Barnes built their dream home a year ago and never thought they would open its doors to the public
But after hearing about the needs of the Children's Home of Northern Kentucky
the couple decided to show their custom-designed
16,000-square-foot home as a fundraiser for the nonprofit
and bedrooms furnished in authentic Asian and European decor
The home's varying styles stem from the Barnes' business and leisure travels to over 65 different countries
"The house is definitely a reflection of their life's work and their dreams," said Henry Vittetoe
After overhearing a conversation between Vittetoe and Rick Wurth
the retired couple became interested in the work of the nonprofit because their mothers were raised in the foster care system
"Our mothers were both orphans and Darlene lost her younger brother when he was very
"So it's little children in general and little boys in particular that have always touched our hearts."
"Naturally the builder wanted to show the home because it's very unique," David said
Only when the idea was floated that we should do it as a fundraiser for some worthy cause did we decide to open it."
Darlene said the home has attracted a lot of attention
there were rumors that the pool in the center of the home was a helicopter pad
"no one knew what it was and it was just a very big curiosity for a long
David estimated he and Darlene looked at hundreds of house layouts online before settling on a plan for their home
with its stately Mediterranean-style exterior and eclectic interior
was finished after six months of architectural planning and more than 13 months of building
"We have a lot interests and we incorporated those interests in various sections of the house," David said
"The key was to make it all work together."
Darlene's lifelong pottery hobby is reflected in her hand-crafted pieces displayed throughout the home

The home is featured in the May/June 2014 issue of Housetrends magazine
also had a hand in designing the home's security system

Last year's Halloween was particularly memorable for Darlene
And they were so excited and they wanted so bad to see the inside," Darlene recalled
"So we turned our fountain on and our lights
And when we opened the front doors they kept saying
'Will you adopt us?' and 'Can we come in?' And I loved it
I think it was more of a happiness for me actually to see their happy little faces."
the children's home has evolved from a traditional orphanage to a provider of care for abused and neglected children and children under state custody
"Dave and Darlene have built a beautiful house
but what I think is even more beautiful is the fact that they want to reach out and care to the children being served by Children's Home of Northern Kentucky," Wurth said
"Their heart and their spirit of concern makes the community even more beautiful."
Toebben stressed that the public should take advantage of the one-time opportunity to view the house
"We've built plenty of large estate homes in our 60 years
but rarely are they ever open to the public," he said
"A lot of people just would never consider opening a home of that size and caliber to the general public

(WKRC) - It’s been four months since a fire broke out at the Villa Hills Civic Club
Fire crews determined the cause to be a cigarette ember
left in an ashtray that blew into the wooden structure
The Villa Hills Civic Club has been part of the Villa Hills community since 1961 and pre-dates the city itself
leaders immediately said they would rebuild
and the city and the community rallied behind them
People started submitting pictures of memories inside the club and some even pitched in to help clean up debris
chairman of the Villa Hills Civic Club Rebuilding Committee
says the response from the community and the city has been heartwarming
“When you see something like this and you realize you&#x27;re not going to be able to replace something that kind of history and when people start coming up with these things you kind of go there&#x27;s a little bit of hope there for you,” Brown said
you use that to build momentum and gather more things and re-create whatever&#x27;s possible.”
The rebuilding committee just met with an architect to see some initial drawings of what a new building could look like
but the committee would like to expand on the size of the former building and make it something that will serve generations and generations

VILLA HILLS &ndash; A fire engulfed the Villa Hills Civic Club early Thursday and destroyed the building
Crews with the Crescent Springs-Villa Hills Fire Department were dispatched around 2:48 a.m
for a possible structure fire at 729 Rogers Road
Firefighters arrived on scene and discovered heavy fire coming from the rear and north sides of the building
adding windy conditions hampered firefighting efforts and caused the blaze to spread more rapidly
The fire was reported under control around 4:30 a.m.
The building is considered "a total loss," with damages totaling $320,000 and&nbsp;an additional $130,000 in contents
The president of the Villa Hills Civic Club, Mike Martin, was on scene Thursday morning. The private club was formed nearly 61 years ago, in May 1961, and now covers 23 acres in a beautiful country setting with fishing ponds, he told <a href=https://www.fox19.com/2022/02/17/fire-destroys-villa-hills-civic-club/ target=_blank>Enquirer media partner Fox19</a>
&ldquo;The object of this club shall be to advance and improve civic conditions and public welfare of the City of Villa Hills and neighboring areas," reads the <a href=https://villahills.wordpress.com/ target=_blank>civic club's constitution</a>
Officials said the investigation into the fire's cause is ongoing

