"That 9-year-old boy was shopping with his father in the convenience store," Fowler said
"They were waiting to check out while this altercation was taking place and
that round went through some merchandise and
struck the boy in the upper chest area on the right-hand side."
Fowler said the store owner then restrained Smith
"They actually held him down and took control of the firearm," Fowler said

Since a significant part of Henrietta’s legacy is tied to the West Hamlet
“The entire West Hamlet area has more historic properties than most of the rest of town put together,” Schultz said
“We have a concerted effort to preserve this area to hold onto our heritage.”
State money also could be available to aid in development through the NY Main Street Program grants aimed at blight removal

He said the state agreed that restoration of the Cartwright properties would qualify for blight removal grants

Banks won’t finance a property that does not have a clean title
Even though the building existed long before the state roadway

The town is now working with the Department of Transportation
lawmakers in Albany and Monroe County officials on a plan for the state to cede a slice of the right-of-way
“Steve Schultz has been amazing to work with,” Liess said
“He has a great vision for the town.”
In total there are about 3.5 acres of land on the two sites
so the vacant parking area to the south offers other development possibilities in what likely will be a two- to four-year development endeavor
Schultz said his one ask on any possible new buildings is that the architecture conform to the era in which the existing structures were built
“Others have handled that,” Schultz said
“by making the new buildings look like agricultural structures
which were common next to or behind historic homes and properties like the former Cartwright Inn and historic house on the adjoining property.”
Liess hasn’t moved that far along in his vision
But he is sure of one thing: nothing will move into the property until the old Cartwright Inn is gutted and refurbished
“I’m hoping to salvage as much of the (original) Stagecoach Inn as I can,” he said
“We’ll need to take everything down to the studs
I want to take an ugly duckling and make it look historic.”

(WHAM) — A 9-year-old boy is recovering from non-life-threatening injuries after being shot inside a gas station on West Henrietta Road
The store owner's actions during the incident are being hailed as heroic
BACKGROUND: 9-year-old boy shot at Henrietta gas station
Ruben Smith, a 35-year-old predicate felon, fired the shots at the Speedy Trac gas station and convenience store Saturday, according to the Monroe County Sheriff's Office.
Chief Deputy Michael Fowler said Smith was causing a disturbance among customers and employees before the situation escalated.
The store owner, who spoke anonymously, recounted the moments leading up to the shooting.
"I was terrified. I mean, I wasn't expecting something," he said.
The owner said that when he was walking inside the store, Smith followed him in and a physical altercation ensued.
"He got up and he started first, he swung on me, and that's how we start wrestling," he said. "I kind of hold him down."
As bystanders contacted the police, Smith allegedly pulled out the revolver and fired, hitting the boy in the chest.
Fowler said one of the bullets passed through merchandise, hitting the child in the chest. The owner reportedly disarmed Smith, grabbing the loaded revolver from his hand, and held him until deputies arrived and took him into custody.
Smith had allegedly fired two rounds. One of the bullets struck the boy, who was subsequently taken to Strong Memorial Hospital. He is expected to make a full recovery. The store owner said the other bullet penetrated the bottom of a shelf.
Smith is charged with two counts of second-degree assault and two counts of second-degree criminal possession, with additional charges possible.
Smith pleaded not guilty at arraignment Saturday night. The judge ordered that he remain in custody without bail.
RadarHealth department temporarily shuts down Texas Roadhouse in Henrietta following inspectionby WHAM
Henrietta, N.Y. — The Monroe County Department of Public Health has ordered Texas Roadhouse on West Henrietta Road to close temporarily, according to an inspection report obtained Wednesday morning by 13WHAM.
The report indicated an inspection Tuesday found three "public health hazards" and seven "other violations" at the restaurant.
Photos in the report showed roaches under the restaurant's dish machine, bags of peanuts "adulterated with rodent chewings and droppings" and a roach submerged in sauce along the main cook line, according to the inspector.
The inspection report indicated the county suspended the restaurant's permit to operate, meaning the restaurant must close until further notice. The county noted the restaurant must hire an exterminator and needs to address all violations before being reinspected.
The restaurant confirmed earlier Wednesday morning that it had been temporarily closed due to a pest issue. A sign on the restaurant door indicated it was closed Tuesday night.

Henrietta, N.Y. — One person was hurt during a rollover crash Tuesday afternoon in Monroe County.
Deputies responded just after 1 p.m. to the intersection of Jefferson and West Henrietta roads for a two-car crash.
Investigators determined the overturned car heading north on West Henrietta Road tried to turn left onto Jefferson when it was clipped by another car that was heading south on West Henrietta.
The driver of the flipped vehicle was taken to a local hospital with a leg injury, according to MCSO.
Deputies did not indicate drugs or alcohol were a factor in the crash.

Henrietta Texas Roadhouse to reopen Friday following health department shutdownby WHAM
— The Texas Roadhouse on West Henrietta Road is reopening to customers Friday evening
following an inspection by the Monroe County Department of Public Health that forced it to temporarily shut down

One person died and three others were seriously injured in a three-vehicle crash on Brooks Road in Henrietta Monday afternoon, according to the Monroe County Sheriff's Office.
First responders were called to Brooks Road in Henrietta around 3:10 p.m. after three vehicles collided on the road, said Capt. Christopher Fay of the Monroe County Sheriff's Office. One person - a man - died at the scene, said sheriff's spokesman Deputy Brendan Hurley. Three others — a woman and two young children — were taken to an area hospital with what Fay described as "serious injuries."
All three remained hospitalized as of Tuesday morning and were considered "critical but stable," Hurley said.
"It is a very serious accident and our hearts go out to the families involved, and the victims of the crash," Fay said Monday during a news briefing.
The driver of the third vehicle was not injured in the crash, according to the sheriff's office.
Brooks Road was closed for several hours on Monday as deputies investigated at the scene. Fay said it was tough to immediately determine what caused the collision, which remains under investigation. Deputies spent several hours reconstructing the scene.
Brooks Road is located just north of the New York state Thruway and connects West Henrietta and East River roads.
Further details on the crash, including the names of those involved in the crash, were not released.

The driver, Max Brady, 30, is charged with criminal possession of stolen property, assault, unlawful use of a vehicle, leaving the scene of a personal injury accident and other traffic infractions.
The passenger, Tyler Vergason, 30, is charged withcriminal possession of stolen property, assault and unlawful use of a vehicle.
Both suspects were arraigned in Brighton Town Court and taken to Monroe County Jail. Brady is being held on $10,000 cash bail, $20,000 bond or $100,000 partially secured bond. Vergason is being held on $5,000 cash bail, $10,000 bond or $50,000 partially secured bond.
Police said a woman in the other vehicle was taken to Highland Hospital for treatment, while a man was treated at the scene.

Over 20 Joann fabric and craft stores in New York are expected to close, including three in the Rochester region, the retailer announced in a recent bankruptcy court filing
The retailer, which operates around 850 stores in 49 states, according to its website, filed for Chapter 11 bankruptcy protection in Delaware back in March. In a statement at the time
the Ohio-based retailer said it had secured approximately $132 million in new financing and "related financial accommodations" and expected a reduction of its $1 billion total debt by about $500 million
