We spoke to Olivier Rousteing one week before the Met Gala
Not only has he been designing the house’s next pre-collection and custom fits for the biggest fashion night of the year
but he’s spent the past 18 months working closely with Johnnie Walker Vault on a selection of four (one for each season of the year) $20,000 dollar bespoke whiskies
who’s high energy and running on“adrenaline,” you’d never guess that the past few years haven’t been an easy run
leaving him with severe burns and facing a long and gruelling recovery process
as would be expected from Balmain’s prodigy—Rousteing was appointed creative director of the house at an embryonic 25-years-old—he’s come back stronger.
how the fire informed the Johnnie Walker collaboration
and why he’s no longer “the Balmain baby.”
The Met Gala for me is one of the most iconic moments in the year because you can express your creativity in such an endless way
but it’s also all about the history of the story of fashion because you know that what you do at that time
because it’s going to be exposed in the Metropolitan Museum
The Met is not something that you do only for the first Monday of May
and I’m obviously known for my tailoring
It’s the best time of the year when I can enjoy dressing people and the excitement of the dresses and of the suiting
Trying to top last year [Tyla’s skin-tight sand dress] is gonna be really difficult
In what ways did your approach to couture inform the Johnnie Walker collaboration?
Creating a blend is like creating a collection
Creating whisky is even more emotional than a collection for some reason because when you wear something
it gives you confidence or it gives you an attitude
I wanted to drape the bottle in metal gold
which for me was like draping my mannequin.
I read that the whisky bottle’s wing stopper reflects your recovery after the fire
I think those wings are like I’m rising from the ashes like a phoenix
There is one sentence that is really part of the house and anchored in the house
“let’s keep walking until we can fly.” It’s a part of a moment of my life where maybe I was scared to not fly again because when you get burned on 70% of your body
you don’t know how you’re gonna come back
But if you get the resilience and acceptance
including the full collection of decanters numbered ‘1’
The collection launches globally from 26th May with only 25 bottles of each season available worldwide

The charismatic creative director launches Balmain Beauty with a maximalist fragrance collection that fuses heritage with a future-facing energy
FRAGRANCE AND fashion have long enjoyed a symbiotic relationship
scent marked the first step into the beauty sphere — an intangible accessory that captured the essence of a brand
who launched his eponymous label’s first perfume in 1946
just one year after his debut fashion collection which was hailed as the “New French Style”
Fast forward almost 80 years and Balmain’s current creative director, Olivier Rousteing, has built on the brand’s longstanding perfume legacy with the anticipated launch of Balmain Beauty
available at David Jones Elizabeth Street Sydney

or I’m playing the better version of myself.” He continues
“There’s intimacy with your fragrance that there is with nothing else… it’s armour that you can wear every day.”
“When you start to discover all the notes it feels like it’s so infinite and…I didn’t know how it worked so I went to school and I tried to really understand how to create fragrance
because I knew how to create clothes [but]…to create fragrance
with Rousteing relishing the opportunity to learn something new in his thirties
smelling all the flowers…starting to play with them and learning from the other students,” he smiles
“I kept saying from the beginning of my experience with Balmain Beauty [that] I would love to create a symphony
but I didn’t know the instruments to create it
this orchestra.” His solution was to immerse himself in the industry to ensure he could communicate with the ‘noses’ he collaborated with on the scents
To recreate the compelling duality that exists in his fashion designs
“Balmain is a brand of tensions — the tensions between the heritage [and]…the sense of modernity
the sense of being a witness of the present to build a better future,” the creative director states
when we created Balmain Beauty…that’s what we wanted to represent.”
The resulting perfumes juxtapose traditional notes to create a contemporary friction
Powerful musk — a favourite of Rousteing’s — is paired unexpectedly with delicate rose; airy citrus creates synergy with sensual jasmine; marine notes elevate earthy oakmoss
“We made sure that they would work and they would be even stronger together,” shares Rousteing
“The tension between two notes [is] what I was trying to do with all of [the fragrances]
to make sure that they will be really unique.”
“[With] Carbone — there’s an intensity that is really strong
because when I wear [it] I feel unstoppable,” the designer considers
I feel cosy and inviting…so it’s a really different kind of emotion.” Rousteing also advocates for layering the scents to create a unique sillage
“I love layering fragrances — I do that a lot with Carbone and Rouge; I [also] mix Sel d’Ambre with Bleu Infini,” he shares
is not dissimilar to his approach to dressing
“It’s like when you buy a jacket and you buy a t-shirt
you buy a sweatshirt and you do your own styling,” he explains
“It’s the same for me with fragrances — style yourself
because only you can know better than anyone the way that you want to be.”
Meet the eight Les Éternels Eaux de Parfum that make up this compelling new collection and find your favourite with assistance from Rousteing himself. “Start with notes,” he advises, “and you start to understand [if] you are more someone that loves leather, wood, tobacco, floral. Are you more into spicy? Are you more into vanilla
It’s really interesting because you start to discover your personality.”