The driver crashed into a fence in David Munson&#x27;s backyard
Munson said he was drawn to his window by the sound of sirens
&quot;I hear shouting in my backyard that sounded like &#x27;down&#x27; or &#x27;get down,&#x27;&quot; said Munson
handcuffed him and walked him out of my backyard through the fence,&quot; he said
A police dog caught up with the driver as he tried to run
Police say he was also driving without a valid license
Wilson also has an outstanding warrant out of Hamilton County
Mitchell officer and a Villa Hills officer both suffered minor injuries
They&#x27;ve been treated at the hospital and released
It turns out Wilson has a history of leading police on chases in stolen cars
Records show it happened in 2015 with a car stolen from an Enterprise Rent-a-Car

— A fire destroyed a Northern Kentucky community activity center that's been around for more than 60  years early Thursday morning
The fire started at the Villa Hills Civic Club on Rogers Road just before 3 a.m
Fire investigators said the fire started in the rear of the building on the back porch
Crescent Springs-Villa Hills Fire Chief Jeff Wendt said that wind conditions hampered firefighting efforts and contributed to the rapid spread of the fire
said the building was built in 1961 and is a center of activity for the community
The club has hosted countless events for the community through the years

VILLA HILLS, Ky. &ndash; The family of a man who was <a href=https://www.cincinnati.com/story/news/local/northern-ky/2021/02/23/what-we-know-villa-hills-officer-involved-shooting/4551244001/ target=_blank>fatally shot by police last year</a> has sued two Northern Kentucky police officers and their department
Kentucky was shot by Villa Hills police during a February&nbsp;2021 traffic stop&nbsp;on Interstate 75 after officers said he pulled out a gun
He later died from his injuries at a hospital in Florence
filed last week in federal court in Covington
alleges Villa Hills police officers Sean Dooley and Jacob Bolton violated Lockaby's constitutional rights
with Dooley arriving on the scene shortly before 11 p.m.
As Bolton conducted a background check from his police cruiser
Dooley approached Lockaby's vehicle to question him
The conversation between the two was "relatively calm," the lawsuit states
and even offers Officer Dooley a tobacco chew
Dooley asked for consent to search the vehicle and Lockaby refused
"You've had a lot of pretty nervous behaviors sitting here talking to me," according to the documents
"At no point in this entire interaction with the Villa Hills Police does Lockaby show signs of being nervous
adding there was no odor of drugs or alcohol coming from the vehicle
The officers noted Lockaby had "a wallet full of money," but that they couldn't tell if the bills were singles
At no point during his conversation with police is Lockaby asked about the money in his wallet
Dooley told Lockaby:&nbsp;"You know what I do for a living ...&nbsp;I catch drug dealers and drug smugglers."
Dooley ordered Lockaby to exit the vehicle so the officers could conduct a search
Lockaby pulled out a gun and "in less than a second
points the gun up before pointing it down," according to the lawsuit
The officers opened fire on Lockaby and he was shot several times
Neither of the officers involved was&nbsp;injured
No drugs were found in the vehicle after it was impounded and searched
The lawsuit also alleges the city of Villa Hills and the Villa Hills Police Department failed to provide appropriate training to officers regarding traffic stops and use of force
Prosecutor: Use of force justifiedA month after the shooting, Kenton County Commonwealth's Attorney Rob Sanders said the <a href=https://www.cincinnati.com/story/news/local/northern-ky/2021/03/19/nky-officer-involved-shooting-justified-prosecutor-says-man-pointed-gun/4769575001/ target=_blank>two officers were justified in their use of deadly force</a>
dashboard camera video from Bolton's cruiser and body camera video from both officers captured the entire incident in which Lockaby refused to follow Dooley's commands to step to the rear of the vehicle
Sanders said Bolton fired after he saw Lockaby point the gun at Dooley
Pennsylvania to a felony offense:&nbsp;possessing a firearm not to be carried without a license
an attorney representing the city of Villa Hills and the two officers
said his clients will "vigorously" defend the officers' actions in court
adding that he's confident the use of force was warranted
"This is about as clear cut as it gets," Mando told The Enquirer
He also said the lawsuit is "frivolous" and he intends to seek its dismissal at the earliest possible&nbsp;opportunity

