MONTROSE, Colo. – The Bureau of Land Management has finalized a supplementary rule implementing decisions pertaining to motorized and non-motorized travel, day-use areas, camping, and seasonal wildlife habitat in the Tres Rios Field Office and the Silverton area of the Gunnison Field Office
The rule applies to BLM-managed public lands in Archuleta
excluding public lands within Canyons of the Ancients National Monument
These measures respond to growing visitation by restricting certain activities and defining allowable uses in special management areas to provide for visitor health and safety
and prevent degradation of natural and cultural resources
“The BLM worked closely with the local communities to develop plans with a shared vision for managing a wide range of public land resources and resource uses,” said BLM Southwest District Manager Stephanie McCormick
“This supplementary rule implements decisions that support the unique quality of life enjoyed by our Southwest Colorado communities.”
The BLM manages more than 245 million acres of public land located primarily in 12 western states
The BLM also administers 700 million acres of sub-surface mineral estate throughout the nation
and productivity of America’s public lands for the use and enjoyment of present and future generations

Water Services management explored the idea of a wetlands project to assist in the final phase of the wastewater treatment process as a means to reduce the cost normally associated with traditional methods
but while still following Clean Water Act rules. The testing phase of the wetlands process required the construction of test cells (see photo below) that proved the concept worked

Army Corps of Engineers (ACOE) received approval from Congress for the Tres Rios Ecosystem Restoration and Flood Control Project
The City of Phoenix partnered with the ACOE to improve and enhance a seven-mile long
almost 700-acre section along the Salt and Gila Rivers in southwestern Phoenix
The project received 65 percent of the funding from the ACOE
with 35 percent coming from the local sponsor

This plant was originally brought into this country in the 1800s as an ornamental plant
staff started to realize the danger of importing foreign plants into the fragile desert environment
Sonoran Desert wildlife has lived with native plants for millions of years
The plant and animal communities have evolved together
with the animals using the plants for shelter and food
and the plants using the animals for seed dispersal
Native plants are perfectly suited to sustain native animal populations
the salt cedar has displaced many of the native plants
The salt cedar invasions have thrown off the natural balance between plants and animals
making survival more difficult for the native wildlife
Tres Rios staff removed large tracts of salt cedar and replaced it with native cottonwood/willow riparian corridors
where the salt cedar is very thick and will be impossible to replace
the river sediment will be dug down and filled with water
This will prevent regrowth of the salt cedar
and offer a clearer channel for flood flows to utilize

Although a series of executive actions in late January 2025 effectively stopped the flow of those seeking to migrate to or apply for asylum in the United States, the Tres Rios Border Foundation is continuing its work of supporting those serving the needs of people who have migrated or are being expelled from the country

John Nelsen is a long-time border advocate who serves as partner liaison for the group
and its predecessor organization the Presbyterian Border Ministry
change over the 33 years he’s been active at the border
and a changing legal and political landscape have all required Tres Rios Border Foundation to adapt
“We are still here,” Nelsen said of the fear that was inspired by the cartel wars back in 2009-2013
“The reality then was that we still went across (the border to be with partners)

it had to become our thing because we were seeing massive numbers of people migrating.”
The group incorporated under Tres Rios Presbytery in 2020 and soon hired a part-time director

Pumroy says that’s where those who have learned the stories of migrants and asylum seekers start to work on their behalf
“Anybody can enter in any of those points and participate in this type of mission work,” she says