Its Rozelle Village proposals now on exhibition include affordable and market housing and provide 227 units across considerably upsized buildings of up to 16 storeys
This is a 75-apartment increase on the previously approved plans for the site
according to Heworth head of development Christopher Walsh
“The inclusion of affordable housing in our updated proposal is a direct response to the urgent need for more diverse housing options in the inner west
where high rents and limited availability place significant pressure on essential workers and families,” Walsh told The Urban Developer
“The infill affordable incentive assists with the project viability—which is what we believe was the Premier’s intention.”
Just 3.5 per cent of the local housing stock is dedicated to this housing typology
compared to 5 per cent in Greater Sydney as a whole
“While development delays are always a challenge
ensuring the long-term viability of the project.”
With a handful of studios and SOHO (small office/home office) units
126 two-bedroom and 68 three-bedroom apartments
Heworth will deliver a “vibrant mixed-use development”
with commercial and retail floorspace across numerous multi-storey buildings
“The exhibition milestone is a significant moment for Heworth in bringing Rozelle Village closer to reality,” Walsh said
“It’s an opportunity to present our plans to the public
and further refine the project to meet both community expectations and regulatory requirements
we are optimistic that construction will follow soon after.”
Surrounding a public plaza will be a new registered club to replace the previous Balmain Leagues Club
and 200sq m of community facilities in a non-residential podium
and a smaller three-storey building to fit the SOHO units
sits on the brownfield site and would be demolished for Heworth’s project
While the future of the project looks bright
The developer took state agency Transport for NSW to court this year, asking for $100 million in compensation for the delay to the development, which centred around the agency’s compulsory acquisition of the site
Heworth has owned the site since 2018 and has had multiple iterations of its proposals since
will mark the end of the long development process
Eden Connell and his partner Karen Ball went house-hunting
Balmain and Rozelle were at the top of their suburb wish list
but they quickly discovered their budget didn’t stretch to the house with a two-car garage they were searching for
and we didn’t really know the suburb that well
but I used to work in Leichhardt and we love the edginess of it and the culture of the [surrounding] suburbs,” Connell says
Connell is a corporate photographer whose business requires regular trips into the city for shoots
so they were looking for a larger house within striking distance of the city
Lewisham is just seven kilometres south-west of the CBD with terrific public transport options
“We’ve got space and we’re close to everything.”
The family of four can jump on the light rail for a day trip to Darling Harbour or a meal at the Tramsheds
or walk to myriad eateries in the neighbouring suburbs of Dulwich Hill
Local agent Joseph Lombardo says schools in the area
and construction is underway on upgrades to the GreenWay along the light rail corridor
which will deliver new parklands and pathways
“It’s an up-and-coming suburb yet it’s quiet and safe to bring up a family,” Lombardo says
Darlinghurst: One of Sydney’s most walkable suburbs
Menai: Looking for ‘good schools and better value’
Hurstville: The unexpected ‘burb to get a one-hat meal and award-winning coffee
landing in Lewisham has been a really good decision
it would be hard because we’re really settled where we are,” he says
and since we’ve moved here it’s getting better and better.”

The Boulevarde is probably the most prestigious street in the suburb. It’s got a lot of original homes from the early 1900s that have been renovated, and it’s a wide, tree-lined street close to the school and Petersham hub.
Maia Specialty is right opposite the train station and it’s great for coffee [expect house-roasted single blends and single origins], and I love Moulin Cafe for its pastries. I’ll pop in before work or at lunchtime, or on a Saturday walk.
The demographic has completely changed from local buyers to a majority from inner-city areas, and that comes down to value. The Lewisham market is dominated by apartments as opposed to houses, and that price point is very attractive.

