Two wastewater treatment plant employees are facing felony charges after allegations of willfully allowing sewage to leak into Bluff Creek in northwest Oklahoma County
Glenn Brentnell, 63, and Anthony Menzie, 55, who've worked at the Bethany-Warr Acres Water Treatment Plant, were charged Tuesday in Oklahoma County District Court. The pair face felony counts of obtaining property by trick and deception and violating the Oklahoma Pollutant Discharge Elimination System Act.
A probable cause affidavit by an investigator with the Oklahoma Department of Environmental Quality showed officers responded to "an unlawful discharge of a pollutant" in Bluff Creek near the plant on November 30
The discharge was found to be "improperly treated and raw wastewater," according to the affidavit
Witnesses said Brentnell and Menzie were responsible
Menzie said he had altered laboratory test results and submitted them to DEQ and the Environmental Protection Agency in late 2022
Menzie said he submitted the falsified reports after being instructed to do so by Brentnell

now closed civil lawsuit also state DEQ had submitted at least four notices from early 2020 to early 2022 about ongoing issues with operations at the plant and Brentnell's noncompliance with inspection reporting
The Bethany-Warr Acres Public Works Authority then received an emergency order from DEQ in December 2022
outlining multiple deficiencies with the trust's wastewater management system
including the lift station and headworks building
"It was learned that no personnel were onsite at the (wastewater treatment plant)
and the personnel responsible for the (plant) could not be reached," court documents read
Brentnell abruptly retired in December 2022 just after the DEQ's emergency order was received
He had claimed that "the issues in the ODEQ notices were minor," according to the suit
A separate investigation in late 2022 by the public trust
instead found numerous issues with plant equipment that had been neglected and left in disrepair
Had the trust "been advised of the multiple notices served on Defendant Brentnell regarding the plant conditions and plant equipment issues
those issues could have been timely addressed and repaired and discharges avoided," court records also state
the trust claims it spent more than $2.6 million attempting to remedy issues from the plant afterward

but as of Friday evening he was not in custody
