The Marguerite E. Small Elementary School in West Yarmouth
is showing its age and limitations for contemporary educational needs
A walk around of the school on Higgins Crowell Road on April 4 with officials highlighted problems — leaking roofs
previous flooding from the parking lot into the electrical units
aging furnaces and no gathering space large enough for the whole school
These were some of the defects school officials pointed out in the rambling school built around an enclosed courtyard
The school currently has 305 pre-K to Grade 3 pupils as well as the town’s only integrated pre-school and special autism classes
“We’re trying to limp things along,” Superintendent of Schools Marc Smith said on the tour
as he and Facilities Director Steve Faucher pointed out many temporary fixes to stop leaks throughout the building
White sheets hang from the ceilings in the halls and classrooms that Faucher calls “rain catchers” and some roofs have a temporary polymer coating
“The big problem is water penetration,” Faucher said
The many angles of the roof are also part of the problem
“We can’t let the problem get worse,” Smith added
The school district has requested $100,000 for more roofing repairs in the capital expense article of the April 29 Yarmouth town meeting warrant
The Dennis-Yarmouth Regional School District was invited in December to enter an eligibility period with the Massachusetts School Building Authority
the first step in a highly competitive process to obtain state funding called the Core program for new schools
It was the district’s ninth attempt for the program
The 270-day period to fulfill all the agency’s requirements began April 1 and must be completed by the end of the year
The requirements include establishing a building committee that should be approved by the Dennis-Yarmouth Regional School District School Committee on May 5
as well as many other documents to back up the need for the state funds
The fall town meeting must also approve monies for a feasibility study and design that could cost from $700,000 to $1 million
School Committee Chair Tomas Tolentino said earlier
The state school building authority decides whether to approve a renovation or an entire new building
M.E. Small Principal Carol Mahedy has worked for the school district for 32 years and served as school principal for four years
she walked the long hallways proudly pointing out student artwork and introducing teachers
several who had attended the school as children
Adrian Bogle was one of those who remembered his fourth-grade classroom
Now he teaches 23 second-graders in one of the most crowded classrooms along with English Language teacher Christine Ciavarra
Seventeen of the students in the class are English language learners
“They get incredible results,” Mahedy said of the co-teachers
Small are currently English language learners
In the eligibility application to the state
Small School’s two classrooms for students with autism and three pre-school classrooms with students of varying learning abilities
“We have the most vulnerable students in the worst facility,” he said
The school was built on the open classrooms concept popular in the 1960s
but the folding paper-thin walls between the rooms have long been sealed
Exterior doors in every classroom are no longer good for security reasons
The courtyard in the middle of the school first had animals such as sheep and chickens
the courtyard is now with little grass and a large clump of overgrown pine trees
Faucher also noted that the courtyard has no access to the outside of the building
so mowers have to enter through the building
Second-grade teacher Bogle showed floor tiles that popped up from water leakage
A classroom for kindergarten teacher Susannah Criser had to be vacated in February because of a leaking ceiling
Having two parking lots also causes a loss of instructional time at the end of the day when buses and parents line up to pick up the students
“I love this school.” She greeted many students by name as they entered the cafeteria to pick up their bagged breakfasts
The school received a state award last year for serving breakfast daily to 85 percent of its students
The school's name honors the second-grade teacher and principal Marguerite E
who worked in the Yarmouth schools for 44 years and whose photo is at the front entrance

Tom is survived by three daughters: Kathleen Kelley of Medford; Susan Leighton and her husband
of Beverly; and Christine O’Brien of Manchester
He is also survived by many nieces and nephews
he was grateful to grow up with many cousins

No one was injured Wednesday when someone fired a bullet through the window of a home on Camp Street in West Yarmouth
according to a statement from Yarmouth police
Officers went to theh ome after a woman heard glass shattering in another room at around 6 p.m.
She discovered a bullet on a couch in that room
The Yarmouth Fire Department also sent a crew to the home
No one was in the room where the bullet entered the home
according to Yarmouth Patrol Officer Nicholas Giammarco
Police determined the people in the home were targeted; it was an isolated incident

has drawn complaints from performers about getting paid and from ticket purchasers about cancelled shows

The Music Room opened in 2021 as an 88-seat live performance venue
art gallery and recording studio at 541 Main St
it was described as a collaboration between mortgage originator Scott Cornella
Grammy Award-winning producer and guitarist Paul Nelson was another partner involved with bringing The Music Room to life
Ticket prices have ranged from $35 to $150
In an interview at the Times office March 26
Peter Larkin of Dennis said he has joined The Music Room as a partner
Serpone sought the in-person interview with the Times but did not show up as arranged on March 26
"The people who haven’t been paid are going to be paid," Larkin said
"I'm interested in moving this forward and taking care of what is handed to me from the past
Mingace said The Music Room is working on paying artists who haven’t been paid and refunding money to ticket holders
“We’re working with rescheduling shows for folks that want to use the money for another show and then we’re refunding the balance to anyone who does not want one of those two options or the show’s not being rebooked,” Mingace said