The Balmain board is set to call a crisis meeting to discuss removing the club from the joint venture with Western Suburbs in an ambitious bid to go it alone that could spell the end of the Wests Tigers
In a move that will send shockwaves through the NRL
frustrated Balmain directors are preparing to call a vote on their involvement in the merger amid concern over decisions being made by the club’s majority owner
Balmain director and former Tigers first grade player Garry Leo told this masthead on Thursday he and his fellow board members had “lost faith” in HBG and was calling on fellow directors to endorse the end of the troubled joint venture 25 years after it was established

Balmain see it as an opportunity to put forward a proposal that could force the NRL to choose between the Balmain Tigers and Wests Magpies if the NRL team is unable to keep the Tigers name without Balmain’s involvement
The Balmain side owns 10 per cent of the Wests Tigers
with the other 90 per cent owned by the Holman Barnes Group – of which 30 per cent is owned by the Western Suburbs Magpies
HBG acquired 15 per cent of Balmain’s previous share in 2019 when it agreed to pay off Balmain’s $3.2 million debt to the NRL

Balmain have already held private conversations about approaching 91-year-old billionaire property developer Harry Triguboff
to gauge his interest in potentially backing a Balmain licence given their limited financial resources
The other name being discussed is billionaire automotive businessman
we could go to the NRL with a proposal to stand alone,” Leo said

It comes a day after the Herald revealed Wests Tigers chairman Barry O’Farrell is considering walking away from the club after he was recently told by HBG he would have to reapply for his job
who is also the Balmain representative on the Wests Tigers’ four-person board
said: “I have no comment on behalf of Balmain.”
Balmain directors feel they were blindsided by the external review at the end of last year
and believe many of HBG’s decisions have had a negative impact on the NRL club
“One day we’re being told Barry O’Farrell would be reappointed as one of the independent directors
it’s why they have been going so bad all these years
and that’s because the Wests directors have had too much influence on what is happening at the club
He was basically being told what to do by Wests.”

The New South Wales government has announced that the Balmain peninsula will soon have 24 hour public transport with buses to run the length of Darling Street at least every hour on Friday and Saturday nights.
The introduction of 24 hour public transport to the peninsula supports the Inner West Council’s recent announcement of Balmain’s Darling Street becoming a special entertainment precinct.
The new 24 hour routes include the 433 from Balmain Gladstone Park, which travels to Central via North Annandale, Forest Lodge and Glebe, and route 422 that connects Balmain East Wharf to the QVB.
These services will be upgraded to run every 10 minutes or better between 6.30am and 830pm on weekdays and every 20 minutes or better between 5.30am and 6.30am, as well as between 8.30pm and 12.30am.
“From December 8, Inner Westies will have another transport option to get home after a night out, with overnight services running on Friday and Saturday,” NSW transport minister Jo Haylen says.
“Sydney has a comprehensive 24 hour public transport network, with a variety of services continuing throughout the night, every night.
“Adding these two extra overnight services means there will be 36 bus routes operating on Friday and Saturday nights across Sydney.
“We are always looking at ways to improve frequency and reliability of our bus network, which means providing more services on some of our popular routes and reducing them were the demand isn’t there.
“These timetable changes will help passengers take advantage of the new City Metro line and support Southwest Link operations during the final Metro conversion of the Bankstown Line.”
The 442 and 433 join 34 other buses that operate a 24 hour service on Friday and Saturday nights that ensure Sydney has a comprehensive public transport network all night long.
The changes have been introduced as part of a broader timetable shakeup which will see improved frequency and new overnight services across the Region six bus network in the Inner West.
Route 423 from Kingsgrove Depot to Martin Place via Earlwood and King St Newtown will see additional services across the week, with services operating at least every 10 minutes on weekdays.
Additional services will operate on route 418 Burwood to Sydenham and will support Southwest Link services connecting Marrickville, Dulwich Hill and Hurlstone Park passengers with Metro services at Sydenham and Sydney Trains services at Ashfield and Burwood.
The expanded services on route 418 will increase service frequency across the week and replace the 425 service which duplicates a small section of the route between Dulwich Hill and Sydenham.
Additional morning and evening services on the 420 service will provide additional public transport connections to Sydney Airport for travellers and workers.
Timetable adjustments will also be introduced on routes 426, 428 and 430 operating towards the city along the King Street Newtown corridor.
Route 526 will be upgraded to operate every 10 minutes or better seven days a week, supporting demand for travel between Rhodes, Sydney Olympic Park and Strathfield.
There will also be changes on some Victoria Road services operating to Drummoyne, Chiswick and Five Dock, with more services operating on route 504 Chiswick to City and adjustments to route 502 Cabarita Wharf to City.
The additional services on route 504 will replace existing route 503 which covers the same route from the City but terminates earlier in Drummoyne. These changes will better reflect demand and reduce service duplication.
Transport for NSW is working with schools, community and business groups to ensure people have the information they need to plan their trips. Further timetable adjustments are planned for early 2025 in Blacktown, Hills District, South East Sydney and the Northern Beaches.
“24 hour buses to Balmain could the shot in the arm needed to bring our famous pub culture back to life,” Mayor of the Inner West Darcy Byrne says.
“With the White Bay Power Station pumping, new 24 hour buses and the Darling Street special entertainment precinct opening in 2025, this could be the renaissance of Australia’s oldest and best pub culture.”