Tres Rios Border Foundation supports Abara’s network of 12 shelters — most housed in churches and served by pastors
they host a quarterly luncheon where pastors and their families unite for fellowship and spiritual refreshment
They provide necessary car maintenance and repairs for these pastors who often use their personal vehicles to transport migrants to various appointments
They’ve offered money and opportunities for pastors to have respite
such as having a meal out or taking in a movie
and funded vacations to be reunited with their families they have not seen in four years due to the nonstop requirements of serving both a church and a shelter
“These pastors are killing themselves,” Nelsen says
“They’re serving the church and the shelter
and I tell everyone in my presentations how committed they are.”
Abara hosted 33 border encounters; Tres Rios Border Foundation hosted six
Each encounter is a three-day educational excursion for groups on both sides of the border
The group’s schedule has filled for 2025 and they’re asking people to look at 2026 for future border encounter bookings
Funded by presbyteries, a few churches and many individual donations
Tres Rios Border Foundation believes it could expand its border encounter offerings and support for shelters and hospitality sites in El Paso and Juarez
The encounters are an opportunity for Presbyterians to meet people who live on the border
and to form their own opinions — based on their faith — on how migrants and migration should be addressed in our churches and in government

AZ — Seeing smoke in the West Valley on Wednesday
A prescribed burn is being monitored by Phoenix firefighters and the Arizona Department of Forestry and Fire Management
The burn is in the Tres Rios Wetlands area

The Phoenix Water Service says the prescribed burn is part of ongoing efforts to improve the ecosystem and eliminate invasive plant species
It will also provide wildfire training for Phoenix firefighters
Ninety-first Avenue is closed in the area during the burn
Broadway Road is also expected to have extra congestion in the area

– Annual seasonal closure of wildlife winter range goes into effect on December 1 for public lands in the Durango area managed by the Bureau of Land Management (BLM)
These closures will remain in place through April 30 to protect wintering mule deer and elk that move down from higher elevations to ride out harsh winter conditions
Closures may be lifted earlier if mild conditions permit
The BLM coordinates with Colorado Parks and Wildlife and the City of Durango to identify key wildlife areas for protection while continuing to offer areas open for winter recreation
“Lands under BLM jurisdiction provide critical wintering areas that enable wildlife to make it through the tough winter months,” said Tres Rios Field Manager Derek Padilla
“It’s important that we work with our partners to protect this important resource.”
Colorado Parks and Wildlife data on deer and elk movements throughout the year indicates that closing areas to human activity protects critical foraging habitat and enables animals to conserve energy for winter survival
The following Durango area trails are closed to public use:
the Perins Peak area east of County Road 208 and west of Hogs back is closed through July 31 to protect nesting peregrine falcons
the Summit areas within the Montezuma Triangle Recreation Management Zone and a portion of the Cortez Special Recreation Management Area

The mission of the Tres Rios Foundation is to inform PC(USA) congregations about immigration issues and processes and connect them to real ministry and ways to help on the border and beyond
“What we are trying to accomplish — an encounter — is really the best way to experience the border,” Nelsen said
Groups often comment that what they learn while they are on the border is very different from the information they receive via the news back home
Tres Rios is hoping to change that narrative
“We want people to be able to see and hear and experience what is really going on,” he said
The Tres Rios Foundation is also working toward system change
In the midst of debates on immigration and the migrant situation
there is one thing that most everyone agrees upon: The system is broken
The foundation’s desire is that these Border Encounters will have a lasting impact on those who participate
“I don’t know anyone who has gone through this experience who has not been changed personally as well,” Nelsen said
The Border Encounter is a three-day immersion experience into the issues of the border
A fundamental question to consider when trying to understand the border is
“How do people arrive at the border and why?” There are three main misconceptions
The first is that most migrants choose to leave their homes for a better life
and natural disasters don’t have a choice,” Ledbetter said
The second misconception is that El Paso is a dangerous and chaotic city. Statistically El Paso is actually one of the safest cities in the U.S. “This city of immigrants is the kindest I’ve ever lived in,” Ledbetter said
The third misconception is that there exists a fair and reasonable process for immigration
The reality is that legal avenues have not been updated in decades and that all available avenues are difficult and lengthy
Ledbetter is quick to point out that the Border Encounter is not “border tourism.” “This experience is at the invitation of local leaders to amplify what the border can teach us,” he said
The distinction is an important one for the Tres Rios Foundation
“We are trying to move away from the old mission trip mentality of going and doing for and toward a mutuality and doing with,” he said