— After allegedly sharing video of himself drinking alcohol at his birthday celebration
an off-duty Covington police officer ran a stop sign and crashed his personal vehicle into a guard rail in a residential neighborhood in Villa Hills
A Villa Hills police investigation found Devyn Harris was going about 30 miles per hour Feb
8 when he drove headfirst into the guard rail
a Covington police officer since December 2020
told police he was "checking" his phone when he wrecked in a residential neighborhood near Benedictine Sisters of St
Harris insisted that he didn't pass out while driving
Harris declined the I-Team's request for comment
Officer Harris sent "Snap-Chat" video of his consumption of alcohol as part of his celebration of his birthday," Covington Police Chief Robert Nader wrote in a March 1 order suspending Harris for one day
"Many members of the Police Department observed such videos."
Harris' suspension order doesn't reveal what time Harris posted those videos on the night he crashed
Nader declined to say how many Covington officers saw Harris' Snap-Chat videos and which officers received the videos
Villa Hills Police Chief Bryan Allen insisted that his officers investigating the Feb
8 crash were not aware that Harris had allegedly been drinking alcohol and sharing video of it with other police officers before he crashed
"We didn't have enough probable cause (to file charges)," Villa Hills Police Chief Bryan Allen told the WCPO 9 I-Team during a telephone interview
Police records show Harris had deep lacerations on his face and head following the wreck
An EMS crew transported him to University of Cincinnati Medical Center
Villa Hills officers didn't "observe" evidence at the crash scene that Harris was under the influence of alcohol or drugs when he wrecked
If VHPD officers had known Harris shared video of himself allegedly drinking prior to the crash
they would have handled the case differently
"It probably would have given us probable cause" to request a search warrant for Harris' blood to see if he was intoxicated
"The (Covington) internal investigation was never shared with me." 
Nader told the I-Team he learned about Harris' videos "the day after the accident."
"Your questions appear to be wondering whether the officer was impaired at the time of the accident
and whether a social media post seen after the fact would prove that," Nader wrote in the email
"See the Villa Hills police report in which the officers who investigated the wreck describe their firsthand observations of the scene
including any evidence to suggest alcohol influence
Allen said the decision to not charge Harris was made after consulting with the Kenton County Attorney's Office
"We were not a party to any decision-making," Kenton County Attorney's Office Executive Director Susan Topmiller wrote in an email to the I-Team
 "The Kenton County Attorney’s Office was unaware of any of the events relating to the crash of Mr
Devyn Harris until helping process an open records request made by WCPO to Kenton County dispatch on March 7
That was our only interaction on this case."
Police records show Harris wrecked around 11:20 p.m
at the intersection of Amsterdam and Collins roads
The T intersection requires all traffic to stop at a stop sign
Harris was driving on the 900 block of Collins Road
Officers did not consider road conditions a factor in the crash
The guard rail running along Amsterdam Road may have prevented Harris from plunging into a lake on the other side
A neighborhood resident called 911 to report the crash and Harris' need for urgent medical attention for serious face and head lacerations
a Kenton County Sheriff's deputy and two Covington officers arrived at the scene of the one-vehicle wreck late on a Tuesday night
Allen said Harris didn't receive that much police attention because he's an officer
"We treat every accident the same," Allen said
Harris is heard repeatedly screaming for "Sean."

Sean Dooley is one of the Villa Hills officers who responded to the wreck
Police body camera video shows Dooley running to Harris and trying to calm and comfort Harris
Dooley is listed on Villa Hills police records as the "investigator" of the crash
"He's a great f****** dude," Dooley told other officers on his body camera video
The I-Team was unable to determine if Dooley and Harris were friends or just acquaintances through police work in nearby communities
Allen insisted Dooley's relationship with Harris didn't create a conflict for Dooley
"It doesn't mean he can't do the report," Allen said
"He (Harris) was calling for someone he knew and we comforted him until EMS got there."
"Villa Hills Police determined the factor that caused the collision was texting and driving which is a violation of KRS 189.292." 
But Allen said officers couldn't charge Harris with texting while driving because officers didn't see him doing it

Allen said he wasn't concerned that officers didn't check the phone for evidence - texts
photos or video - before retrieving it for Harris
"There was no reason for us to hold the phone," Allen said
Tyler Brockman sent a text message to other Villa Hills officers: "per the Chief
do not disseminate or discuss the collision from last night involving an off duty officer with outside agencies or people
All information will need to be put out by myself or Chief."
some officers were talking about the accident and they didn't need to be talking about it," Allen said
The I-Team left a request for comment on Dooley's voicemail
Dooley followed police department orders and didn't respond to our request
Allen insisted his department handled the case like any other one-vehicle accident
Officer Harris crashed his car three weeks after the Covington Police Department honored him as employee for the month of November 2021
Harris was recognized for his response to a shooting and for enabling the "peaceful surrender" of the suspect
toward a productive and successful career," Nader wrote in his email to the I-Team
"We are happy Officer Harris recovered and is currently working to help the citizens and businesses of the City of Covington."

The Crescent Springs Villa Hills Fire Department and Ludlow Fire Department responded River Road was&nbsp;closed near the 600 block for hours.&nbsp;