Olivier Rousteing becomes the first cultural collaborator invited into the Johnnie Walker Vault
Johnnie Walker, the world-renowned Scotch whisky brand, has teamed up with Balmain couture icon Olivier Rousteing on a super-exclusive inaugural release from its Johnnie Walker Vault
The initiative brings together Rousteing’s high-end fashion vision and the expertise of Johnnie Walker master blender Dr Emma Walker in what the brand says is an innovative exploration of flavour
form and heritage that will influence the final release
The first of two releases of Johnnie Walker Vault x Olivier Rousteing Couture Expression will be pre-launched at Harrods on 5 May
a preview that will include the full collection of decanters numbered 1
The release will be launched globally from 26 May
with only 25 bottles of each blend (named after the seasons)

The Johnnie Walker Vault is home to more than 500 of the rarest and most exceptional whiskies in the world. Until now, access to the Vault has remained exclusive to a select group of whisky makers and blenders (and a Spear’s writer)

registry and fund administration platform Caruso has secured a $3.2 million strategic investment from Balmain — one of Australia’s leading private credit firms — accelerating the fintech’s expansion plans ahead of its intended 2026 fundraising timeline
"We weren't actually actively out here capital raising
so it's been opportunistic," said Mark Hurley
speaking from the company's newly established Dallas office
The investment materialised during a routine business development trip to Australia
where Balmain was initially on Caruso’s “target client list"
founded in 2023 in New Zealand but now largely based in Australia
Its platform is used to manage $15 billion in assets across more than 400 funds and 27,000 investors
Its platform aims to streamline operations for fund managers by consolidating multiple software systems into a single interface
particularly unlisted or private fund managers
most of them will have three to six different softwares managing investor data," Hurley said
"They'll have some sort of onboarding and AML/KYC tool
and usually these systems aren't integrated or are poorly integrated."

Balmain legend Ben Elias says 100,000 fans will hit the streets in protest, as South Sydney supporters did at the turn of the century, if the club’s majority owner attempts to replace the Wests Tigers joint venture with Wests Magpies
This masthead on Friday reported on the latest drama playing out behind the scenes at the Holman Barnes Group
and how at least one director held grave fears for the future of the Tigers-Magpies merger
Former HBG chairman-turned-director Tony Andreacchio
wrote to several members via text message: “Their [HBG] misguided ambition is to see the Western Suburbs Magpies replace the Wests Tigers in the NRL competition.”
Elias was stunned talk of a divorce continued to surface after nearly 25 years of marriage between Balmain and Wests
rating the chances of Wests Magpies returning to the NRL about as good as “the Balmain Tigers coming back”
“And the suggestion that this group now wants the return of the Wests Magpies instead of the continuation of the Wests Tigers as an NRL entity is simply outrageous,” Elias said
“It demonstrates a complete disrespect to our passionate fans
“If this mob wants the Wests Magpies to return
you can expect 100,000 fans to take to the streets and protest
just like South Sydney fans did when their team was kicked out of the competition [in 1999]

“The article in the Herald explained that the HBG is controlled by 18 debenture holders
“The debenture system at the HBG is archaic
It means that our great fans and supporters have no voice with respect to the running of our great club
“Our great club deserves the best possible stewardship
I also can’t see the ARL Commission and [chairman] Peter V’landys allowing this to happen.”