Beaudoin said he called and emailed Serpone
and booking agent Bobbi Lewellyn-Harper for months
He said he left messages on The Music Room answering machine
He sent registered letters to The Music Room and Alpha Entertainment Group’s resident agent address
One was returned after two weeks; the other was returned as undeliverable
Beaudoin said he then tried to track down Angela Philbrook
an attorney listed on forms filed with the Secretary of the Commonwealth for Alpha Entertainment Group
but her address was the location of a Christian book publisher
Beaudoin filed a complaint with the Yarmouth Police Department
Sound technician Andy Aldrich said he is still waiting to be paid for work he did at The Music Room in July
He said he worked three weekends and was paid for only two
Aldrich said he has repeatedly called Serpone and Cornella to no avail
He spoke with the Yarmouth Police Department but did not file a complaint
“He’s caused me a lot of grief,” Aldrich said in a March 19 telephone interview referring to Serpone
Yarmouth Police Detective Stephen Renzi said one formal complaint and three informal complaints have been lodged against The Music Room
The formal complaint ended when the performer who lodged it got paid
Renzi told a ticket purchaser to pursue a refund through small claims court
The two other parties never told Renzi if they wanted to pursue the matter civilly or criminally
Cancellations on the website Eleven of 48 upcoming shows at The Music Room have been cancelled
according to the venue’s website on April 7
Tom Rush posted on his Facebook page that he cancelled two March shows because “the venue has defaulted on all their obligations.”
A post on the Eddie Japan Facebook page announced cancellations of two June shows due to “...ongoing managerial issues at the venue,” adding
“we feel it’s in the best interest of everyone involved to step away.” Frontman David Santos declined to offer any additional information beyond the Facebook post
“We’ve had shows cancelled before,” Mingace said in the March 26 interview at the Times office
what the artists are telling us is that someone is purposely trying to cancel the shows
We’re going to have an investigator come in and investigate.”
New Hampshire resident Dave Adams spent $309 on four tickets to the Eddie Japan show scheduled for June
His credit card was charged but he said never received tickets or an email response from The Music Room as confirmation that he'd bought tickets
he said he couldn't leave messages because the mailbox was always full
He received no responses to emails requesting information
With no record of his purchase besides a charge that doesn't list The Music Room or a ticket agency
“When you can’t get a hold of someone and there’s a pattern
it just doesn’t feel very good,” Adams said on a telephone call March 29
Three complaints on the Better Business Bureau website as of April 2 are from customers who sought refunds for cancelled or rescheduled shows
“we have a no-refund policy for all ticket purchases.”
is that the venue does “honor the ticket for the same seat and same artist in the event of a cancellation or reschedule

Jon Tolley has been selling fresh lobsters from his home in West Yarmouth since 1975
and his father did the same for nearly 30 years before that from the same house
“I’m 66 and I have been a fisherman my whole life,” Tolley said
Yarmouth Building Commissioner Mark Grylls has ordered Tolley to stop selling his lobsters from his home at 23 Iroquois Blvd
in West Yarmouth because retail sales in a residential zone are not allowed under zoning regulations
“I have to follow the regulations,” he said Wednesday
The town received a complaint about Tolley’s sales from a West Yarmouth resident
Tolley is seeking to overturn Grylls’ order and will ask the Zoning Board of Appeals on April 10 to allow him to continue selling lobsters from his home

The town has mostly ignored his pleas to find a new location for the pumping station, Wilson said on Dec. 23 at the bog property. The pumping station will be built close to his family's bogs and agricultural wetlands. Wilson's Fresh From The Vine farm stand — a repurposed cranberry-red RV — is also in jeopardy

the town is negotiating with Johnson to secure an easement to his property at 316 Route 28 for the pumping station
Any structures will be located 10 feet away from the retaining wall
The wall will be monitored throughout construction
and contractors will be responsible for any damage to existing infrastructure
The pumping station will also have vault linings
daily operator inspections and multiple backup generators
It will also designed to handle peak summer flows
and there will be an on-site emergency generator
All critical equipment will be elevated three feet above 100-year flood elevation
The pumping stations need to be adjacent to low points in the collection system
which is why the town had trouble finding locations
Town officials considered placing the pump across the street from Wilson's bog
but conservation restrictions prevented that option
"I am one of the last four (cranberry) growers in this town and as far as I'm concerned the elevations are not going to work," said Chris Wilson

"At this point the towns is talking about me— but not to me," he said
He is also worried about the retaining wall

that the town needs some kind of wastewater treatment system
Johnson said he's trying to let the dust settle
"I want to do what is healthy for the town from a sanitation and sewage standpoint," said Johnson
"But before I would ever allow an easement to go in
I want to know that everyone is protected."