“Here we have reeds and on the other side you have cottontails and patches of Pennyworth,” said Martinez
“The valley doesn't really have the climate to sustain this naturally

"We do have bald eagles out here from time to time,” said Martinez

Travel Area 1 (TAP1) consists of about 92,000 acres of BLM-managed lands within Archuleta
and Montezuma counties. Travel Area 2 consists of BLM-managed lands and routes within Dolores
which are being considered in a separate NEPA action currently in pre-planning
TAP1 is characterized by BLM-managed lands primarily in the vicinity of urban areas (Durango
These lands include a number of special recreation management areas (SRMAs) designated for motorized and non-motorized recreation
Other areas within TAP1 include the Weber and Menefee Wilderness Study Areas (WSAs) and other dispersed BLM-managed lands
Resource uses in TAP1 area include recreation
and public use rights-of-way. Per land use designations in the 2015 Tres Rios Resource Management Plan
approximately 13,000 acres are ‘closed’ to motorized traffic and 18 acres are ‘open’ without limitations
The remaining approximately 79,000 acres are classified as ‘limited’ and allow traffic on routes either designated through previous planning decisions or through this document
The TAP1 decision designates 4.6 miles of two-wheel-drive road
3.1 miles of trail for motorized use (by OHVs and rock crawlers)
and 1.2 miles of trail for non-mechanized use and authorizes Class 1 e-bikes on trails in the following areas: Chutes and Ladders Recreation Management Zone (RMZ)
Mud Springs RMZ and on the North Menefee trail outside of the Menefee WSA. Additionally
the decision creates or improves parking areas (access points) and OHV “play areas.”

Nazario Prieto with the Phoenix Water Services Department says prescribed burns are the best way to control plant growth
they use just a lot of people to come in and cut some of the reeds and some of the excess vegetation," Prieto said
"It's just extremely time-consuming and inefficient."
Prieto said the burns will provide training opportunities for the fire department and that this burn won't be the last in the wetlands
"We're hoping that over the next five to seven years
we can go through the whole wetland and then after that maybe instead of every year
every third year — something like that," Prieto said

the Tres Rios Wetlands form a bustling tapestry of nature
home to more than 150 species birds and animals
The captivating colors showcase an impressive plant community of marshes
bulrush beds and mesquite bosques that each year lure thousands of migratory birds
were established as part of a rehabilitation project in and around the Salt River to restore the natural habitat of an area that had been severely degraded
Supreme Court decision threatens the future of the area
along with millions of other acres of wetlands across the country
the court curtailed the Environmental Protection Agency’s authority to regulate the nation's wetlands and waterways under the Clean Water Act
The challenge to the regulations was brought by Michael and Chantell Sackett
an Idaho couple who bought property on what an appeals court called a “soggy residential lot” next to Priest Lake
a 19-mile stretch of water fed by mountain streams and bordered by state and national parkland
After the couple started preparing the property for construction in 2007
the EPA halted construction and ordered the Sacketts to return the property to its original state because they had failed to get a permit for disturbing wetlands
the high court sided with the Sacketts and rolled back longstanding rules adopted to carry out the 51-year-old Clean Water Act
It was the court's second decision in the last year limiting the ability of the agency to enact anti-pollution regulations and combat climate change
Justice Samuel Alito said that the “navigable waters” of the United States
as defined under the Clean Water Act and regulated by the EPA do not include many previously regulated wetlands
the Clean Water Act extends to only streams
and those wetlands with a "continuous surface connection to those bodies."
That means wetlands that are not directly connected to a flowing body of water will no longer be monitored for pollution or be protected from development
This decision will affect millions of acres of wetlands across the country that play a vital role in maintaining water quality
providing habitat for endangered species and flood control
the question of what water bodies will be affected is still up in the air
as many of the state’s rivers do not flow year-round
Tres Rios Wetlands sits next to the Salt River
but are not connected through surface water
thwarting federal protections for the 700 acres of land
“A vast number of wetlands that were regulated and required permits under the clean water act no longer do because they are no longer defined within the jurisdiction of the act,” said Stephanie Stern
a professor of law at the University of Arizona who focuses on climate adaption policy and water law
“This is very much a shifting of power from federal to state government.”
Justice Brett Kavanaugh joined the three liberal justices in a concurring opinion and said the decision would harm the federal government’s ability to address pollution and flooding
“By narrowing the act's coverage of wetlands to only adjoining wetlands the court's new test will leave some long-regulated adjacent wetlands no longer covered by the Clean Water Act
with significant repercussions for water quality and flood control throughout the United States,” he wrote