The Tigers and the other 16 clubs recently signed licence agreements with the NRL
they would first need to convince the ARLC why they should revoke the Wests Tigers licence
HBG chair Julie Romero could not be contacted on Friday
but said via a prepared statement on Saturday: “The Holman Barnes Group slogan is ‘be true to the review’
Our commitment is to the West Tigers and ensuring the Wests Tigers is positioned for success
Seeing reports suggesting anything other than our total commitment to the club is disappointing
“We will not be moving away from Wests Tigers and to claim that is fiction
The group is disappointed to see damaging inaccuracies reported.”
and telling another she was in the wrong corporate box at a game
Andreacchio would not comment on Friday about the text message he had sent
but did say: “All I will say is that my only concern is the best interests of the Wests Tigers
Some on the board couldn’t cope with losing their blazers as part of the review
I would be very worried about the future of the merger.”

Jarome Luai met Wests Tigers fans for the first time on Saturday
and stood in the blazing sun for 90 minutes posing for every photo and signing every autograph
Luai was even gifted a gold necklace with a tiger
and wore it around his neck as he was the last one standing at Concord Oval
at least 30 minutes after his teammates had finished their commitments
There is a lot of excitement in Tiger Town because of the arrival of four-time Penrith premiership winner Luai
not to mention the untapped potential of young guns Jahream Bula
Luai was not due to report for Tigers training until the new year because of his international commitments with Samoa
with the loudest roar coming when he stepped past a couple of defenders and almost scored a try during a training drill
Front-rower May, who thought Trent Robinson was “prank calling him” when the Sydney Roosters coach told him he was free to leave the club despite having two more years to run on his deal
refused to discuss Robinson or his former club
“I don’t want to comment about where I was previously
I don’t want to talk about the past any more
As for joining his Samoan Test teammate Luai in Tigers colours
May said: “I grew up with ‘Romy’; I’ve known him since I was like six years old
A lot of people have speculated that I came here because of him
I remember him always being immature and just that guy that mocks everyone
But he’s really taken on his role of leadership
It’s surprising to see because I’ve known him as that mocking
and hopefully he can prove to all the young boys.”

The developer of the long-dormant Balmain Leagues Club site is seeking $97 million in compensation from the state government over an abandoned compulsory acquisition of the land for a temporary construction site for the Western Harbour Tunnel
The compensation claim includes costs associated with a fire that tore through the property in May 2022 while the land was occupied by Transport for NSW
Demolition of the old Balmain Leagues Club on Victoria RoadCredit: Edwina Pickles
filed proceedings last year against Transport for NSW in the Land and Environment Court
It is seeking an order that the transport agency pay it $97.2 million in compensation
including more than $48 million to cover construction costs said to have increased while its redevelopment project was paused
The compensation figure sought by the developer can be revealed after the court released key documents in the dispute
Transport for NSW denies the developer is entitled to compensation in the amount claimed
Transport for NSW compulsorily acquired a lease of the land in October 2021 as a construction site for the $7.4 billion Western Harbour Tunnel between Cammeray and Birchgrove
The term of the lease was a maximum of seven years
but Transport for NSW was able to terminate it with one month’s notice
It rescinded the acquisition months later in July 2022
Under NSW laws covering compensation when compulsory land acquisitions are rescinded, landowners are entitled to be compensated “for any financial costs or any damage actually incurred or suffered ..
as a direct consequence of a compulsory acquisition and its rescission”
Transport for NSW disputes that delayed development of the land and costs associated with the fire amount to financial costs or damage incurred as a direct result of the lease acquisition and rescission
It says in its defence document that “the fire was treated as suspicious by Fire and Rescue NSW” in 2022
The state government’s multibillion-dollar infrastructure program has led to mounting compensation bills for compulsorily acquired land, including around the new Western Sydney Airport and metro stations
Heworth said it first became aware of the proposed acquisition of its site in March 2018
and it was “unable to progress the development” in the face of uncertainty about whether it could proceed
it was publicly known in the market that the lease over the land was proposed to be acquired which created negative market sentiment in relation to the development,” the developer said in a court document outlining its claim
it was unfeasible to commence marketing the development for pre-sale.”
The site has been vacant since 2010. Heworth’s latest, and controversial, plan for the site is a $285 million mixed-use development including 227 apartments – of which 59 are affordable housing units – spanning three towers between 14 and 16 storeys
It had won approval for a smaller development