The woman's husband went into the house to rescue the woman from the second floor and the man, who was in the basement. He also tried unsuccessfully to put out the fire with a fire extinguisher, according the Yarmouth Fire Chief Enrique Arrascue.
The fire was mostly confined to a second-floor bedroom
but other parts of the home had smoke and water damage
and it took probably a couple hours after that to clean up," said Arrascue
According to a press release from the department, no one was injured. The American Red Cross helped with woman and man who were in the house
The department is investigating to determine the cause of the fire

(WLNE) — The Yarmouth Fire Department responded to a fire on the second floor of an occupied home on Gill Avenue Wednesday
Crews responded at approximately 10:40 p.m.
as well as an ambulance from Centerville Osterville Marstons Mills
Most of the fire was contained to the its area of origin in the second floor bedroom
and the home sustained heavy smoke and water damage
Two occupants of the home and a civilian attempted to put out the fire with a fire extinguisher and were evaluated and released at the scene
No first responders were injured while fighting the fire and the American Red Cross will be assisting the displaced residents
The cause of the fire is still under investigation by the Yarmouth Fire Department
The sites of a former night club, a motel and a 1750 boarding house will be turned into one nature-based park on three town-owned properties on Mill Creek
The planned transformation has taken 27 years
The existing Mill Creek Park and Chase Brook Park will be connected with a pedestrian bridge over Chase Brook to a vacant parcel in the middle
where the former Yankee Village Motel stood
The Yarmouth Select Board approved renaming the new combined park as Chase Brook Park
The spring town meeting will be asked to approve funding for the park project
Greene said those amounts include $820,000 from the town's CPA money
$373,000 from the capital improvements budget and $368,755
a repurposed balance from the motel purchase

“It will be a benefit to the town and visitors,” she said
noting that many cars stop in the two parks’ parking lots now
The project’s environmental benefits will include improving the surrounding water from nitrogen pollution
creating a low-mow maintenance area and possibly allowing shellfishing again
Other improvements to the combined park will include a birch tree grove along Chase Brook
will help provide educational signs about the native plants and history of the park area

Years in the planning West YarmouthThe site's transformation began in 1997 when Rascals nightclub burned down at 261 Route 28 and became Chase Brook Park in the early 2000s with Community Preservation Act money and the help of many local donations
the town acquired with CPA money a parcel east of Chase Brook Park at 281 Route 28 where a 1750 boarding house was in disrepair and in foreclosure
It was demolished to create the current Mill Creek Park that has a parking area and a lookout
In between the parks was the Yankee Village Motel at 275 Route 28, which town meeting approved in 2018 and was purchased in 2020 for more than $1 million from combined CPA funds and a Parkland Acquisitions and Renovations for Communities (PARC) grant
The motel’s “onerous septic system” was removed and thus ridding 97% of nitrogen-loading pollution
The building was demolished and asphalt removed
“We’re excited to be contributing to reducing nitrogen pollution,” Whetten said
Whetten said state environmental regulators have granted permits for the entire site
The Cape Cod Commission also recently exempted the project from review as a development of regional impact
The commission “determined it was not going to create an impact,” he said
“We’re not building anything to create undue hardship.”
The application has been submitted and Whetten does not expect a problem with approval
Last fall, the town also received $434,000 for the water quality improvements for the project from the Southeast New England Watershed Implementation Grants program
administered by the Environmental Protection Agency
The total estimated cost of the project is $1.5 million
which does not include eliminating the invasive species over three years

the investigation identified Brazilian nationals in several communities in Massachusetts who have allegedly been involved in the sale of various types of firearms

specifically the “Tropa de Sete” and “Trem Bala” street gangs
originally founded in the prison systems in São Paulo

kidnappings and the coordination of a transnational drug trafficking operation.To date
trafficking quantities of fentanyl and ammunition have been seized over the course of the investigation which began in 2024

Eighteen Brazilian nationals have been charged separately with federal firearms offenses over the course of the investigation

“New Year’s has been one of our busiest nights of the year
We have people coming in who have been coming in for 25 years,” Premny said
the Orleans couple is looking to sell their restaurant and enjoy retirement
They have listed the 80-seat restaurant at 23 West Road for $1.6 million
“We’re putting our toe in to see what happens,” she said
“We would love for someone to come along and love it as much as we have.”
The owners said they plan to keep business as usual at the year-round restaurant
continuing to serve dinner as they do now until they find the right new owners
Roche runs the dining room and Premny is the chef
Roche remembers the early days when she would bartend a full shift and then head to the laundromat with bags of linen tablecloths that needed cleaning for the next day
23 West Road “was a cottage in the 1920s and in the 1970s or so
We took over from her in 1996,” Premny said
“Everyone remembers she always had a playpen in the dining room because she had all these grandkids.”
The new partners named the cottage-style restaurant The Beacon Room and started out serving lunch and dinner

noting she has experimented with serving elk loin

Two 18-year-old men were arraigned in Barnstable District Court on Jan. 9, following arrests leading to the seizure of a 3D printed handgun and a Polymer 80 handgun, according to the Yarmouth Police Department
Both handguns are referred to as ghost guns by Yarmouth police
because they do not have a proper serial number listed
was charged with two counts of possession of a large capacity gun and possession of guns with defaced serial numbers
A large capacity gun is one that is capable of holding more than 10 rounds of ammunition