How wetlands play an important role in a watershedIn the early 1970s
the newly created EPA commissioned hundreds of freelance photographers to document the state of the nation’s land and water
Photos emerged of the devastation humans had caused on the environment: trash and old tires piled along the shores of Baltimore Harbor
and a smoggy sunset in Philadelphia documented the degraded state of air and waterways throughout the nation
It was one of the first times for many Americans to see the widespread damage caused by humans
and the photographs were fundamental in the creation of the Clean Water Act
The act established a basic structure of regulating discharges of pollutants into the waters of the United States and regulating quality standards for surface waters
preserve biodiversity and ecology and maintain the value of watersheds across the country
Wetlands play an integral role in the ecology of the watershed
high levels of nutrients and primary productivity create ideal conditions for organisms that form the base of the food web and feed many species of fish
Many species of birds and mammals rely on wetlands for food
“Wetlands aren’t the most charismatic of the water bodies and I think it’s been harder to get protection for them,” Stern said
Wetlands can even be used as atmospheric maintenance
as they store carbon within their plant communities and soil instead of releasing it to the atmosphere as carbon dioxide
helping to moderate global climate conditions
The new ruling will limit protections for millions of acres of wetlands
its implications for Arizona and the West may not be so clear
due to the relatively high number of intermittent and ephemeral rivers and streams throughout the region
These are temporary or seasonal rivers that do not have a consistent flow of surface water throughout the year
ephemeral and intermittent rivers are more common because of drought and their reliance on snowmelt mountain runoff
the term “navigable waters” meant all waters of the United States
and made it a criminal offense for industries to pollute or degrade waterways unless they had permission through a permit
But two Supreme Court cases in 2001 and 2006
brought through challenges by a municipal waste agency and real state developers
began adding exceptions to what water bodies could be protected
The rulings prompted the Obama administration in 2015 to release a 400-page report titled, “Connectivity of Streams and Wetlands to Downstream Waters.” The review
laid out a hydrological understanding of how water sources interact with each other in watersheds
The report would be used by the administration to reestablish protections for wetlands removed by those court rulings. The protections would later be undone by the Trump administration and then reinstated again by President Joe Biden

A perennial water source may be a primary waterway
but ephemeral and intermittent streams and rivers will feed into it
And adjacent wetlands are either connected through the surface
expanding and contracting with the volume of water present
All water bodies in this sponge will share organisms
as water is transported above or below the surface
all bodies of water in a watershed become intrinsically connected
including the sort of isolated wetlands that have now lost protection
With no regulations for these adjacent wetlands
the likelihood of pollutants entering perennial and ephemeral streams and rivers is greatly increased
either by surface water through a flood event
there has been a tremendous advancement in our knowledge of hydrology and how interconnected water is both above ground and underground,” Stern said
moves us backwards to a very segmented view rather than a science-based view of the hydrological connectivity.”
It is now up to the state to establish and implement regulations on water quality for unprotected wetlands in the state
under rules enacted by the Arizona Legislature
the Arizona Department of Environmental Quality said: “The recent U.S
is a significant decision that has the potential to affect how all 50 states protect wetlands and water resources and implement the Clean Water Act
ADEQ is carefully reviewing the case and collaborating with other states to ensure that the Environmental Protection Agency and the Army Corps of Engineers provide the guidance states need to implement the changes directed by the Court
The decision provided direction and clarification regarding how the CWA applies
the decision did not directly change the current regulations for what waters are regulated under the CWA.”
After the Navigable Waters Protection Rule went into effect
the Arizona Legislature voted to extend protections similar to the Clean Water Act to Arizona’s wet waters that no longer fell under federal jurisdiction