The Balmain peninsula will soon see 24-hour public transport
with buses running the length of Darling Street at least every hour on Friday and Saturday nights
The introduction of 24-hour public transport to the peninsula supports the Inner West Council’s recent announcement that Balmain Darling Street will become a Special Entertainment Precinct
performances and cultural activities can flourish
and outdoor dining is permitted until 11pm
The new 24-hour routes include the 433 from Balmain Gladstone Park
which travels to Central via North Annandale
and route 442 which connects Balmain East Wharf to the QVB
These services will also be upgraded to run every 10 minutes or better between 6:30am and 8:30pm on weekdays and every 20 minutes or better between 5:30am and 6:30am
“24 hour buses to Balmain could the the shot in the arm needed to bring our famous pub culture back to life,” said Inner West Mayor
new 24 hour buses and the Darling Street special entertainment precinct opening in 2025
this could be the renaissance of Australia’s oldest and best pub culture.”
The Inner West bus timetable changes start on Sunday 8 December and are being implemented to support improved bus connections and service reliability
giving passengers the connections they need for seamless connections to other transport options
“Transport for NSW is working with schools
community and business groups to ensure people have the information they need to plan their trips
Further timetable adjustments are planned for early 2025 in Blacktown
South East Sydney and the Northern Beaches,” it stated

“These timetable changes will help passengers take advantage of the new City Metro line and support Southwest Link operations during the final Metro conversion of the Bankstown Line.”
Council was recently given the green light from the State Government to proceed with its planning proposal to establish Special Entertainment Precincts in Balmain
Mayor Byrne said the Inner West continues to position itself as the leading entertainment and live music destination in Australia
“We were the first Council in NSW to deliver a Special Entertainment Precinct
now we are building on that success with 6 more,” he said
“These new Special Entertainment Precincts will build on the success of Enmore Road and create more opportunities for performing artists
as well as boost local businesses and add to the vibrancy and nightlife of our neighbourhoods
“Rewarding venues that host gigs with an hour later trading creates a real incentive to rely on cultural activity instead of poker machines
For Darling Street Balmain and Norton Street Leichhardt these new precincts can be the shot in the arm they need to bounce back to life
“Earlier engagement this year for these new precincts received great community support
so we know this is something local people are enthusiastic about.”
The Mayor said the six new Special Entertainment Precincts will create real incentives for venues to host live performances and artistic activity through:

This was for sure a shift in womenswear genre for Balmain, but Rousteing’s authorship was unmistakable. He said: “I'm proud of this collection because, for me, it is the beginning of a new era. And after 14 years, if I cannot write a new book, then what is the point? And now I think this is what I'm doing.”

Our community needs a representative who is a compassionate listener and fierce fighter” Ms Leach said
“This community has been facing a lot of challenges
We need a strong and experienced Government helping families through these tough times
“Now more than ever it is essential that our community has a strong voice in the heart of the NSW Government
A Liberal representative with pragmatic policy and a means to deliver it is what our community needs.