ADEQ created the Surface Water Protection Program, which served as the basis for HB2691
passed by the Legislature and signed into law by Governor Doug Ducey in May 2021
Later that year, ADEQ implemented the SWPP and released its Protected Surface Waters List that specifies all waters protected by the Clean Water Act and the new SWPP
But the list of newly protected water omitted Tres Rios Wetlands
despite language in the bill that stated all protected surface waters shall include “perennial or intermittent wetlands adjacent to waters on the protected surface waters list.”
Surface water connects Arizona to each of its neighboring states
The Colorado River is a significant source of water for seven states and 40 million people throughout the West
“If the states don’t regulate with sufficient stringency
you could have these border issues and spillover issues between states because of that interconnectivity,” Stern said
“It’s going to be a big problem because if you are connected
to a state that is developing its wetlands and not protecting water quality
development will be allowed on some wetlands unless the state explicitly outlines its own regulations
activities such as grading and demolition create pollutants that can migrate off sites and harm waterways
Sediment is one of the main pollutants of concern because it absorbs toxic chemicals that can be transported and deposited into other areas
Sediment destroys habitats for small animals that live on the bottom of streams and can clog fish gills
stormwater washes over the loose soil on a construction site
and through any other materials being stored outside
it can pick up other pollutants like chemicals
These pollutants can be transported to nearby storm drains or washed directly into waterways
With no way of regulating wetland pollution
these toxic chemicals now have a greater chance to go into the “sponge” and affect rivers and streams that share the watershed
Water pollution is also considered one of the top threats to aquatic biodiversity
habitat degradation and change in migration patterns
Wetland ecosystems host remarkable biodiversity: 40 percent of all plant and animal species live or breed in wetlands
according to the International Organization Partners to the Convention on Wetlands
In 2020, the group released an emergency recovery plan
which outlined six priority actions to curb freshwater biodiversity loss in wetlands
The plan acknowledges the Clean Water Act’s role in slowing and reducing point source pollution
But the plan also recommended stronger water quality monitoring to protect wetlands and biodiversity
Conservation groups say the latest court decision is a major blow to advocates who have been hoping for stronger protections
More than one-third of the threatened and endangered species in the U.S
and nearly half use wetlands at some point in their lives
dozens of endangered and threatened species rely on wetlands for habitat and as a water and food source
the threatened Chiricahua leopard frog is now found in fewer than 80 ponds
which means its entire range will lose protection under the court ruling
And while wetlands foster biodiversity and protect wildlife
Wetlands act as natural sponges that trap and slowly release surface water
“Wetlands are an important means of flood control
so this has implications for that too,” Stern said
“Because if the wetlands are receiving less protection and are being developed
then that will increase our flood severity and flood risk.”
The holding capacity of wetlands helps control floods and prevents water logging of crops
Preserving and restoring wetlands together with other water retention can often provide the level of flood control otherwise provided by expensive dredge operations and levees
The bottomland hardwood-riparian wetlands along the Mississippi River once stored at least 60 days of floodwater
they store only 12 days because most have been filled or drained
Some people are concerned that the court’s dismissal of the EPA’s science-based regulations could signal other environmental rollbacks from the conservative court
Last year the court also rolled back the EPA’s power to curb emissions under the Clean Air Act
saying the agency cannot put state-level caps on carbon emissions
“I think this does set the stage for more limitations,” Stern said
or the decision to not have environmental regulation
Justice Elena Kagan wrote that the majority’s rewriting of the act was “an effort to cabin the anti-pollution actions Congress thought appropriate," and referenced the court's 2022 decision to curtail the EPA’s authority to regulate power plant emissions
the court had appointed itself as the "national decision maker on environmental policy.”