A Sydney court case over a will including multimillion-dollar properties in the harbourside suburb of Balmain has shone a spotlight on the rise in lawsuits filed by family members seeking a greater share of a deceased’s estate
NSW Supreme Court Justice James Hmelnitsky said a widow in her 70s should receive a larger slice of her late husband’s assets after he died in 2022 aged 87
The Balmain properties at the centre of the NSW Supreme Court case are worth an estimated $6.8 million.Credit: Jamie Brown
The estate included three Balmain properties estimated to be worth $6.8 million: houses in Llewellyn Street ($2.5 million) and Little Darling Street ($1.8 million)
and a mixed commercial and residential property in nearby Montague Street ($2.5 million)
The couple had lived at a semi-rural property at Razorback near Camden
The entire estate was valued at more than $9 million
The deceased’s wife of 40 years filed proceedings last year against the executor of his estate under NSW succession laws that allow spouses and children, among others, to seek a “family provision order” if inadequate provision has been made for them in a will
The judge said it was “broadly accepted” by the couple’s three children and a son from his first marriage
that the deceased had made “insufficient provision” for his widow by leaving her about 18 per cent ($1.7 million) of the distributable estate
The will directed that three of the deceased’s children – his son and the couple’s two daughters – should each inherit one of the Balmain properties
accounting for individual shares of between 19 and 27 per cent
The couple’s son was to receive one-third of the Razorback property
with the remaining two-thirds to be given to the widow
The judge concluded the widow should receive a $2.7 million share of the estate
He found the most “just and equitable” outcome would be for the son from the deceased’s first marriage to bear most of the burden of the additional provision
That son had been left the Montague Street property in the will
but Hmelnitsky raised the prospect that he could swap that for the two-thirds interest in the Razorback property
Two of the three Balmain properties are located in Llewellyn and Montague streets.Credit: Steven Siewert
The judge said this option “does the least violence to the overall scheme of the will”
which did not contemplate the Balmain properties being sold
The widow and the couple’s two daughters had “particular sentimental reasons” for wanting to keep those properties in the family
The only way the estate could be administered without selling the Balmain properties was “if some or all of the beneficiaries are willing to put the estate in funds to make further provision for [the widow] … and to help meet administration costs”
One daughter told the court she would be willing to borrow up to $500,000 to pay to the estate
The number of family provision cases filed in the NSW Supreme Court has increased steadily over the past 20 years
principal of Sydney law firm Tiyce & Lawyers
said the judgment “shows the human face of these cases” and it was a “great example” of a judge considering the complex needs of families in arriving at a decision
Family provision orders helped “ameliorate what can be harsh decisions made” in a will
but the court would give effect to the wishes of the deceased to the fullest extent possible
Tiyce said a “convergence” of factors had helped drive the boom in family provision claims
including “the absolute explosion of Sydney property prices” and generational wealth transfers as older Baby Boomers died
“There’s actually more money for people to be having fights about,” he said
But Tiyce warned lawyers needed to be cognisant of the cost to the estate of running the cases
and potential adverse cost consequences for clients if they lost in court
Tiyce said a good lawyer drafting a client’s will would ask whether they had made proper provision for their family
Lawyers might also help clients prepare what was known as a “Section 100 statement”
which “essentially acts as evidence from the grave”
that no provision was made for a child in a person’s will because they had already bought them a home
An executor may need to use that document in court in the future
really useful documents when people are drafting wills,” Tiyce said

The number of family provision cases filed in the NSW Supreme Court has increased steadily over the past 20 years, from 655 in 2005 to 968 last year. More than 1000 cases were filed in 2016, before the figures dropped slightly. Some cases settle before trial.
Michael Tiyce, principal of Sydney law firm Tiyce & Lawyers, said the judgment “shows the human face of these cases” and it was a “great example” of a judge considering the complex needs of families in arriving at a decision.
Family provision orders helped “ameliorate what can be harsh decisions made” in a will, Tiyce said, but the court would give effect to the wishes of the deceased to the fullest extent possible.
Tiyce said a “convergence” of factors had helped drive the boom in family provision claims, including “the absolute explosion of Sydney property prices” and generational wealth transfers as older Baby Boomers died.
“There’s actually more money for people to be having fights about,” he said. But Tiyce warned lawyers needed to be cognisant of the cost to the estate of running the cases, and potential adverse cost consequences for clients if they lost in court.
Tiyce said a good lawyer drafting a client’s will would ask whether they had made proper provision for their family, including children, grandchildren and de facto partners.
Lawyers might also help clients prepare what was known as a “”, Tiyce said, which “essentially acts as evidence from the grave”. It might set out, for example, that no provision was made for a child in a person’s will because they had already bought them a home.
An executor may need to use that document in court in the future.
“They’re really, really useful documents when people are drafting wills,” Tiyce said.

Campaign Against Moral Persecution foundation member and 78er Peter De Waal AM is finally telling his life story in the memoir It Wasn’t Dutch Courage which looks back on his over fifty years of LGBTQIA+ activism in Australia.
The 369 page book is being launched at the Balmain Town Hall this Friday, April 4 from 6pm and attendees will be able to purchased signed copies of the book at the event.
“From the ashes of early WWII traumas rises my journey—an immigrant’s struggle for personal liberation, a relentless fight against injustice, and a love that defied silence,” De Waal says of the book.
“From the birth of Australia’s first national gay rights movement in 1970 to the battles for legal and social equality, my memoir bears witness to a history too often erased. It’s a testament to those who dared to speak out, stand together, and demand change.”

referee Tim Mander blew his whistle on a 42-14 defeat to the Raiders
drawing the curtain on 91 years of Balmain in the top grade
In the stands there was sadness and anger that it had come to this
Twenty-five years on and that mixture of feelings remain for me
To be a fly on the wall in the dressing rooms post-match
I wonder what it was like for players and staff
A collection of young men not knowing perhaps what the future held for them; how did Tiger icons such as Wayne “Junior” Pearce and super fan Laurie Nichols react in the moment
it was almost impossible to concentrate on the game
a more experienced Raiders outfit were the better team on the day
Goodbye to what we knew and what felt like home
We cheered with gusto as Darren Senter and Laloa Milford crossed the try line
We shadow-boxed with Laurie for one last time
None of us wanted to hear that final whistle from Tim Mander – that piercing sound cut across a crisp Canberra afternoon breeze like a knife
Final game … Balmain fan Laurie Nichols with James Webster after the Tigers last game in 1999Credit: Paul Harris
Throughout the match I found myself eavesdropping on conversations nearby
I was a 21-year-old uni student and attended with my mate Stu
The only hurdle that day was hoping there was $2 in loose change in Stu’s XE Ford Falcon glove box to buy a Big Mac on the way to the match
the team came over to our pocket at Bruce Stadium for a goodbye
Old-school photos were taken – for anyone reading this under 25 that means taken by a camera with actual film that had to be developed at a Kodak centre
Autographs were signed and we all just lingered and hoped to stay in the moment
I wasn’t ready for closure and I suspect neither were those around me
The players eventually departed for the sanctuary of the dressing room
A few thousand Tiger fans marching in silence
Trying to locate Stu’s XE Falcon in the car park
I shed a tear and dispelled the myth that Balmain boys don’t cry
Twenty-five years now gone since that historic day
It feels like an occasion that should be recognised
Twenty-five years and I’m still angry the NRL forced our hand to merge
the Bears are coming out of hibernation and now PNG
The game found a home for more teams eventually
Do the NRL care for those of us left behind or are we just collateral damage
When I read the headlines in 2023 that the Blue Wiggle was going to save us
I clung onto that hope for two hours like someone lost at sea would a life raft
The first sign of hope in 24 years was but a mirage
or as the Balmain Tigers executive put it that day “fanciful and unrealistic”
Twenty-five years and I still hold the begrudging acceptance it had to be this way
the club doesn’t have coin stashed in the bank
The economics didn’t stack up and many good Balmain people weighed it all up in 1999 and decided a merger was the best way to go to preserve as much history as possible
It is great Balmain fans have the opportunity to continue the connection through the Wests Tigers and there is now a new generation that only know the new identity
The Balmain club is doing a great job with things such as the new website and merchandise and still giving local kids a pathway to the top
Am I just living in the past and need to move on
Twenty-five years and I still hold as much pride
joy and gratitude for our great club as ever
I’m still that 10-year-old who wished the tactic of flying Blocker over to the UK to serve his suspension would get him to the grand final
I’m still that teenager who read every page of Sirro’s autobiography three times over and wrote him a fan letter
I’m still that daggy uni student who thought wrongly that girls would be impressed and talk to me while I was wearing a fluorescent orange Balmain tracksuit
Twenty-five years and I am still a Balmain Tiger
Whatever the 25-year passing of time means to you
I hope you can find the opportunity to pause and reflect at some stage on your memories and the joy it has brought us all to have been a supporter of the mighty Balmain Tigers

despite spending hours chasing his kids around
is struggling to fit into his old footy jumpers
